So I purchased cell phones that had rebates attached to them (bad move #1). But you couldn't submit the rebates until 6 months after the start of your service (bad vibe #1). So this was Jan of 07 and I submiited the rebates in July of 07. I kept calling to find the status of the rebates and was pushed off as "few more weeks). Then suddenly in December, the call center had this info:

Notice regarding rebates sponsored by InPhonic, Inc.

On November 8, 2007, INPC, Inc. (formerly InPhonic, Inc.) filed a voluntary petition for reorganization under Chapter 11 of the U.S. Bankruptcy Code. The filings were made in the U.S. Bankruptcy Court for the District of Delaware.

If you ordered a wireless device from INPC or one of INPC's affiliates before November 8, 2007 and your order included rebates with a submission address of White Bear Lake, MN, you will be receiving communication(s) pursuant to the procedures of the U.S. Bankruptcy Court regarding any approved rebate claims.

Great, so this was in Nov. I have yet to receive any communication. Does this pretty much mean I am out of the rebates they owe me? Or are they going to restructure and have the money to pay people? Can someone translate? :huh:

Sounds to me like they're going to try to get out from under the rebates. I wouldn't expect any money back from them.

That said, if you have any problems with them, you can probably leave your contract, as they have broken the original agreement. Don't hold me to that, though.

I would guess the chances are mighty slim on any kind of recovery... even if they do try to restructure, the secured creditors are standing first in line.... After they have been satisfied then the unsecured creditors get in line.... more than likely after the secured creditors get what they need... nothing remains in the estate to distribute....

I think that there's not much of chance you'll get your rebate. I hope you're still not w/ the cell service you were provided by purchasing these phones? We purchased a phone, through our service provider, that had a rebate attached to it and we received the rebate w/ in six weeks. It shouldn't take more than two months to process a rebate...not a year.

Is there a possibility you can take the phone back to the retailer you pruchased it from bring in th eletter and ask for a refund based on breach of contract, let them know you purchased the phone because of the rebates and now since it appears as though rebate will not be honred can you get a refund and at least geta different phone?
