Our RFE

We just had the RFE for the income proof on Dec 18th, and resent to the USCIS on Jan 22nd. I wonder they didn't ask about the medical? Cause I just filed my childhood vaccination records with the AOS, not sure if I have to hand in my I-693 at our interview later??? Anyone in Rochester NY who can suggest a panal doctor to me? Thanks!! P.S. I came to USA with K-1 visa last Sept and I did my medical in Hong Kong last March.

Outside of the US the doctors are called Panel Physicians. Inside the US they are Civil Surgeons. You can find the ones in your area by going to USCIS Civil Surgeons Locator.

No, unfortunately... she didn't seem to know what to do. (Although I can try contacting her and see if there is any news on the situation... but she really didn't think it was worth it and said I'd be waiting awhile... which I found strange since others have been successful in short time and it seemed like she just had no idea what to do.) We're not sure what to do now either, and are a little worried that USCIS won't accept what we ended up sending... a copy of the medical that I asked for at the border along with a note explaining the situation and where they could find a copy if it wasn't sufficient (we found out that the US Consulate in Montreal has a copy that they say they will grant to immigration upon request,) and also expressing willingness to do the medical again if it is really absolutely necessary. Unfortunately, not knowing what their response is going to be is making us reluctant to use the AP to travel to Canada, just in case they deny it anyway. Part of me is wondering if we should schedule an appointment with a CS and just go ahead and do the medical anyway and send it... we're probably going to try calling USCIS this week as well. We're hoping they'll surprise us with an approval, but I have to admit, I'm a bit worried we'll get a nasty officer looking at my case

Thanks Lona! Hopefully we'll find out soon and won't have to wait a long time we're really anxious to go to Canada to visit our family hopefully you get your green card soon! Looks like they're looking at your case!

We had a similiar situation and they requested a new I-693. Get a new complete physical by the Civil Surgeon in the sealed envolope and send them exactly what they request or the will deny. We were denied and now have to refile the whole AOS and EAD and get a new medical, which costs a hell of a lot mre than just a completed physical......talking from experience....they don't give second chances if you send a copy, and don't trust what they tell you on the phone. It is what is in writing on the RFE that they go by.

I have some good news! It's not the BEST news yet... but at least it sounds promising. I wrote my congressman's rep again and she wrote me yesterday, and then again today, and said she spoke with someone in California today and is going to be in touch with him. She kept insisting that I would be safe to travel this weekend as well and telling me to have fun. She told me not to worry... it would be resolved. She said they didn't get what I sent yet - not sure what's up with that as we sent it by USPS and it was received in California last week, so maybe it just didn't get sorted out yet.

So, anyways, we'll see! Looks like we're going to go - we've been wanting to surprise our family in Canada, and we miss them tons!

We contacted our Congressman who contacted the USCIS who said the medical was lost and needed to be re-done.

So, contacting your congressman can be a waste of time, because the USCIS will tell them the same thing they tell you.

Sorry, but unless you have a really helpful congressman that will go to bat for you I think its best to just re-do the medical.

Or maybe you just have to be a little more ''forceful'' with your congressman. At first I thought our congressman rep wasn't going to be much help but now she is proving to be quite helpful. We might have to do it again but I'm thinking it's less likely! Which USCIS office did your congressman contact? I think a big part of the problem is that while sometimes medicals probably really do get lost (which is unacceptable to be happening so often if you ask me), a lot of the time it's not really true, and they do have or can find the files - if only they would be more serious about looking into it - they don't always tell them the same thing they tell us. If everyone just keeps re-doing the medicals then this problem with them "losing" medicals (which is totally unacceptable!) will never be resolved. Even if we do end up having to do it again, we don't want it to keep happening to a lot of other people. Not saying anything is wrong with your choice... this is just how we feel and our situation is looking hopeful now.

When I spoke with my congressman's immigration rep told me she emailed directly with the CSC (where our case was transfered) and that they said our medical was not in the file.

I am curious- what did your congressman's office tell you? Have they communicated yet with the office handling your case? Did they find your medical?

I am very concerned now because I did sent a letter to the USCIS stating that they have the medical (we wouldn't have gotten the K1 if he hadn't!!) in response to the RFE package. I did challenge them. But now since they are insisting they lost it, I am scared our whole application will be denied because we did send in the medical with the RFE!!

I agree that we should try and get the USCIS to be held accountable so that they do not force people to waste extra time and money on another medical. But on the other hand what is the way to do that?

She spoke with the folks in California as well, but I'm hoping she spoke/will speak with the National Benefits Center as well - according to another thread on here, the person's medical was at the National Benefits Center (I think) and they had two types of files - main and temporary... and the medical was in the ''other'' one. I'm not sure what that all means but our congressman rep was looking into it. They haven't found it yet that I know of but she is insisting the problem will be resolved.

Wait - you sent in your medical??? A new one??? I wouldn't think it would be denied??? We were afraid ours would be denied because we sent in a copy - unsealed - that we obtained at the border, as our RFE...

No, we did not send in anything for medical but the vaccination supplement. As I write this my husband is at the doctor re-doing the I-693.

Our RFE is due 2/26 and with no definitive answer from the USCIS or our congressman except that it is lost, we are going to send in a new, sealed medical.

Sigh.

You can't fight city hall?
