Hi,

My wife (k-1 fiancee visa recipient, now married) recv'd an I-797C, NOA saying her (and her 5 yr old child) I-485 was rejected for the following reason:

"The check amount is incorrect or has not been provided. The correct filing fee is $930.00. Each applicant between the ages of 14 and 79 must also include an additional $80.00 fingerprint fee. Please resubmit the aplication with the appropriate fees to the address listed on the bottom of this notice"

I believe I sent the correct amount... a personal check in the amount of $1,610.00.

$930(filing fee) + $80(fingerprint fee) + $600(for the child) = $1,600

Does anyone have an idea of what I may have done wrong?

Hi,

Happened to us too and caused over a month of delay in the process what we did was made separate checks for $930, $80, and $600 (if that's the fee they indicated, i don't know about child) total of 3 checks and not the sum in all one check.

you sent them the correct fee..but how old is the child you're including in your petition?try calling them and ask them or go to the nearest USCIS in your place and discuss your problem with them..im sure something is wrong with your application..my friend too had the same problem but she just change her personal check.. :) i hope you'll find out what is wrong with them..

I have also sent in separate cheques, one for myself for $1010 and 2 separate ones for the kids each. the application instructions state that the biometric fee and the form fee can be combined in one cheque but there are no instructions about payment submission for accompanying kids.

you should call to confirm though if this was the issue.

It is indeed best to have separate checks. Even if it is her child, their applications are likely to be processed separately. Just do separate checks and send the applications again. Make sur to attach each check with the proper application it belongs to.

I can only tell what I did, and which is sending two checks, one for me, in value of 1,010, and one for my daughter, in value of 600 USD.

According to the instructions for I485 (instructions that you can find on USCIS site (http://www.uscis.gov/files/form/i-485instr.pdf ):

"What Is the Filing Fee?

You may submit one check or money order for both theapplication and biometric fees, for a total of $1010.00.

The filing fee for a Form I-485 is $930.00.

The fee is $930.00 only (no biometrics fee required) forapplicants under 14 years who submits Form I-485independent from other family members.

The fee for a child under the age fourteen years will be$600.00 when submitted concurrently for adjudication withthe application of a parent under sections 201(B)(A)(i), 203(a)(2)(A) and 203(d) of the INA."

So, the mistake which you have done, in my opinion, is that you included her child's fee on the same check.

According to their instructions, one check for 1,010 for your wife, and one for 600, for her kid.

Applications receive separate number cases, and it does make sense in a way that you send separate checks for each applicant.

PS I have also written on each check, accordingly: "For B.G-S" (my name)" and "For I.G" - my daugther's name, to make it more clear.

No problem so far and already approved AP and EAD. Good luck!

I'm not sure I understood correctly. You do need to complete a I485 form for your wife AND one for her child, so 2 forms in total.

To be more specific, you need to make 2 files as if for 2 separate persons, everything included in both of them. But you can send them in the same package.

At least that is what I understood from the instructions on uscis page that I gave you the link earlier, someone correct me if I am wrong.

If you did send only ONE I485, then it even more reveals why your check has been considered incorrect...

Total looks correct to me. You might try calling them or making an appointment or infopass

They need separate checks for each applicant.

Same thing happened to me, i sent it back and they rejected it again. Best thing to do is file separate cheques (checks whatever) and go from there. By the time you get your greencards you won't care about the cost difference.
