I got 221(g) in India HELP! ! !

hi,

My interview was today... and i am pretty much devastated as I got 221(g) for no reason. My case is as follows and I need your guys help.... I am 10 years younger than my wife... and this case of marriage is pretty much very very unusual in India.... The Consular officer a Lady asked me how did you meeet.. which chat rooom.. why did your wife get divorced and what dod you guys chat about... actually we dated 2 years ..she got divorced..then saved some money and came down here and got married to me... and in that time I could also be over 21 which is the legal age to get married in India....

There are 12 things listed in the list of 221(g)...... Of which I had the 7 of them in my hand.. which she refused to see and told me to submit to the VFS...... the other 3 things I neeed help which my wife has to get

1. Notarised statemennt describing and detailing how you met the petitioner and why you decided to get married.

2. Notarised Explanation from the petitioner on when and why her first marriage ended.....

3. Detailed contact info of each of the prior spouses.....

MY QUESTION IS :-

1)does my wife have to hire a attorney or she can do by herself by going to the loacl county court or get it done by a banking instituation and other such people which have the right to do notary in USA for things in point 1 & 2.

2) For her her ex husband... she has no info of her whereabouts.. what shall we do for that.. shall my wife give a letter in signing that she has no whereabouts of her exhusband.

PLEASE help ASAP.....

Do you think I would be denied or would they take tooo long to issue me my visa.... My kids and wife are waiting for me really bad....

For what they are asking ........is this because of the age difference between the two of you? You say it is .....this case of marriage is very very unusual for my country..... I am not familiar with your culture (so sorry) but when you say unusual do you mean that older women do not marry younger men per se?

Notarized statements for how you met ??? Wow, senior members should be able to answer this one, with online chat rooms and dating nowadays, it is pretty common for things to happen in the way they do. I am by no means an expert here, but seems strange on that issue. But I would give them all the information they request at this point and yes notarized (??why?? hmmm ) and pray for the best.

If they want you to write how you met, what went on etc etc. then do so, and attach some emails, correspondences and letter or cards. This is what our lawyer told us awhile back in case the question did come up, but we could fill up a car with that stuff. She also said that as long as my previous divorce was final, then that was not an issue with the embassy. They can ask, but can not deny as it is a legal marriage now and was a legal divorce prior to marriage. Stumped on this one. :wacko:

I wish you the best in this journey but only thing I can see from your post is what you said in the beginning about older women marrying younger men and here in the states that is no biggie, or even in the UK. But would that be any different than a man who is older marrying a younger woman, happens everyday and every minute.

What do they mean by her first marriage and when and why her marriage ended? What do they mean by when? Do they not have the divorce decree? Why? That would show on the divorce decree as something to the effect of irrecon difference etc. Do they want details of exactly why? But back to the WHEN PART?

The best I can tell you is to give them exactly what they ask for and hope for the best. You say your wife's most recent divorce was fairly recent. They'll want evidence her former husband no longer lives with her. She should at least have his Social Security number from an old tax form. "I don't know where he lives." is probably not going to work for you. It might, but she should make every effort to find out.

What you are overcoming is the suspicion that your wife is assisting your immigration by entering into a fraudulent marriage and that her divorce was to facilitate that. With that in mind, you helping her get her job, in my view, may actually hurt, not help.

Hi well I don't see any problem with the age gap. I am 34 and my wife is 47 they approved the visa on the same day. they asked a lot of question. I think phone bill, emails, greeting cards will help you. don't be panic just do what they want. they will approve . usually when I-130 is approved embassy respect the desicion of uscis.

They'll want evidence her former husband no longer lives with her. She should at least have his Social Security number from an old tax form. I dont think having his social security number is what they are looking for. They stated contact information. How are they going to contact anyone through a social security number? Perhaps they are trying to prove that the wife doesn't still live with her ex-husband.

Jigi - Your wife can go to people.yahoo.com to try to search there for his whereabouts there. If no luck, they provide links to outside sources that can find telephone number, address for a couple $$. Then provide this report to the embassy notarized that you have tried all attempts at locating a contact for him. Better to spare a couple bucks than risk the visa.

As for the other items they are asking for, have your wife write out a detailed letter of how you met, how you fell in love, etc., and notarize it. Here in the US you can notarize at almost any bank for $1-2.

Actually, I think Jigi paraphrased three of the items requested and left out the other two entirely. I've seen Consulates specifically ask for an X's SSN. If they didn't ask for it, then no worry but I would provide it anyway, if available.

Perfect. If he's ducking child support for her children, she'll have some documentation from her State authorities that indicates that, to back up her statements that she doesn't know his whereabouts.

2. if he in united states where did the divorce took place ??

3. what religion was the 1st marriage took place under ?? and/or was the marriage ever registered ??

I agree. Don't be nervous, Jigi. Just provide what the Embassy has asked for. Lot of people get 221(g). In USA, one does not need a lawyer to notarize. One can simply go to his/her bank where he/she will find at least one person who can notarize.

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

They have also asked me about the names and adddresses of the close relatives like brothers , sisters and etc of both petitioner and beneficiary.... do you think they will contact and call all of the people... Which I am worried and dont want to happpen as I have eloped and ran away from home to get marrried.

No one from my side knows I am married... if they embassy calls and my folks say something bad about me... WILL I be in problems

Yes, they might contact your relatives. Perhaps, it is the time to tell your relatives that you've got married.

They have also asked me about the names and adddresses of the close relatives like brothers , sisters and etc of both petitioner and beneficiary.... do you think they will contact and call all of the people... Which I am worried and dont want to happpen as I have eloped and ran away from home to get marrried.

No one from my side knows I am married... if they embassy calls and my folks say something bad about me... WILL I be in problems

Yes, they might contact your relatives. Perhaps, it is the time to tell your relatives that you've got married.

6/09 tax transcript for 2007 just became available -whoot

6/20 NVC receives everything nothing more to give them now just close eyes and pray

6/23 NVC enters into system

6/26 NVC - RFE uggh - wants all three years of Federal tax return listed and they lost originals or so they say - DING DING ROUND TWO

7/25 NVC Case completed whooottttttttt

8/7 Case forward to US EMBASSY LONDON OH YEAHHHHHHHH -

Embassy - case out for delivery to embassy via DHL sneaky us lol

08/10Received

08/19 Medical Exam completed - healthy oh yeah!!!!!!!!

9/26 @8am -Interview - approved VISA IN HAND OMG WHOOT!!! HELLO AMERICA MY LUV

POE- Atlanta then MCO - October 15th with the cat "GIT" on board lol - POE SUPER SWEET

Husband home finally - god what a journey....but after 400+ days we made it
