I have one little question,........

James and I want to get married on May 17th an seeing that that date could get pretty darn tight I would like to know if I HAVE to apply for the SSN BEFORE we get married or if I can just do that after the wedding in my new married name.

It really depends on the state - Marraige Laws By State. In Texas it is a requirement, but it is waived if you're unable to get one (I know, sounds odd, but is understandable) so perhaps it is similar in your state. In our case, we waited 8 days to apply for the SSN and received it about 10 days later so it ended up not being a problem either way. To find out for sure, check the link above and even better, call the court/office that issues marriage licenses and ask them directly - that's how we found out the requirement is almost always waived. :thumbs:

In Texas it is a requirement, but it is waived if you're unable to get one (I know, sounds odd, but is understandable) so perhaps it is similar in your state. In our case, we waited 8 days to apply for the SSN and received it about 10 days later so it ended up not being a problem either way. Thanks for the link above. My fiancee and I were planning to marry in Las Vegas, but the link mentions that you need to know your SS number for Nevada. My fiancee won't have a SS number at the time, so I guess we'll marry in California. I will call the offices to be sure. Thanks again for your information!!!

Social Security is federal and does not vary state to state. You can apply for your ssn after you are married. What varies is the requirements for marriage. IN the info that is posted by mnay states, it will say that you need your ssn number. However, you need to call and inquire since you will not have one. A marraige can still be performed if you can prove you are here legally. The information that is posted is for the most routine situations and questions and you are an exception. I know that when my husband and I went ot get married, the info said he needed is ssn. I explained that he was here from another country and had to wait to apply bc USCIC had to put him into the system and that is takes a couple of weeks before he can apply for ssn. They told me that all he needed was the documentation to show that he was here legally and we could be married. Take the time to call or send them an e-mail about your circumstances. Good luck!

:thumbs: Agreed. In Ohio, it states both parties need a SSN, but again, if you dont have one, you can't provide it, so you can still get a marriage license providing you entered the US legally. I would highly doubt Las Vegas, one of the largest marriage capitals in the world would without exception require a SSN for both parties. Call and check before you change your plans. Regarding the SSN, the law states one thing, but many offices, especially the smaller ones, dont deal with K1's often, so you may have a struggle to get one. I would just get it as early as you can and be done with it (or give yourself a cushion if they do question the non-USC's right to get a SSN)

We are getting married in Idaho on Monday, and here, a SSN is required to get a marriage license. However, if you don't have one, you can get a "denial letter". This is a letter that basically states that you can't get one for whatever reason (i.e. k-1 visa holder), and it waives the requirement. If you give this instead of your SSN, you can get your marriage license, no problem.

We are in California and got married in Las Vegas and noone wanted any SSN from us or anything. Just an ID for the marriage license, so I showed my passport (besides, we applied for the marriage license when I was just visiting here on tourist visa and didn´t even have K1 yet - noone had a problem with anything). After the wedding we went to apply for the SSN cuz here on VJ it seems like people do that after 2 weeks of being here, but the SS office said we couldn´t apply for it after 2 weeks of me being here and that we had to wait 30 days from my entry. So we waited another 2 weeks. They still issued my card in my maiden name cuz they needed a picture ID with my married name (said marriage certificate wasn´t enough for that purpose) and so I am gonna come back there after I get my CA driver´s license and have them change my name on the SS card :) It´s a bit weird but that´s how it went for us.

Most if not all locales have a procedure to issue a marriage license when one or both parties are simply ineligible to get a SSN. What if you were an Italian couple that simply wanted to get married in a particular state and then return home to Italy for your life. Will the locale deny them this opportunity? I doubt it. They will typically have a workaround but you need sometimes to ask them.

I not sure but that sounds like a passport from a foreign country...
