My niece have an F2B status. She just recently received emails from NVC including welcome letter and a notification to pay her Affidavit of Support. Her mother has actually paid for the AoS already. She is also pregnant and due to have her baby in June or July 2017. My question is, what does she need to do to make sure her baby will be able to immigrate with her. Should she hold off on filing out documents or paying any more fees until she has her baby and should she notify NVC to add her baby's name in her application and once baby is added to go ahead and proceed with the visa payments or any other payments? Will she get denied because of it?

Your niece is unlikely to get a visa before her child's birth in June or July when nothing has been submitted to the NVC.

 

Wait to add the baby to the case.  Once the baby is born, notify the NVC.  Send in a copy of the child's birth certificate with an English translation. After the child is added, then pay the fees and proceed with the case for your niece and her baby.

Thank you Jojo92122! So the $120 fee her mom paid for the AoS hasn't really started any paperwork correct? They haven't filled out or submitted any documents at all.

When she has to fill out the DS260 (not sure if that is the right number) it will ask for information relating to any children.  What is the daughter's PD? Because chances are she may have the baby before she completes this form and baby can be added.  Once added NVC will request some information as well as generate an invoice(s) for child for payment going forward.

Request embassy change: May 2013

Son born: September 2013 (added to petition March 2014)

Interview: March 17, 2015 (Joint sponsor needed)

Joint sponsor documents submitted: April 27, 2015

Visas approved and issued: April 30, 2015. Had to return to embassy to do oath for son :)

Visa in hand: May 5, 2015 (two working days after issued)

IV fees paid: August 10, 2015

POE: JFK - September 10, 2015 (one day before visa expiry date - No hassle)

Returned to Barbados: September 28, 2015

Green cards: October 5, 2015 :dancing:

Entered US permanently: March 22, 2016

Applied for SSNs: March 28, 2016 (didn't tick box on DS-260)

SSN received: April 4, 2016;

Learner's permit: April 7, 2016 (in NY you also have to do 5-hour class);

Driver's License: July 13, 2016 (on first try) :dancing:

Married: September 2015

I-130 sent: October 8, 2015 (via USPS)

Priority date: October 9, 2015 (WAC)

Petition approved: March 8, 2016 (5 months to the date of receipt) :)

NVC Welcome Letter: May 13, 2016
AOS documents sent: August 8, 2016
Case complete: September 14, 2016 (the waiting continues:clock:).

Interview:  October 5, 2017 (Approved - Issued following day :))

Visa in hand:  October 12, 2017

POE:  October 13, 2017

It's fine that her mom has paid the I-864 fee.  That does not change with adding the baby.  Wait to file the I-864 since mom will need to sponsor two immigrants.

 

Once the baby is added, the baby will need his/her own DS-260 fee.  So, there is a fee for your niece and one for her child.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
