I-130 and I-129F both approved, I-129F now in embassy

Hi guys, by taking a look at my timeline you can get an idea of what's been going on with my case. My Question is, is it possible that both I-130 and I-129F have been approved and are being worked on at the same time? Just a little background info, I got NOA2 for my I-130 first and it was sent to NVC. I received a NOA2 for the I-129F about a month after the I-130 was approved. I didn't think anything of it because i read that the I-129F would be closed since the I-130 arrived first at NVC. Well, just today my wife called me and said she received a letter from the US Embassy in Manila, Philippines. It's a letter for interview appointment and instructions on how to go about with the medical exam. The letter also came with the original I-129F i sent with the USCIS stamp of approval. I'm not sure how it's possible but my I-130 is still at NVC and it's been stuck there for almost 2 months now. CEAC issues have been delaying it. I'm now very tempted to continue on with the K3 regardless of its limitations and having to pay fees again (already paid AOS and IV fees for I-130. But I can't even login to the accursed CEAC. Paid by mail. Don't know when I can ever login and do DS260. Havent even sent AOS and IV packages.) Has anyone ever encountered this? I'm pretty sure the letter sent isn't a error. It all seems pretty legitimate.

July 30, 2015 : Interview Complete APPROVED!!

August 16, 2015 : Received Letter from NVC that I-130 is being expedited to Manila Embassy.

August 26, 2015 : Manila Embassy closes K3. Proceeding with CR1 again. New interview date September 16, 2015

September 16, 2015 : Interview Complete APPROVED!! ISSUED on same day. :dance:

September 23, 2015 : Visa in hand
September 29, 2015 : POE

THanks NLR. I was just wondering, I wasn't able to make copies of most parts of the packages (including the forms. I know it was stupid, but I wash rushing to send it out and my copier was broken :crying: ). Is it a requirement to bring a copy of the entire packages to the interview? Or can she just bring updated affidavit of support, medical exam papers, proof of relationship, and other related documents? I know this may be country specific but was just hoping you had an idea.

She needs to do ds-160, bring an i-134... basically most things that a K1 would need besides a letter of intent.

Thanks, my wife got scheduled for interview on july 30. We received the complete list of stuff to bring. Excited and nervous at the same time. We are just gona go with the k3 now. Thanks for all the advice NLR!

No problem. I hope the interview is a successful one. As a reminder, do not do anything with the I--130 at the NVC. It will need to be sent back to the USCIS so your wife can adjust her status.

Should i call nvc now and tell them that im gona cancel the i130? Or should i do that after the interview?

YOU DO NOT cancel the I-130! An approved I-130 is what makes it so she can adjust her status! Let them know after she gets the visa to send it back to the USCIS.

If you want, you can go ahead with the K3.

you know all the silly stuff to do now, right? ustraveldocs.com/ph account, pay the visa application fee, medical exam, etc etc...

if NO, you not know it, get into the PI Sub-forum, find one of Hank_ 's posts, read his signature area, and click the link.

Sure, it's listed as K-1, but it's the exact same stuff for a K-3 [save it's CEMAR vs Cenomar]

i say do nothing at NVC, at the moment.

focus on Visa Application stuff for the IV Unit in Manila, instead.

Thanks both of you! I never anticipated events to unfold like this so I'll have to do more research for the k-3. She already has a flight booked to do the medical. Meanwhile I'm preparing the i134 and more relationship proof. Hoping things will turn out right, thanks again guys!

Did you expedite your case because that was pretty quick.

hello FEHIBOR! No I didn't request for an expedite. Based on what I've read on here the Philippine cases move very fast for some reason. Also, I see you are on the K3 visa path. What step are you on now? If you fill in your timeline that would be very helpful. Back to your question, I'm not very experienced with expedites but it could be worth a shot. Based on the statistics here it will take around 6 months for I-130 to be approved. And K-3 is almost non-existent. I believe my I-129F made it to the embassy because NVC was a mess during the time and might have sent it off in error. I suggest you make a new post regarding your expedite questions so more people can see it and help you, don't forget to fill in your timeline!
