Hi everyone!In behalf of my sister I just wanna know the income requirement for K1 visa? Her income this year is a bit low, $22,000.00 and i don't know if she could qualify to file a K1 petition for her boyfriend.

About $20k is all she need to make as long as it's just her boyfriend and her,

and no children are involved.

Find the family count and take 125% of the income to determine the required income.

how about if she had 1 child here in the US? her income is only $22,000.00 this year. And if she is receiving medical from gov't will it affect her petition?

she would need to show 125% of povery income for 3 people for the period of last 2 years, so 20090 * 1.25 = 25113$ on income during 2 previous years and she is clear financially. Any lack in income can be compensated with funds available to cover (forgot the formula, but probably between 5 and 10 times, so with 22000 income she would need to have 3500 * 5or10 ~20k in savings to qualify).

receiving public benefits has lit up big arguments here, and multiple people claim that if us citizen is receiving them - it does not disqualifies petition, but everyone agrees that visiting side cannot apply for those until after lifting conditions.

no offence here, but if I was the decision making officer I would not approve such petition due to the danger of him becoming a puiblic burden unless a) your sister stops receiving benefits for 2 years and then reapplies, b) has a sponsor with enough income evidence that would be fianancially responsible for repaying any benefits that he may end up receiving.

You can also have a 3rd party sponsor. They provide their income and sign a document that doesn't legally bind them to support you. So it's no risk to them.

This is the USCIS poverty guidelines. 125% is already figured out for you > http://www.uscis.gov/sites/default/files/files/form/i-864p.pdf

For the K-1, some interviewers will accept 100% with the I-134. However, after you are married and filing for AOS, you will need the 125% for the I-864, so might as well be prepared for that.

It may work out going through Manila, since there have been several postings stating they have not even been asking people for the I-134 lately. Check in the PI regional forum.
