Hi,

 

I am the USC. Filed for my husband back in NOV (I-130, I-485, I-765 etc). Filed for my step-son I-130 in march. 

I would like him to get a K-4 so that he can come soon, do I now apply for the I-129F?

11/4/16 Mailed forms to Chicago lockbox via FedEx

11/7/16 Paperwork received at lockbox

11/22/16 NOA Received via Text/Email

12/15/16 Biometrics complete

02/06/17: EAD card Being produced

02/09/17: EAD card mailed

02/16/17: EAD card received (with typographic error)

02/17/17: EAD Typographic error E-Request sent

02/21/17: EAD Correction application with documents mailed to NBC

02/24/17: EAD Packet signed by USCIS

03/14/17: Text/Email NOA

03/21/17: Hardcopy NOA received

03/25/17: Mailed out I-131

04/10/17: Biometrics repeated for EAD I-765

04/21/17: i-131 Expedite request

05/10/17: I-131 Approved at Infopass appointment

As already said above, the child could only get a k4 as a derivative of a k3, which is not your case

My husband is currently awaiting AOS...From a B1/B2 visa.

 

We already applied for the I-130 for him and my step son. 

 

Husband is here in NYC. Step-son is still in Jamaica.

 

Should I apply for the K-4 to get him here quicker?

Stupid is a strong word, but the K4, even in the extremely rare case you can get it (about 0.2% chance, most are closed at NVC stage), won't get him here faster.  This used to be the case years ago when the CR-1 took several years, but right now, both processes take 12-14 months.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Can't get him on K4 unless your husband is K3 I believe. You can try applying for an expedite on humanitarian grounds, wanting him to be able to get into school for September etc. Think outside the box. Expedites are free to request. You either get it or you don't and won't affect anything unless you are successful.

August 17, 2016: Visa Approved!!!! :dancing:
