A staff person at the embassy in San Jose, Costa Rica told my wife that her ex-husband (biological father to my step-children, CR2 visas) needs to come to the interview. I am losing it! This can not be correct!!

Has anyone ever heard of this? Wouldn't that be grounds to refuse visa, looks like ongoing relationship? I called the embassy 2 weeks ago to ask about this and was told he does not need to come. However, the staffer told my wife again today that he does need to come. I think they are giving her instructions for tourist visas. I just can not see how anything good could come from an ex-spouse coming to the interview for a CR1/CR2!

My wife thinks he needs to come, I think it is a bad idea and completely wrong.

Thoughts? Knowledge? Opinions?

09/02/16 call to NVC, 6 weeks point, now waiting for supervisor review

09/22/16 CC for both CR-2 cases (took 2 months to review)

09/27/16 3 expedited visa statuses changed to "in transit"

10/04/16 3 cases at embassy status changed to "ready", waiting for interview instructions

10/05/16 Received instructions email from embassy, without interview date

10/07/16 Wife and kids went to medical (Walk-in). Completed X-ray, Urine, Blood. Scheduled physical for 10/12/16

10/12/16 Wife and Kids completed physical and received sealed medicals.

10/19/16 Interview request email sent to embassy

10/26/16 Embassy provided interview date

11/03/16 Interview - APPROVED ALL 3!!

11/14/16 Picked up passports with visas?

12/01/16 Entry at Atlanta?

What is the custody situation for the CR-2 kids, and do you have a notarised letter from the bio dad stating he is ok with them leaving the country?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Seems they want to make sure he's cool with his kids leaving. Not about a relationship with your wife.

Not a bad thing unless he's not onboard. If the staffer (CO) says he must come he must come.

I agree that this just may be a confirmation that the father is ok with the kids migrating.

custody was joint, but my wife has a formal "poder especial" or "special power" made by an attorney and signed by the ex. Then she received "permiso de salida" from the national child welfare agency.

I am worried that the people that answer the phones are giving her instructions for tourist visas for minors. Because, for a tourist visa the ex would have to attend the interview.

How does she have joint custody but have some sort of "special power" to migrate the children without proper consent?

Does the father know the children migrating? This is what the embassy wants to know.

Timeline

Per my experience with Tokyo U.S. Embassy, I filed a CR-2 for my step-daughter but since my wife has full custody, they never stated such a thing during their interviews.

Is custody shared? Are they divorced? As other posters stated, they may want to know if the biological father is okay with the child migrating.

father signed papers agreeing for kids to immigrate to U.S. "poder especial"

wife already has papers from the government of Costa Rica giving permission for kids to leave the country "permiso de salida"

ex-husband was not needed at interview. my wife was given wrong instructions for a minor child applying for a tourist Visa. Also, did not need to show any papers or permissions for the kids to immigrate.
