K-2 issue. Can't locate my ex for child immigration approval

I have full custody for my minor kid, but embassy stated, that bio father's notarial approval is mandatory.

This person disappeared from his country 10y ago and nobody knows where he is, even his country's authorities. I assume he moved to cheaper country and happy not to pay child support and get away with it. I have email from them (Federal Police) saying they can't locate him nor confirm whether he's alive or not. Will this be an issue?

03/18/16....I-129F mailed to Lewisville, TX

03/30/16....Delivered at Lewisville, TX

04/04/16....$340 check cashed

04/06/16....NOA1 Text & E-mail. Case sent to CSC

04/08/16....NOA1 hardcopy received by post

04/11/16....called to USCIS inform about Name typo

04/27/16....Name typo updated

06/29/16....Got RFE

07/15/16....RFE was received by USCIS

08/01/16....NOA2 approved

WAIT/CALLING TO USCIS.. WAIT/CALLING TO USCIS.. WAIT/CALLING TO USCIS.. WAIT/CALLING TO USCIS..CONTACTING USCIS SUPERVISER..CONTACTING SENATOR..

10/03/16....Case sent to NVC (THEY LOST OUR CASE AND STOLE 2.5 MONTHS OF OUR HAPPINESS. Only senator's involvement helped to sort it out.)

10/13/16....NVC assigned case number (after waiting more than average)

WAIT/CALLING TO NVC.. WAIT/CALLING TO NVC...WAIT/CALLING TO NVC...LOSING MY MIND AGAIN..

11/16/16....NVC status changed to IN TRANSIT. Yay!

11/20/16....US Embassy received file but never contacted me

11/26/16....packet 3 received by consulate (packet 3 instructions was never sent by embassy, I sent packet 3 regardless)

11/28/16....interview scheduled on 12/22/2016

12/22/16....CO refused to consider self-earned income and refused co-sponsor. Refused to take in consideration my own assets and property income and well established freelance business. Asked to show $100K++ on bank account while he knew that we have maybe only $70K cash. 

03/22/17....After several fights was interviewed in Paris. They kept my passport. Was told Administrative Processing won't take more than 2-3 weeks.

This is specific for the embassy in France because some embassies are fine with just proof of sole custody and others want the written consent.

Have the embassy told you that you need the signature? Have you tried and contacted them with the new proof you have that the police can't find him either?

I guess i won't find anyone in same situation, so I will just present facts as they are, to Bangkok US embassy and let's see. So far they don't want answer any questions before interview scheduled

Get a court order, if they want his permission they will not budge.

If it's anything like Canada where I had sole custody my ex still had all his parental rights. So I still needed his permission. My attorney didn't trust a letter from him so she got me a court order.

You have proof that you can't find him get a lawyer and they can get you a court order.

Ontarkie, what this court order says exactly? Removing parental rights? I wish I could fly to anther country and afford a lawyer and wait several months for court order

Are you going through the US embassy in France of Thailand? I suggest changing your country flag to which ever embassy you will be interviewing at, so that people from there see your thread and may answer with personal experience.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Mine just said that I have Permission to move the kids (it lists all their names) permanently to the US.

Signed by the judge and court seal.

It doesn't need to be too much as long as it says the courts grant you permission to move the child to the USA.

For fathers rights unless you go to court to remove the fathers rights then his rights are still intact.

It may not take you several months to get it through the courts. I didn't actually have to go to court. My attorney just took my proof to the judge and he signed off on it right away. Obviously this will be different where you are but look into it. You have proof of him disappearing you might get lucky.

You can get a court order to remove children from the country you are in...especially if he's not paying the support (if any is ordered).

I believe the embassy just needs someone taking responsibility i.e. the judge in this matter.
