I751 denied after 2 year

Hello everyone .

I need your advice to weigh my option to act on my recent deniel of I751.

I filled I751 jointly with my wife in Aug 2014 and also gor my biometric done in sept 2014 .in the month of dec when my son (20 yr) and wife came from indian vacation .

My wife walked out on me and resulting i had to move out of the house when family court told me to stay away from them .

So i did and kept tryimg to make every thing allright . But no possitive result . In the month of april 2015 i moved to California and waited for my application status to change . No luck and finaly my wife pushed me to file divorce. And we did in the month of march .and i notifed USCIS about it and also about my address change .

My lawyer send a new I741 which shall supersede the old one as aweiver.

This was done in the month of april 2016and my divoce is still in process.

Today 15 sep 2016 i had gone to USCIS on infopass . To find out about my status ,and i was shocked to learn that my case was denied last month ( aug 2016) and i am supposed to call immigration court to find out about my hearing ..

I never got any letter or RFE or any other letter from USCIS so far.

I am confused and tensed .as of what to be done now.

If any one can help me on this or share ther experience. I will appreciate it .kindly help

Her family was always against our marriage. And when she went india on vacation. They spoiled her brain ... but can i file a new I751 with my divorce decree.

That doesn't sound good. You need to first address the reason(s) behind the current denial.

You probably need to see the denial letter to see the reasons.

From what I read, you either re-file or wait to go to immigration court. Some people successfully re-filed on their own or with lawyer's help. Denial except for fraud often comes from administrative issues like missing a document or a deadline. These should be able to be fixed.

Hey guys . I was wondering and seeking your advice .

My case was denied on 16 aug 2016 . Can and should i file a new I751 with my divorce decree.

There is no immigration court date has beed asigned to my case . So i am just wondering if i should file anew application. And is it going to help in your opinions.

I havent even got any notice of denial but i am guessing that it was because of no show on the interview..because when i was coming from india 2 weeks ago CBP officer asked me that why i didnt go for my interview.

Once you get NTA you may have less options. You may not be able to re-file. Immigration judge takes long waiting time and should be accompanied by an attorney that cost $.

If you are doing without a lawyer I'd suggest refile a divorce waiver as soon as possible explaining you never got interview notice.

I've read that people did that successfully and got 1 year extension again after they submit the new petition.

This is just from what I read and not from personal experience or qualified opinion!

So first on info lass the officer said my case is denied . And then last week my lawyer wrote aemaul to vemont service center asking the status of my case . And vermont replied . That my case is under review and thwy cant pridisct any time frame.

So i am huess it ia still oending right ?????

If you missed an interview it was likely denied. Have you received a notice of denial?

It seems you have problems receiving USCIS mail.

If an interview was scheduled, your file is with the local USCIS office so Vermont probably would not have up-to-date information on it.

I havent recivwd ant mail from uscis whatso ever .

In the month of april when my divorce was initiated i filled a waiver with a new fee to uscis in CA . Yhey kept the application packet and said it has been forwaded to vermont service center and returned my fee , saying THE FEE IS NOT REQUIRED AT THIS TIME .

And at the time of this new application my file was anew york local processing center . So you are right i am not getting mail from them but for the las 2 years i am calling them and going on my info pass to have extenssion stamed . And double cheking my address with them they says it is CA address ...

And i guess local office might have scheduled an interview which i never came to know about.

And now vermont already has my CA address.

So vermont is saying it is still under review . Cause they didnt update my address with local office in new york .

So should i wait untill i recive any letter from vermont ?????

If you were denied because you missed an interview which you did not receive a notice for, all you need to do is have your lawyer file a motion to reopen and explain you never received a notice for interview. It is simple really. Happens all the time. You first need to know why it was denied. If it is the interview, you should just file the motion.
