Notice of Potential Interview Waiver Case

Has anyone in the NPIW club experienced any problems with medical examinations expiring? Has anybody been approved since 1 June 2014 with an expired medical? Hopefully I'm reading this wrong / missing something and 'getting my knickers in a twist' over nothing.

I'm getting worried about this as well as mine would expire January, I'm HOPING it won't matter but you never know..

It looks like the medicals of a few people 'in the club' will be expiring in the next few weeks so I'm sure we'll find out soon!

The guidance reads like it won't be a problem but who knows!

K and V nonimmigrants applying for adjustment of status are not required to repeat the medical examination if the application was filed within one year of the date of the original medical examination, and:​

The medical examination did not reveal a Class A medical condition; or ​

The applicant received a conditional waiver in conjunction with the K or V nonimmigrant visa or the change of status to V and the applicant submits evidence of compliance with the waiver terms and conditions.​ ^[27]

If a new medical examination is required and reveals a Class ​A​ medical condition, a new waiver application will also be required. In such cases, the officer should determine whether the applicant complied with the terms and conditions of the first waiver, if applicable. Such determination should be given considerable weight in the adjudication of a subsequent waiver application.​ ^[28] ​

Even if a new medical examination is not required, applicants must still comply with the vaccination requirements if the vaccination record was not included as part of the original medical examination report. If the vaccination report was properly completed at the time of the overseas examination, the officer may accept the vaccination assessment completed by the panel physician. ​

An applicant’s overseas medical examination report completed by a panel physician should already be in the applicant’s A-file. If it is not in the A-file, the officer should request the medical examination report through a Request for Evidence (RFE).​

​

If the applicant was granted a change of status to V in the United States,​ ^[29] the medical examination report completed by the civil surgeon should be in the A-file created at the time that the change of status was initially granted. ​

Now that does put my mind at ease, my vaccinations were all up to date so hopefully no problems there, thank you very much for that!

But the alert did say that ALL I-693 forms would expire after 12 months so watch this space.

I'm still betting on a 6 month wait, followed by the RFE for the expired medical, followed by the 3 month wait for the RFE to be processed ... I'm JOKING ... I can't see USCIS ever doing that :-)

I'm glad we have this forum to discuss things and vent our frustrations in a friendly manner.

I am guessing I will also get my green card on January. It'll be 6 months of waiting for my green card on December 5 hopefully if they are kind enough they'll mail it to me as present for Christmas, but who knows? I'm not gonna bet on that though I'll surely lose lol

Sounds like we're on a similar timeline, my 6 month mark will be January, I'm hoping it'll be around that time but obviously the way things are going you never know..

Is there any sort of timeline tracking similarly to those that get interviewed? We have received our Waiver notice on June 10. Would be great to see who is getting their GC this month. January people? February?

I got mine today. Guess it is time to sit tight. As long as my AoS doesn't take longer than next June I'll be fine. My medical expires next June.

I know that visajourney.com is only representative of a tiny fraction of the people AOS'ing in the immigration system but even in this thread you have to go back to the end of August (approx page 17) to find an instance of somebody being approved without interview.

I just don't understand USCIS approving other K1 AOS filers and not just all the k1 AOS cases. What's wrong with them? Why do we have to wait for such a long time? And then I've read some people here who didn't get their GC after 6month mark they called the USCIS and the answer they get is to wait again for another month. Correct? Just W T F! What were they doing from the last 6 months? Why do we have to wait another month? Gessshh!

Hi there. Add us to the club, I think. We got a letter today dated November 12th. The letter is addressed to my 10-year old stepson. Nothing yet for his father. USCIS site says "acceptance" since August. EADs were approved on the 7th, into production on the 10th, and still don't have those in hand either. This blows. ?

Oh Tina, sigh. I'm sorry. I contacted the congress woman we talked to with the K1 and she came back with the info that our case is potentially an interview waiver. Which, bc I follow these threads, I replied very upset with well, that's fantastic (sarcastic) bc they are taking a year to get ppl their greencard and she was actually telling me that no, this means it should go faster! I am about to reply to her and copy a person's notice, bc this is ridiculous, and Matt's medical expiring before he gets his greencard is a real possibility.

Sorry, Johan doesn't have his EAD yet as well. :(
