Timeline

Hi everyone in this forum. I'm here for a long time and now i have your's help!!!!

My spous is LPR. And filed for me and my child in Jan 30 2011.

Our case was completed about 4 months ago! But now we have second child (newborn)

And we want to add her to my case!!!!

Please Can anyone tell me how shoul i do that!!! Must i sent all documents to NVC or not?

If the baby is born before the visa, you'll need to file a DS-230 with the consulate (just like you already filed DS-230 for yourself) and pay the fee, and your spouse will need to send you a revised I-864 with both you and the baby listed on it (and his income must be sufficient for the increased household size due to the baby), for you to bring to the baby's consular interview.

Since your case seems to be completed at NVC by now, it may be possible for the child to derive status from the immigrant visa petition filed on your behalf, or for your spouse to file an immigrant visa petition for him/her. You just have to notify the NVC by phone or e-mail about the birth of your child. They will instruct you then on what to prepare like birth certificate and payment of corresponding visa fee, might also be asking for new AOS since there is an increase in household number. :-)

Timeline

Since your PD could become current in the next 2-3 months. Do the following (from my personal experience).

1. Send the scanned Birth certificate of your newborn to NVC to e-mail and ask them to add to the case. NVC ads and generates IV bill.

2. Pay the IV bill.

3. Send the DS-230 for newborn, Original BC, pictures and updated AOS to NVC to complete the case. OR if you do not have time ask NVC to take the docs to the interview since the case is already added and you paid IV bill.

For me, NVC took 15 days to add my child and another 10 days to process my documents after I send them with updated AOS plus DS-230 for my child

You must get the baby his/her own passport now. Photocopy of the child's passport bio page will be sent together with his/her DS-230 form.

I did some readings regarding your case. Here's what i found:

A child is permitted into the U.S. without an immigrant visa as a new immigrant in certain, limited situations. This visa exemption arises if the child is born to an accompanying parent after issuance of an immigrant visa to the parent but before the parent's initial admission to the U.S. (Essentially, the child is born abroad after the parent/s obtain their immigrant visas in their passports, but before they come into the U.S. as immigrants.)

If you havent delivered your baby yet when the interview arrives, inform the consul rigt away so they can give you checklist of what to do. Also make sure to keep all your prenatal records, ultrasound (if any) and the like. :-)
