Okay thanks to a great suggestion (thank you Darnell) I am running with this. I just got off phone with NVC and they said to write letter of explanation why the documents they request aren't included (I am missing the DS-230 package I have D-230 form unsigned and I have passport pics). And they will review and determine if there are "have to haves" for my husband and render a decision.

So my question is has anyone here every been in this situation of not sending the originals, but presenting at interview? What did you say in letter? Right now my mind is not working. I am done crying its time to spring into action this must go out Wednesday.

NVC will not be able to consider your petition "case complete" if the required forms and civil documents were not signed & submitted.

Just wait for their reply and move from there. In the mean time, fill out a new DS-230 (Sign part 1 only) and prepare the original civil documents.

Thats not true there have been some who didn't have documents but stated they will present at interview. K1's get that luxury. As NVC supervisor stated send what you have and they make a determination (just like they do with expedites) as to the case complete or not.

So all I can do is send it I will get a yes or a no.

good idea. I would just state in the letter how you've tried 3 times and 3 different postal services and you are at your wits end. please please please allow the originals to be submitted at the interview in Nigeria as you are running out of time, money and patience.

get scans of all civil docs and a ds-230,

print it out.

include them as a 'ds-230 submittal' into NVC, with a cover letter

stating the problems with getting the originals.

On each page of the civil docs printout - write 'photocopy - will submit original on interview day - see addendum'

In the addendum, write a letter of attestation on each attempt to get civil docs out of Nigeria.

Cover letter on top, asking for waiver of original docs .

addendum 2nd

ds-230 then all civil docs.

That's the pack, really.

You can talk with a supervisor to get it pre-cleared, if you'd like.

You know I was thinking of that just today thinking "dang why didn't we scan everything to keep just in case". I have nothing but an unsigned DS-230 and passport pic. That's what I told the supervisor they said send what you have.

What I would like to know why do K1's get the privilege of bringing everything to interviews but we don't? why are we being punished.

Dwheels don't knw if this would help but at least it would give u hope.My hubby and I hv been wondering why my original divorce document weren't given back to me after my interview we think theirs a mix up somewhere or rather the price we are paying for asking NVC to consider our case complete when we haven't submitted all required documents ,he told them I would bring the "stamped&sealed divorce papers" to my interview cos we spent so much time trying to figure out where NVC wants us to "stamp&seal" the divorce document as they wanted it authenticated.Finally we figured it was at FOREIGN AFFAIRS ABUJA! and began processing for it to be signed and sealed which took some days then I dhl'd it to my hubby he then sent it off to NVC only for him to call NVC to find out if they hv recieved it but the lady he spoke to said NO but they finally went ahead to consider my case complete! But asking I bring the said document to my interview, my hubby was like WHAT! But his sent it off to NVC already. The lady was like well if we receive it we will fwd it to the embassy but note ur wife's case is complete. Even wen my appointment letter was sent to me, under where all d documents I'm required to bring I noticed it was just that "Divorce document" that I'm asked to bring to my interview. My hubby called up NVC again and was told its been sent off to the embassy but I Neva got it back after my interview. So sister their is hope. Keep pestering them with calls , someone would surely give ear to u.GOODLUCK

Okay here is the letter I wrote. Opinions anyone what do you think?

Subject: Letter of Explanation of Original missing Documents

Dear Sir/Madam:

I am DWheels the Petitioner and wife of DChase, the beneficiary. I am requesting permission to bring all required documents to the scheduled interview. Once you have read our dilemma you will understand we are in a most horrible situation.

Below I have listed what we have enclosed and what will be brought to interview.

1. 2 Passport-sized photographs- Enclosed

2. Certified marriage certificate – Enclosed

3. Completed and signed form DS-230, Part 1-Enclosed

4. Completed and unsigned form DS-230. Part 2- Enclosed

5. Photocopy of the biographic data page – Original will be presented at Interview

6. Certified birth certificate – Original will be presented at Interview

7. Original police certificate – Original will be presented at Interview

As you can see from my case there has been quite some time sitting there. First my case was misplaced at CSC after I received my I-797C Approval from USCIS for 30 days. My AOS was sent and accepted with no issues. However now we are at a standstill because of the IV BILL documents.

My husband first attempt to send me all the required documents on 9/10. He used the Nigerian postal service (big mistake). He thought he was being thrifty and saving some money. Well the 12 day guarantee arrival came and went. After much complaints and my husband going back to the post office on two occasions they admitted during all the rain that was happening the week he dropped off mail that much of the mail was lost or destroyed in flooding waters and could not be retrieved. We lost 6 weeks on that.

So my husband gathered again all the documents (it takes about 7 to 10 says to get everything). We heard so much about DHL so we tried that. That was 11/21. This time no mail again. That was attempt #2.

So on 12/21 my husband gathered all documents the third time and this time we used FedEx. I setup a FedEx account and it was sent from Abuja. For some reason the envelope sat for a week at the Nigerian customs and finally was sent 12/27. It arrived today 12/31. And to my horror all documents were removed replaced by 5 sheets of blank paper.

We have now tried 3 times to send the most sensitive of documents to me so I can than send to you at the NVC. Who knows what hands these documents are in. And you know that in the wrong hands in a country like Nigeria someone could very well be assuming my husband's identity. They have our marriage certificate, His birth certificate, His Police certificate, his biographical pages of his passport and all the personal information about me and him and his parents and mine on the DS-230. My social security number all my personal information where I live, his moms address everything. Very upsetting this is.

It worries me very much that these precious documents are out there and we are not even finished at the National Visa Center.

I am writing this letter to ask, no to beg that you will process our application and we will present at interview just like the K1 Visa couples get to present their originals at interview.

Please grant us this request so we can finally be complete and get to the embassy. We have already been at NVC 5 months.

I don't really know what to think about this case as there is a lot of 'red flags' from your explanations,maybe i have not been following much on your discussions so far...It took FedEx just four days to deliver our documents (Marriage cert,Police cert,My Birth cert),we did electronic signature for DS-230 part 1 and we were favored by God at NVC and now have case completed .How would FedEx say they have just 5 blank papers(What did you do about this??)

As a Nigerian i may want to think,this is definitely spiritual....but again why should such documents be intercepted at FedEx without some explanation and if you tracked it,what part in transit was it delayed or scrutinized? Well,maybe if you can find answers to some of this as we all know this are world renowned courier services,i mean FedEx and DHL and if they cant deliver a simple package of documents...well

I'll be doing something for you and that is 'PRAY' that you may find solution to all this with a speed of light.You deserve better.
