Hi just updated my case status for K3 I 129F in uscis site..we just applied K3 last october, now they were asking for RFE, they already sent letter today by mail and will receive this anytime this week, wonder what kind of documents they need for RFE...need to know so we can prepared the documents ahead of time and this time will look for a Lawyer who have legal knowledge to handle this matter...thanks

You will not know until you have that letter in your hands. USCIS only posts that they sent a notice, but they don't explain exactly what it says on their notice. Do you really need a lawyer?

yea, the letter is just sent today so we will receive it anytime this week, then that's the time we will know what the instruction we are going to do..but i heard that they only ask RFE once there is no second chance so I am worried no to make any mistake , me and my husband were talking about lawyer who can help us to do the RFE....

Actually our I130 is still on process its out of normal process tho we're currently running on the 6th month ..we got an email telling that out case was being adjudicated and we should receive NOA2 within 45 days...while our K3 application they were asking for RFE which we will receive their mail anytime this week..uhmm....

Well my petition took 165 days to be approved. I got an RFE and did it all myself. You can do it yourself too. First when you receive the letter read it and see what they are looking for and if there is something you don't really understand post it here. I'm sure anybody can help you. It's just a way to save money, because many people do it without the help of lawyers. I'm not telling you not do it, but i'm saying that doing it yourself is also a good option. This site is sooo helpful that simple cases should not required the help of lawyers or the money that you will later need for other expenses with your loved one!

RFE's are case specific, I received an RFE that was three pages long but that was for a re-affirmation. If you are still in the intial process it shouldn't be a long list...maybe a missing doument, a request to clarify or explain something pertaining to your case, or even if a copy was too blurry. Anyway, it should be easy, and they gave me 30 days to submit my evidence back to them. Nothing to worry about.

we just sent the NOA1 from our I130 application and I129F...

My husband who is the petitioner did the same. We were filing for K3 petition. After he received the NOA1 of our I-130, he mailed a copy of it with the I-129F form. Last Nov. 15th, we got a RFE email and he received the letter on the 20th. I was worrying a lot because I thought we will be asked to submit documents that are not very easy to obtain. But RFE was just to submit passport-sized pictures, glossy, taken within 30 days and us wearing the normal street attire. :whistle: Of course we submitted pictures before but they were taken in formal attire. :bonk: I blamed myself because it was I that insisted that my hubby should wear coat and tie and me in blouse and blazer. :P I was also thinking that maybe the adjudicator just wants us to submit recent photos since the forms we signed were dated a April 25th and they received the packet May 26th, so the photos were obviously more than a month old. And they just wanted the change of attire to be sure that we were complying with their RFE instruction. I'm just sad they notified us about our RFE two weeks beyond the processing time. Wish they did it sooner. :(

Hang in there. Don't worry too much until you got the letter. It could be just a small thing. :)

Honestly, I'd almost be inclined to ignore the RFE for the K-3. The K-3 is a dead visa anyway, and will be closed by NVC. You may return the RFE if you like, but if your I-130 is to be adjudicated in 45 days, why bother with the In-129F RFE?

Honestly, I'd almost be inclined to ignore the RFE for the K-3. The K-3 is a dead visa anyway, and will be closed by NVC. You may return the RFE if you like, but if your I-130 is to be adjudicated in 45 days, why bother with the In-129F RFE?

I asked Loto's advice the day we were notified about our I-129F RFE on what we should do, that is, to respond to it or not and if not, would it affect the pending I-130. He said that it's supposed to be separate and that it won't harm the other petition. But we never know if they are holding back the I-130 application too because of the RFE. So he suggested to respond to it so that it could not create an impression that you are hiding something back from them and not to create future issues when we have to deal with USCIS again.

We got an RFE and I panicked! Once we recieved the letter come to find out it was so simple I nearly cried! I forgot to sign the G325 form! :bonk: I tell you this to show you sometimes it is so simple and easily fixed, try to relax and wait for the snail mail letter. Best wishes to you.

I got a I-129F RFE and not wih I-130 but the I-130 hasn't been touched until they received my I-129F RFE yesterday. I was just trying to provide the OP the safest way and that is to reply the RFE. But of course, it's up to the OP which road he/she will choose. Please don't get me wrong. I respect your opinion and I am well aware of the differences. There is no need of sarcasm. :)
