How easy will it be to get a visa if we get married outside the US

My Fiance(Us citizen) and I (Bahamian) would like to get married in the Bahamas. However we are unsure which route would be the easiest in term of not waiting a long time for my visa. Would it be better if I entered the US on a K1 visa got married and we still just had our ceremonies in the Bahamas.We wanted to have the wedding August 2011. We don't want to go the route where we are seperated a long time waiting for the visa to be approved.

Your Fiance (us citizen) should apply for K1 and invite you to US. You guys should get married in the court and also apply for Adjustment of Status. This is the fastest way. Since your wedding will be in August 2011, your fiance (us citizen) will not be able to bring you to USA before marriage, unless K-1 route or visitor visa.

So it's better to go through K1.

I agree, the K-1 is faster for you guys at this point. Marry in the US, adjust status so you become a permenant resident and travel back to your home country for a big party and celebration of your marriage.

Going the K1 visa route, you will have to get married before August 2011 at least a civil marriage by the courts. Then you have to to file to adjust status here in the US (for 1010 USD). When you file you can get travel documents that will allow you to travel outside the US. As of right now it is taking about a little more than 2 months to get them after filing for it with you Adjustment of status application.

Every case is different but it took us 7 months from beginning to end to get my husband here using the K1 visa. You could be here by the Fall if you apply now.

With the CR1 visa, you have to be married first. After that your fiance apply for the petition to bring you here. Which on the front end is a bit longer then the K1 visa in some cases. But if you go the CR1 route you pay less and you do not have to file for adjustment of status once here. You will receive a 2 year green card when you enter.

Actual lega marriage in the Bahamas would violate the terms of the K1 visa. K1 requires the legal marriage take place in the USA. You can have any party, ceremony or celebration you want in the Bahamas after "marriage" in the USA, filing to adjust status and actually receiving a green card or advance parole. You certainly have enough time to accomplish all that by August 2011.

Be aware though that the K1 visa holder is stuck in the USA from K1 entry until green card or advance parole, so several months.

Facts are cheap...knowing how to use them is precious...

Thanks for the quick responses. Another question once I get a marriage certificate in the US. How long will it take for me to recieve travel

documents as I await for the Adjustment of Status? I dont want to give up my job in the Bahamas until I get work authorization approved in the US.

If you get married in the US from a K-1 visa, you cannot leave and re-enter the US without your advanced parole (AP) document. This can take up to 90 days to receive (as does your employment authorization document). These are both filed for when you adjust status.
