    The DS230 is used for some other visa types thats why it asks Q14.
    If you are applying for a K-1 then you do not have a spouse, put 'NONE'.
    I'm pretty sure Q31 refers to people like your children (if any) who will be applying to immigrate with the US with you. You're fiance is already a USC, you don't put his name there.
    There are sample forms available here on VJ that helped me a lot

    The question asks...
    Persons NOT sponsored in this affidavit. You are sponsoring your spouse so put '0'.
    In the event you have a co-sponsor, in our case my father is law is a co-sponsor. He is married but she is NOT applying for AOS/the one being sponsored then you enter '1' as they are part of their household size.
    This is how my husband and I have come to understand this.

    Congrats on your pending marriage! I want to first dispel what you've been lied to about. it will NOT take 14 months. It will NOT take over a year. Australia is a low fraud consulate and with our help we'll be able to show you what to do to make sure you get the quickest possible turn around (I'll explain that later).
    I'll explain the process a little so this isn't confusing. When your fiance/husband files a petition for you (whether K1 or CR-1) he will first get a NOA1. NOA stands for "Notice of Action" and the first one is basically a receipt. NOA2 is the petition approval. This doesn't mean you're allowed to move to the US, it means the US government has given approval for YOU to apply for a K1 or CR-1 visa. The NOA1 to NOA2 time is what takes a while. This is around 7 months at the moment but it is speeding back up and is more like 5 now. The handy thing about this site is how many people are going through it so you have an idea of wait times.
    The K1 is the only visa I know so I can tell you that after the NOA2 you're looking at 2-3 months till you get your visa. A lot depends on you and how quickly you present the required documents. This is what I meant by "we" can help you do that quicker because we've done it and learned from it.
    The K1 visa wasn't a hassle for me at all. The reason Tony and I chose the K1 is because we weren't married and I was in Australia at the time and he in the US. We didn't have the money for a plane ticket RIGHT THEN and we didn't want to wait till we had the money for the flight to file. We also didn't want to have the first half (at least) of our first year of our marriage apart. Tony also made/makes enough money that me not working isn't a big deal. Me working would be great but he can support us. That's the hassle with AOS... you can't leave the US and you can't work until you have either the EAD, AP or GC.
    The CR-1 visa is better in that you get the GC on entry but like I said, I didn't enjoy being apart. HOWEVER your bf (then husband) could file the CR-1 while still in Australia and spend a while with you. He WILL need to organise a co-sponsor who will need to be someone who earns enough to support you plus the co-sponsors family size. They must also be an LPR or USC.
    The wait times aren't as awful as they are in some countries and your (then) husband could be getting things in order for you to come to in the US. Somewhere to live, a job etc.
    A lawyer usually slows things down, not always, usually. They get their secretaries to do the work, the make mistakes that you have to fix, THEIR priority isn't quickly filing and returning documents when asked, yours is. YOU are not the only case they're working on, but for you it would be. Having a lawyers help to make sure you have everything in order is fine but do NOT rely on them to do it for you. You will most likely regret it.. as most people do.
    The questions you need to ask yourself to make the decision are:
    1. Do you need to work immediately when you get to the US? (if yes then CR-1)
    2. Do you need to be able to leave immediately? (if yes then CR-1)
    3. Are you okay with being apart from your husband for around 6 months? (if yes then K1)
    4. Does it matter to you being married in Aus versus US? (if married in US is more important do the K1 as there's no guarantee you'll be allowed to enter on the VWP)
    Up to you and your bf (hope he's your fiance or this is all moot really ). I'm fine having gone the K1 route. I'm not gunna lie and say that it's all been rosy. Not working the boredom is insane. Not being able to get a licence without an EAD. Insurance companies don't like insuring international licences either. BUT I'm happy that since being married Tony and I have been apart only 2 months when I had to return to Aus for a family emergency. Being together once being married was important to us. More important than the money and the boredom.

    OP, if you threw your worries and stress into a pile with everyone elses - you'd want yours back. Fiance and I are 19 hours apart. Needless to say we chat for about 10 minutes when I'm on my work lunch break and then for another 5 mins when I get off work - by then it's way past midnight where he is. We only really get to talk/skype on the weekend.
    As for stress relief - exercise is a great way to let off steam. I've also been spending copious amounts of time with my friends and family since it will be a couple of months until I get to be around them.
    My fiance has started to arrange work for me when I get there - volunteer work I can do to keep me occupied when I get there until I receive EAD. Maybe this will pass some of the time for you?
    Good luck. Once you get to 5 months nag/###### and whine all you like to USCIS/Senator. Fiance jumps on the bitching train first thing monday morning!

    Excuse me? I am plenty happy for all the people who have been patiently waiting in line to be approved and I'm happy these people got approved as well along with everyone else here. I'm rightfully upset there is broken system that seems to be like a visa lottery rather than an actual system based on fairness. Have you ever been to China? My fiance is visiting her parents for Chinese New Year and sleeping in a shack with no heat, no bathroom, no kitchen, no shower and sleeping in a bed with her mother and adult sister while her father sleeps on the floor. People in China are every bit as bad off as the Haitians, and on top of that she's stated he doesn't even live there he lives in the Dominican Republic. I don't need some otaku calling my character into question that has never even met me. I feel everyone should wait their turn and visas filed in order and I think that speaks higher of my character than those like you who publicly claim they have no objection to someone being processed 5 months before them for no good reason. Piss off.

    Your comment is uncalled for and insensitive. He *did* congratulate this lucky couple and then express his justified frustration honestly. And for that you publicly question his character? This type of community will best serve the members if we try to be compassionate and comfort those who are feeling frustrated, not by knocking them down at a time when we all are already vulnerable.

    IMHO it is ridiculous spending thousands and thousands of dollars on one single day - I've been to many weddings and I don't remember much of what goes on, but I always remember how in love the couple looked! In our case anyway, we feel that the money would be better spent on our first home or long extended honeymoon

    I've been in the States for the full 90 days on a visa waiver.
    They are valid for 90 days because you are allowed to stay for 90 days.
