    you are NOT, I repeat, you are NOT a German anymore. If you don't agree, you are NOT ready to become an American. The fact that the US government takes your word for it and does not require you to formally renounce your German citizenship does not mean they don't care about oaths and perjury. For the U.S. government you are a U.S. citizen and nothing else. If you want to be German, you can do so outside of the U.S. as long as it does not interfere with matters concerning the U.S.
    Don't tell Americans in America that you will be German regardless of the Oath you took under false pretenses. I take personal offense to this and so do millions of fellow Americans.

    This is true, RK. Even though we stayed stuck at NVC for almost 1 month from the date of NOA2, and it was driving me crazy, when we did get the reply from the inquiry (through email), they were very helpful and nice. Same on the phone, the lady who told Matt our case # was excited to give out the good news, and she made sure to tell him everything he'd need before he hung up the phone to come back to skype yelling that we got it lol
    I also gotta add the fact that, DOS, all of the operators that I talked to, were VERY helpful and sympathic. The one who told me my interview date, hearing me almost crying, excited and not even breathing straight anymore (LOL) laughed some with (or at) me, and even said congrats!
    Depending on the time you call them, it's hard to get ahold of an operator because too many people calling, but early in the morning (DOS), when they first open, and late in the night (NVC)are the best times. I'm just glad I'm done with it, just waiting for the interview to come and rock on!

    You need to obtain a formal waiver, which is the lengthy, expensive process Penguin alluded to. That is much different than just not getting vaccines at your medical. I haven't seen an approval of this either. You will either be denied at interview, or you will be allowed to enter US and your AOS will be denied. You will have to appeal the decision and try to get a waiver (costs $$) and will probably be deported in the end if you don't comply.
    I am sorry, but we don't need people from third world countries coming and giving our citizens tuberculosis or the measles. Immigration is a privilege, not a right.

    The OP failed to respond correctly to an RFE (or multiple RFEs).
    OP- Please file the motion to reopen and send them what they want. Go to Catholic Charities or some other service to help you with the forms, because you don't understand them. You got 2 RFEs for the same thing, and after you responded improperly to the second one, they denied your AOS. You need assistance with reading and understand what they are asking of you, and there are charitable organizations that will help you. Best of luck.

    Yes, a simple "A" indicates Alien; a small X before that (x-A) indicates that's an extraterrestrial alien.
    For example, Superman was an extraterrestrial alien. He had no legal basis to adjust status and was actually guilty of false claim of U.S. citizenship by pretending to be Clark Kent. He used false documents in order to secure employment at the Daily Planet and his adoption was fraudulent from the get-go as well, which consequently means that all of the Kent clan should have been in jail for many years, and Superman should have been deported with a lifetime bar attached.
    Strangely, Americans have different standards of right and wrong when it comes to their heroes.

    The process from the moment you send the petition to the moment your fiancè would get his visa in China,could take on average between 6/7 months to even a year or more in some cases and no company or lawyer in the world can overrule the processing times of the USCIS and the Consulates. There are some exceptions where a petitioner can file for an expedite request but It's only for limited categories of people like armed forces personel that are going to be deployed while their petition is pending,or for those with extreme hardships requirement. Not sure if you fall into one of these two categories.
    In summary there's no such a thing as "fast" when we talk about visas. If you two do not have particular issues and meet the requirements for the K-1 visa then I'd strongly suggest to simply follow the guides on this website and the precious help of many veteran members in order to have a smooth as possible process. That's what I did with my fiancèe and we didn't end up spending a single penny with third party agencies or lawyers. Of course the choice is yours, mine is a friendly advice

    Hi Stuart,
    I got the infos from different threads here on VJ about the DHL tracking; I summarize briefly what I did:
    1) go on the DHL tracking link: http://track.dhl-usa.com/TrackByRef.asp?nav=TrackByRef
    2) where it says "reference" type: EXP DD MON 2011A. For example NVC shipped my petition on August 3rd but It's safe to put the day before on the reference number so that would be EXP 02 AUG 2011A (It's important to keep the exact spacing so do not type EXP02AUG2011A or EXP 02AUG2011A for example)
    3) in the shipment pick up date range you can put first the same date you wrote down in the reference number, the second date put a day with 2 days of difference. Example
    Aug 02 2011
    Aug 04 2011
    4) click on "track" and a list of all shipment between Porthsmouth NVC toward the world wide consulates will show up. Once you find your consulate (assuming you're the only one in that short time range),you can write down the personal tracking number of your package so that when you want to check again you don't have to go through this hassle again but you can simply type in that number in the tracking link for specific number.
    So to summarize,this is the complete example regarding my petition:
    a) left NVC on August 3rd
    b) http://track.dhl-usa.com/TrackByRef.asp?nav=TrackByRef I typed:
    reference: EXP 02 AUG 2011A
    shipment pick up date range: Aug 2 2011
    Aug 4 2011
    c) found a shipment to Naples,Italy with the following tracking number: 8788095094
    d) after I a while I wanted to check again but this time I used the tracking link reserved for specific tracking numbers and so I went to:

    I typed my 8788095094 tracking number in the box and clicked on "track"

    If I'm reading accurately, perhaps Harpa's concern is whether the OP disclosed having a U.S. boyfriend at POE, and whether any suspicion of immigrant intent was noted in the records at POE.
    I would like to know why the OP (from a VWP country) needed or decided to use a B2 visa, and specifically what she was asked at POE and how she answered.

    The possibility of being rejected exist even if Pollina went through the K-1 process and manage to come out of it with her sanity intact
    The possibility of every one of us being run over by a bus exists everyday but that does not stop any of us from leaving our houses every morning
    If Pollina is positive that this guy is the one that she wants to spend the rest of her life with that AOS is the way in my opinion. They will go through the process together and help each other along the way. Awaiting your fate to be decided by a stranger while you are apart from the one you love is not the practical thing to do
    The other issue that I can think of with the K-1 is that there is a possibility of deny entry when a petition is pending. So this might be Pollina’s last visit to US before she is questioned by a CO on her own when anxiety has kept both her and her fiancé up at night for the last 6-7 months.

    Yeah, true. I agree.
    But I have seen one case in which a person tried, and was not able to adjust. He ended up having to go back to Brasil before the visa he was on expired. His wife was pregnant too and he missed the birth of their daughter. No, he wasn't ever here illegally, nor did he ever overstay a visa. Just a bad and unfortunate case.

    I think a lot of people here give advice on K1 because either they are unfamiliar OR because they feel that since they had to wait everyone else has to wait. People that suggest marrying and adjusting status here are absolutely right. Tim/Mav is absolutely wrong on all the points.

    To the OP - because you asked this question in the K-1 forum, you will get people saying that you should do K-1 (because that is what they are doing and that is what they are familiar with). Unfortunately, some of the posters here are not familiar with the rules and just are giving you scare tactics. As Anh map said, you can marry in the US now and stay here without going home, by filing for "adjustment of status." You can do this because you did not plan to get married and stay here when you came here. The US recognizes that in some cases it is overly bureaucratic to force people to go home to do consular processing. If you went home you would have to wait there for 8+ months, and might not be able to visit because you have already been here for 6 months this year. I personally, don't think that is worth it to fulfill an imaginary imperative that it's the "right way." From what you post here about your circumstances, filing AOS is also the "right way."

    You are totally inaccurate here - she states she comes to see fiance - 100% legal. Nothing wrong with intent to meet someone (quote obvious she did not come to meet Statue of Liberty) either. USCIS will not open any can of worms - why would it ? Again, not sure when you read OP came here with intent to marry ? And to make it even more funny, intent to marry would be 100% legal too as long as she will not intend to stay. It is the immigration intent at the entry time that is not legal.
