This is our last day to file a motion to reopenl. I do not have the money for an attorney and Im worried about just losing another 630 dollars for nothing. If i go to removal proceedings what exactly happens. If she loses at the court hearing will she be taken into custody? I got her here on a k1 visa and we failed the adjustment of status using the same information, which makes no sense to me.

also can we reapply for adjustment of status after 30 days to file for motion to reopen? or we have to do something else before we can apply for adjustment of status again?

What all did you send with your AOS?

Was there an interview or did it just get denied?

If there was an interview what happened at the interview?

What is/was the reason for the denial?

When did she enter on the K-1?

Did you marry within the 90 days?

When did you send the AOS?

The OP failed to respond correctly to an RFE (or multiple RFEs).

OP- Please file the motion to reopen and send them what they want. Go to Catholic Charities or some other service to help you with the forms, because you don't understand them. You got 2 RFEs for the same thing, and after you responded improperly to the second one, they denied your AOS. You need assistance with reading and understand what they are asking of you, and there are charitable organizations that will help you. Best of luck.

Does the denial letter say "This decision is without prejudice to future applications filed"? If so then you can just refile. You don't need to file the motion to reopen. They don't usually initiate removal proceedings against K1's who are denied because they didn't respond properly to RFE's. The denial letter might mention that point, as well.

Does the denial letter say "This decision is without prejudice to future applications filed"? If so then you can just refile. You don't need to file the motion to reopen. They don't usually initiate removal proceedings against K1's who are denied because they didn't respond properly to RFE's. The denial letter might mention that point, as well.

Thank you so much JimVaPhuong, yes you're right we called lawyer yesterday we asked about it and they said they don't initiate removal pproceedings unless you have criminal backgrounds. And yes it also says decision is wihtout prejudice to future application in the denial letter. I have one more question can we re apply AOS in like couple months after? and also, if we re file again, can i apply for work authorization with it? i didnt apply for work authorization the last tiem because i didnt have sss#, can i get ss# now for work authorization even my I-94 expired already?

No you cannot get an SSN because your I-94 is expired.

You DO NOT need an SSN to file for EAD. You can get your ssn after your EAD card is in your hand.
