In the end it's your decision, no one can decide for you. You came on VJ for advice about your situation. For you to ask for advice means you are not sure about this whole relationship thing. You're having doubts. You're questioning. You need to really think long and hard about all this, how it will affect you as well as your child. Like I posted before, you don't need the drama.

Sorry about your situation. As others have said, you need to move on. Ur child is your world. You don't need all that drama in your life. You have a child to take care of. As far as the situation with your fiancé he needs some growing up to do. His parents obviously want an Indian girl for him and that's why his father introduced him to her, to jeep the focus off of you. Do you really want a guy that his parents make his decisions for him? He can't think for himself or decide what he wants. Why is he going out with other girl in the first place if he's your fiancé. He should have respect for you.
He's not ready for a commitment or marriage. Move on and don't look back. Be thankful that this happened while he's still in his country

I'm very sorry you're going through all this. If you decide to stay in the U.S. You will need to remove conditions form I-751 next year by yourself without your husband if you decide for a divorce. You need to show USCIS (immigration) that u entered the marriage in good faith but that you suffered abuse. Make sure to get a copy of the police report.

You can apply to remove conditions from your green card alone, without your spouse, on the form I-751 you can specify that you're unable to file a joint petition and request a waiver "because you entered the marriage in good faith, but it was terminated through divorce or annulment". You must prove that the marriage was actually entered in good faith, i.e., bills, bank statements, pictures, etc. You'll probably have to go to an interview.

When we went through this process we didn't include additional evidence with aos or iv applications. my husband took everything (all evidences) with him to the interview at the embassy. The co didn't look at anything,but better to be prepared in case the co asked for it.

Is it normal that after USCIS received the RFE response, to change the status on line from initial review to rfe and then today back to initial review? They just received the package for their request. This is what the status says online: On April 9, 2014, we received your correspondence for your I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN . You will receive a notice in the mail when further action is taken on this case. Please check our website at www.uscis.gov for further updates on your case. If you move, please use our Change of Address online tool to update your case with your new address.

Evidence of bona fide marriage is joint bank account, rental lease agreement in both your names, photos of you together, sworn affidavits from relatives and/ or friends etc. you can find examples in the guides on this website.

Documentation showing joint ownership or property;
A lease showing joint tenancy of a common residence;
Documentation showing co-mingling of financial resources;
Birth certificates(s) of child(ren) born to you, the petitioner, and your spouse together;
Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or
Any other relevant documentation to establish that there is an ongoing marital union.

As I said before I'm helping a friend with I-130 to bring his wife over back in November. Today I checked his case status online. It said request for initial evidence. I can't understand what exactly USCIS still requesting. He sent copies of his marriage certificate, his divorce decree, G-325A forms for both him and his wife, her annulment from previous husband from court, her birth certificate, his citizenship cert and US PASSPORT wedding photos. What else do u think USCIS still wants? Thank u

You said prior marriage. She needs to show proof that the marriage is legally annulled or terminated in her country
