  1. hi all,

I don't know what I am going to do. I don't know if I can help my husband with evidence I mean I have 2 months worth of emails, we mostly text that's about it, but our phone companies don't have the ability to give us a history of them at all and even the call records. I only have one month of them, they cant go back to previous months He has a couple of letters and post cards that I sent him. We also have the pictures from our party. I didnt stay there for too long. I mean we talk every day, text message every minute of every day, he has over 3000 messages saved on his phone.I mean I don't know what else we need and I don't even know if that will be too little evidence or not. Any suggestions or comments? Please help me :(

  2. What I want to know is if the letter do not ask for any evidence, do you still take everything but the kitchen sink? and for those tough consulates like the DR, does the appointment letter state you should bring evidence such as photos, bills, etc?

WOW my case was completed April 5th and my husband still didnt get an interview date.

How in the world?? Does it depend on embassy???

  3. Hi all!

I want to ask a question, when my husband goes on his interview, the consulate will ask him to show proof that we are in contact. We talk on the phone every day and message all day long, But the problem is his phone is prepaid, Nokia N81 Is there any way he can get the records and how. He asked a lot of people but very one seems to say there is no way he can get the records.

BTW My phone is Metropcs. I called them but they told me that the only way I will only get the Outgoing not the incoming call records.

    Can someone please help me?

call them the USCIS. They can probably tell you whats going on.

  6. Hi to all and thanks in advance for your help on this as I am a bit confused. I sent in the I-130 package with payment and received a I-797C(NOA)and a tracking number. This happened about 2 weeks ago. My wife and I were married before I sent this in to the USCIS. So am I applying for a K3 or a IR-1 / CR-1? When, where and by who is this decided? Additionally I am hearing that I should now file a I-129 after submission of the I-130. I dont get it. Seems like there is lots of duplication and redundancy here.

Should I be doing something or wait until I receive instructions from someone in the Immigration Service? I know that I have to put together a Affidavit of support but was under the impression that I dont do this until ask. I have that deer in the headlights feeling about all this like I am leaving something undone.

    Tom

    hi Tom,

You dont have to fill out the K3 i was also under the impression that it could be filled out, but since you filed the I-130 that is good enough. It took 4 months for the I-130 to be approved. You can check the status of the I-130 online www.uscis.gov. Put in you case number and it will tell you where your case is. After your petition is approved, your case will go to the National Visa Center. The NVC will assign you a case # when you call this number 603-334-0700 and follow the prompts, put in your CIS # and once its in the system they will assign you an NVC case #. You need to call the NVC to get the updates on your case. They will ask for the beneficiary to pick an agent. It could be the petitioner. Then they will want you to pay the Affidavit of Support fee bill, you can do that online Immigrant Visa Invoice Payment Center, with a routing number and account number. You can also pay the DS-230 online application for immigrant visa. You have to wait until they are marked paid, Usually it takes 2-3 days then you can print out the cover sheets. You need the cover sheets to go with your applications and documents needed to go with them. Then you will have to wait until the NVC finishes processing all the paperwork. After the case is complete at the NVC it goes to the embassy. You will both receive notification petitioner and beneficiary of the date. Also there is a medical exam for the beneficiary.

  7. Please avoid posting in allcaps, as it's impolite and more difficult to read.

I recommend going the CR-1 route since you're both married. Don't worry about a tourist visa or anything, just wait for the I-130 to be approved, since it leads directly to an immigrant visa after the interview, which converts into permanent residence upon crossing into the US. Also, as long as you have your certified marriage certificate (or certified extract of the marriage records for your marriage), USCIS will be fine with that. Don't bother marrying again as that would only muddy the waters for the consular official processing your case.

The K-3 would likely be a waste of time and money.

    Sorry about the all CAPS.

  8. you have to keep calling the NVC follow the prompts. Press 2 for not a Haiti related issue . Then press 1 for English then press 1 again to get info on your immigrant visa, then press 1 again to put in the CIS #. If your case file is at the NVC, they would have assigned you a case #. Follow the AVR with the prompts. I understand that the NVC phone # is busy but you have to keep trying to get through. The number is 603-334-0700. To follow up with your case and what documentation is needed you need to keep calling the NVC.

  9. WHAT COMES NEXT AFTER THE APPROVAL OF THE I130 IS IT IS THEN SENT TO THE NATIONAL VISA CENTER FOR PROCESSING. YOU WILL BE ASSIGNED AN NVC CASE # YOU CAN CALL THE NVC AND GIVE THEM YOUR EMAILS AND EMAIL THE NVC THE AGENT OF CHOICE. YOUR BENEFICIARY NEEDS TO CHOOSE AN AGENT OF CHOICE. IT COULD BE THE PETITIONER. THEN YOU THE PETITIONER WILL NEED TO PAY FOR THE AFFIDAVIT OF SUPPORT AND FILL OUT THE FORMS AND RETURN THE DOCUMENTS NEEDED. THEY WILL THEN ASK FOR THE DS-230 TO BE PAID. ONCE ITS PAID FILL OUT THE DS-230 AND SEND IN THE DOCUMENTS NEEDED. YOU CAN PAY ONLINE IF YOU HAVE A CHECKING ACCOUNT ROUTING # AND ACCT# NEEDED @ THE IMMIGRANT INVOICE PAYMENT CENTER. YOU CAN CALL THE NVC. I UNDERSTAND ITS ALWAYS BUSY BUT YOU HAVE TO KEEP TRYING TO GET A HOLD OF IT UNTIL YOU HEAR THE AVR SYSTEM. THE AVR SYSTEM LETS YOU KNOW WHAT IS GOING ON WITH YOUR VISA. ONCE ALL YOUR DOCUMENTS ARE COMPLETE, AND NVC PROCESSED IT AND THERE WERE NO REQUESTS FOR EVIDENCES FOUND, THEN YOUR CASE WILL BE COMPLETE, AND ITS FORWARDED TO THE EMBASSY FOR AN INTERVIEW (BENEFICIARY). PLUS DONT SEND ANY DOCUMENTS IN UNLESS THE NVC ASKS FOR IT.
