I agree with this part 100%. None of us are qualified to tell you that you don't have to see a lawyer, but it's an option you should keep open. I would tell almost anyone that. However, there are many of us VWP-AOSers out there that didn't consult/use an attorney and did just fine. I agree that every case is different.
I'll be honest, it is stressful going this route, but if truly came here without intent, then the odds are in your favor. It's still stressful waiting, but he didn't want to leave me and go the CR-1 route. It was our choice and our decision. We knew there would be no way to appeal but we also heavily considered the fact that we were not hiding anything and we had no prior intent. We made an educated decision and did the AOS just fine.
And yes, there are many here would will tell you that you're not doing it the proper way and that you need to do K1 (if you were still in the consideration phase) or the CR-1(if married) way. This is completely untrue. Some of those posters will rant about it not being fair, you're cutting in line, etc. etc.
You've got to have a thick skin here at VJ, but if you ask open questions about adjusting from VWP, know you'll get those "it's not fair" kind of people responding. By the time you make it to the ROC part, everyone is friendly and it doesn't much matter which route you took.

Lesson number 1: There are only 10% of good men (well to do ) in the states or western world , seek their mates from other countries, or one of their own.
Lesson number 2: You will be lucky if you find ones , and if you do, you are very lucky.
Lesson number 3: 90% are the BETA males , 40% of them still living with their parents, 30% have no steady jobs , 20% have no jobs at all
Lesson number 4: 50% have no higher education, 20% have no high school diploma, 20% college dropped out, 10% GED recipients
Lesson number 5: Just because they are from US or other western world, does not mean they are rich and or well to do , they lied out of their azz when they traveled to 3rd world countries.
Lesson number 6: Well to do men do not have more than 3 weeks( or if they lucky, 4 weeks) travel around the world, if they have a full time job.
Lesson number 7: If they need separate affidavit of support to bring you over, they are more likely won't be able to support you while you here.
Final lesson: It's takes two to tango, it's not all his fault , you wanted to come to the US so bad, so overlooked the obvious red flags. He told you these red flags.

The USCIS officer at our naturalization ceremony specifically said not to laminate the certificate because it would invalidate it. She said it would be very expensive to replace if it was laminated. She also said the certificate wasn't valid until there was the naturalized citizen's signature on it too. :-)

Arrived about 30 minutes early for the interview and went through security, got my interview letter stamped and was told to go to the seating area near window 7. My heart sank when I saw the number of folk waiting in that area, so I sat down and was immediately called to the window. This was just to hand my letter in and be told to listen for my name being called by a closed door.
So I started the waiting process, a lot of folk were coming out and sitting back down. I found this a little odd, but all of these centers work in different ways. After about 40 mins an officer came out with Oath letters for about 10 people, called out their names and handed them out!
Five minutes later I got called in. I was asked for my drivers licence, green card and passports. The officer was very friendly and we went through my n400. When it came to additional trips since the application he only wanted to know the days I spend out of the US which was 6. We never looked at the passports.
Then it was onto the test;
6 questions:
Who wrote the declaration of independence
Who is the commander in chief
Name a state bordering Mexico
Name 3 of the original colonies
What are the political parties of the US
and one I cant remember.
He then said I had passed and said you come from the U.P. right? I said yes (the U.P. is Upper Michigan near Lake Superior, and it is a long way from Detroit (8 hour drive))
He said I was scheduled for the Oath ceremony on May 24 in Marquette Post Office (some 60 miles from me), so they must do some things in advance! They only do about 2 Oath ceremonies in the U.P per year. So he went to another office, got the paperwork for the Oath filled it in and gave it to me! (3 min wait)
So, this happy camper, just walked out with a smile on his face, journey almost done!

Thank you everyone for the good wishes. My husband had his interview this morning and passed. He said it was very smooth and simple. They gave him his oath letter right there on the spot and it is for May 15th, next Wednesday at 7:00 AM (now I have to take the day off. )
I will post his review of the whole thing when I get home.
Thanks again for all your kindess and encouragement throughout this process.
Hoping everyone else will be done quickly as well.

I think you took it the wrong way. I think that optimism is good, as long as you did your homework, which you didn't. You are taking this issue way too lightly.

Hello everyone,
Thank you Calypso for the good wishes for my interview.
I am happy to say that it went very well, my interviewing officer was a very nice young lady (very young...literally), I first got sworn in, and then she briefly explained the process and said that I would be tested first to get that out of the way. I was asked six questions and she stopped after I got them all correct, she said that was all I needed to pass. Then, I was asked to read the sentence "When do we celebrate Columbus day" (or something to that effect), after I read it she said that is was good and then she asked me to write "We celebrate Columbus day in October". She then said the testing part was over and that I passed and that we would review my application next. She asked my personal information first (Name, SSN, address, spouse's name, etc.), she asked if my husband and I had separated at all for any period of time during the past 3 years (it being a marriage based application), she asked if worked at the same job, also asked about any trips abroad, then she proceeded with all the NO and YES questions on the application. After reviewing all the application she said that she didn't see anything else she needed, and that she would be recommending my application for approval and if something else were to be needed I would be receiving a letter requesting it and I could bring it to the oath ceremony. She said not to worry if I didn't receive an oath letter right away, that it sometimes takes 1-2 months for it to be scheduled but that they at least give a 2 weeks notice. She also mentioned that at the oath ceremony I would be given a small form to fill out asking about changes that have occurred from the time of the interview to the time of oath only.
I'm glad that's behind and there's only one more step before the finish line.

The OP's case has nothing to do with bullying from USCIS. There is the law and the OP violated it. Period.
If you or friends of yours have issues against USCIS for your own reasons, it has nothing to do with the OP's situation. The OP has inflicted their predicament unto themselves, 100%. It's not USCIS' fault that they didn't pay attention and broke a law that would have given them the privilege of permanent residence in a fairly straightforward manner.

You have a number of misconceptions here.
SS is never cancelled. This talk of e-verify is a red herring. It has nothing to do with your situation. A credit card is not tied to status and would never be cancelled for that. They want your money no matter what.
When your 2-year card expired and you did not file ROC, then your LPR status was cancelled. That is the law. If you had a 10-year card, the status is not cancelled when the card is, but according to your story, you had a conditional, 2-year card. When it expired, your status was cancelled.
Because it was cancelled you could be in removal proceedings and not know it, or you could have been deported in absentia.
You are no longer a LPR.

You will need a lawyer to figure out your options. You are not eligible to apply for a new GC because you are no longer married. You can try to beg forgiveness, but 5 years is a long time. Please consult with a lawyer, or with a few of them.

Honey, throw them the KITCHEN SINK from K-1 to ROC. As much of it as you can. Let them sort it out, haha.
My husband and I got dinged for the same thing. Smooth sailing right up to ROC, then just when everyone else in our group was getting their approved letters in January, we went to the post and saw a blue paper in our USCIS envelope. I nearly died.
So, we collected every bill, bank statement, doctor's appointment, trip itinerary (tickets, etc.), car insurance statement and receipts from joint purchases that we could find, got our landlord to write a letter and sign it with his phone number and business card (which we attached to a copy of the same lease we'd already sent), printed out my husband's Facebook page with a post pleading to all our friends and family in the US and England to leave testimonial comments (we got dozens of replies), went to Walgreens and reprinted our photo collages from our K-1, AOS and ROC filings, and sent in the whole lot. I got my employer to draft a letter naming my husband as my beneficiary on benefits and life insurance. John also made a DVD with links to all of our YouTube videos (we do a video blog together) from all the years we've been together.
While you may not have the same things, you just might have enough stuff saved up to help you out. Go through it, pull out anything that you think will help your case, and stuff it into an envelope, girl. Then, write the most heartfelt cover letter you ever wrote in your entire life. I practically begged USCIS to come to our home, call our employers, our doctor, our landlord. LOL. It worked. We got our approval last week. Miraculously, we did all of this without a joint bank account or joint tax transcripts.
Be strong. You will get through this, I swear! x

Yes, more bank statements will help, one every other month or every quarter, spanning the length of your marriage. But do you have nothing else to add to that? Health insurance? Boarding passes from trips together?
