    Quick update: My husband was sworn in as a citizen on Friday! Here are his dates, if someone can update:
     
    Fingerprints: 10/20/17
    Interview date mailed out: 10/25/17
    Interview: 11/29/17 (Cleveland)
    Oath: 1/5/18
     
    Everything went really smoothly, other than the single-degree temperatures in the Cleve on the day of the oath ceremony! It was packed--probably about 80 people there taking the oath. One of our senators--Sherrod Brown--had a rep from his office there, which really impressed me. It was a wonderful ceremony and my husband immediately registered to vote, thanks to the forms brought by the Daughters of the American Revolution!
     
    Good luck to the rest of the September filers--I hope your process is smooth!

    1) Yes
    1a) Filing status is based on your marital status as of the lastday of the year
    2) no
    3) filing jointly means you include your worldwide income (not savings on previously taxed income)

    My husband and I had our interviews on Dec 19, right after the interview he got 3 update emails from Elis and eGov, and got his oath letter(PDF) next day.
     
    I got my letter (PDF) 6-7 days after my interview. Unfortunately we are attending on separate days, most probably due to my name change.
     
    Still, we are both very happy with the outcome, and our long journey will be ending soon...

    Happy New Year to everyone! I am glad to announce that my case got approved! On Dec. 26 my online case status changed to in line for Oath Ceremony and today I came home to Oath Ceremony letter that is scheduled for 01/11/2018! I couldn't believe it! I hope nothing goes wrong in the meantime.

    No, the poster who called it an overstay i think misunderstood you. Your ESTA was revoked on concern that you would overstay, not because you actually did. 
     
    It’s a pity you didn’t do the research before going. The US is very, very clear about this, as mentioned for example multiple times on the page from the US embassy in the UK about ESTA: https://uk.usembassy.gov/visas/non-immigrant-visa-faqs/visa-waiver-program-and-esta/
    example of one answer: If your return journey will take you back through the United States, even if only in transit, the total trip, including both periods of time spent in the United States/Canada/Mexico Bermuda, or the islands in the Caribbean cannot exceed 90 days. If it does, you will require a visa.
     
    owning a car is probably irrelevant tbh, it’s not much of a tie. You can sell a car in an hour. I’m not sure about the flat either if it’s just a rental, easy enough to break a lease. 
     
    I’m not entirely connecting the dots between just leaving your job, starting your own business, planning to do all just-tourism traveling but at the same time really needing to visit the US for business.

    Unfortunately your return tickets were probably seen as proof of intended overstay, because of the date on them.
    In any case, the ESTA is gone for good now.
     
    My suggestion is to wait at least 6 months before applying for the tourist visa, so as not to look desperate to enter the US, and especially after the revoked ESTA....but that's just my suggestion.  
     
    Also, with no job and no residence it would be more likely a waste of time to apply now....and a waste of money.

    They are important as they establish ties to your home country.
     
    That being said, yes it can raise eyebrows if all of these ties are established almost immediately prior to applying since it can appear to the CO that one is just doing so to get approved for the visa.

    It is confusing but possibly OP incorrectly believed, as some do, that visiting Canada or Mexico would reset the 90 days.
     
    OP, having neither a residence or a job makes getting a visa very unlikely, especially after a revoked ESTA. Do you really want to commit to the financial obligation of a flat you won’t be in in the hopes of getting a visa? (Unless of course you just stay at home if you don’t get the visa, rather than traveling elsewhere, then you’ll need the flat anyway...)

    On an aside, this part is confusing----if you were not planning on staying in the US more than 90 days, then why on earth would you have scheduled a return flight after that amount of time?

    Happy New Years all.  I'm happy to report that we finally got the oath letter for my husband.  It will be on 1/16 (noon, at the Federal building on S. Dearborn). His timeline:

    Further details - After his interview, he was handed a letter saying he was 'approved'.  On Dec  11 his case was updated to 'in-line for oath'; on Dec 27 his case was updated to 'oath scheduled'.   We got the oath letter on Dec 30 (it was post-marked Dec 27).

    Hi!  I did my oath in Chicago earlier this year (June).  The website only lists judicial oaths - not administrative oaths (i.e., done by a DHS official, not a judge).  The administrative oaths are done in the same building as where you go for your interview (LaSalle).  From my non-scientific review of oath dates over the last few months, it seems Chicago has admin oaths very regularly - a bunch of times a week?
     
    At my oath there were 40-50 people all being sworn in at 1 ceremony.  My ceremony was led by a DHS official (a young woman); it started at 9a and we were done by ~11a.   The longest time taken was for each person to go up and get their certificate.

    First. Relax. This is the easiest part of the whole process. Secondly, if you check the date of the ceremony it is probably a few weeks away. Perhaps enough time for your hard copy to arrive. If not, print out your online version with the date and location. ( did you scroll down because both sides come together as one pdf.) .Then go online and print out a blank copy and attach page two to your page one. Fill it out and sign.
    Here is what typically happens. You go to the Federal courthouse. You enter a waiting area where you register your presence. They check your form. Any problem they will most likely give you another copy to fill out. I sincerely doubt anyone is going to be turned away at this stage of the process.You enter the courtroom where a usher again checks your form and takes it from you. You sit down. You wait. You wait some more. ( In our case there were over 250 people from 45 different countries, very interesting). The judge comes out and may give a little speech, you take the pledge of allegiance ( the oath). Everyone claps and gives hugs. You back to the waiting room and wait for your name to be called to pick up your certificate. Take some photos. Go home.
    Have a party.

    Why does she have to go back home and wait it out when US laws allows her to stay and adjust status?
    The burden is not on the OP to prove that she entered without immigrant intent.
    In fact, immigrant intent doesn't even matter when she has already been admitted into the US. Matter of Battista and Matter of Cavozos.
    It doesn't matter if this was planned or not. It doesn't matter if she entered with immigrant intent or not. The law is clear on this. She has been admitted into the US. She is an IR of a USC. So, there is no problem.
    You've been a member on VJ for many years, you should know this by now.

    My husband Entered the USA on Visa Waiver and we got married. He then returned to his home country of England and continued to come back to the USA for visits, and was never given any problems coming and going. Our original plan was for me to move to England with him in a few years when both of my kids were a bit older, but while he was here I had some serious medical issues arise, and he decided not to go back so he could be here with me while I get treatment. All our plans changed in one Dr.'s visit... we decided to file AOS for him, and guess what, our interview was yesterday and we were APPROVED!!!
    I personally agree with those who said to stay and adjust your status since you are already here. It's legal, and as long as you understand you can not leave the country until after your receive your AP card (if you choose to file for it) you should have no problem. And as stated before, you will not be interrogated about what your intentions were when you entered now that you are already here. I know from experience as nothing in our interview yesterday was asked of why he choose to stay, or why we married while he was here on VWP. Good luck!
