caeremonarius reacted to thepeeeeej in N-400 September 2017 Filers
Congrats @caeremonarius on your wife's oath date. Congrats R & M and @Wishi on your respective interview. My friend who's also a Los Angeles paper filer just got his interview letter in the mail today. He applied in July and will have his interview next month. I think I will be receiving my interview letter sometime in March and will have my interview in April. *fingers crossed*

caeremonarius reacted to acidrain in Denied entry to the US
My spouse, young son and I tried to enter the US with a U-Haul and I was denied entry. I was told to complete the immigration process in Canada.
Are you aware you cannot spend more than 6 months out of 12 in the US? Your biggest hurdle could be the amount of time you've accumulated. You need to spend as much time outside the US as you have spent inside. Which is why customs probably told you to stay away for the next 6 months.
Your US citizen spouse will have to sponsor you while you wait in Canada. As others mentioned your child can visit the US. The border has always told me my son is welcome to the US anytime despite the fact we had to apply for IR2. Does your child have a US passport or birth abroad certificate?
So far the process has taken me a year to complete. I set up shop in Canada and waited about five months after our fiasco to cross the border. I signed up for a couple courses, put my son into daycare, signed a lease, etc. The first time I went to visit my spouse customs was very intense. They allowed me to visit but I only stayed for about 12 days the first visit. Showing you are completing the process legally is crucial if you want to be allowed entry into the US.
I would not delay filing for the i130 to start the process.

Agreed. Sorry to be blunt, but you were abusing your privilege to access the US by living in the US. Canadians are allowed to visit the US without a visa, not live there. CBP’s decision was justified, even though I do understand the hardship you are now going through. They need to follow the laws.
Moving forward, you need to wait out the immigration process. He can try for a waiver to visit you, or you can spend time in a third country. Those aren’t great options, but it’s something.

We just got the same notification!!! I thought a year was pushing it! We his is crazy! No legal issues, American born children, wife is an American citizen from birth and I’ve been in the country as a permanent resident since the 90s.

caeremonarius reacted to Going through in N400 estimated completion time
Don't get too worried or wrapped up in the case estimation time---it's a new function they just introduced a few months ago and it's horribly glitchy. Many people here (myself included) on VJ have reported that the number of months keeps changing back and forth frequently, too...sometimes changing various times within the same 24 hours.
Did you file the N400 online, or by paper application? Have you done biometrics yet?

I agree with @cupcake123 you need to wait 10 days. Also, at the ceremony they might tell you "Just show up to SSA, no need to bring your certificate of naturalization to SSA. They can call USCIS to verify the status." That is not a correct statement. Nobody in SSA will be calling USCIS to verify your status change. My husband works for SSA and was surprised to hear such a statement.
My situation is also a little different since I changed the official spelling of my name. I definitely have to wait to apply for passport until I change my SSN and DL.

The wait has been insane! 8 months and counting. We are planning an out of country trip for June, I just hope everything is completed by then.

Ha! Just like O'Hare International Arrivals!!! Two doors, and when it's crowded, you definitely can't watch both to see who is coming out! Seriously, my wife was waiting for family to arrive from abroad, and their phones didn't work in the US. Each flight is supposed to be assigned to come out of one of the two doors, but somehow her relatives came out the "wrong" door, and it took something like 45 minutes for them to finally find each other!

My husband and I both are done with this adventure.
Today I took the oath with 109 other people, it was great!
Good luck to all waiting!

This is wrong.
The I-485 for a family-based immigration requires an underlying I-130 petition. You cannot file for AOS without also filing an I-130. Since an immigrant visa number is immediately available as the spouse of a USC, you can either file both the I-130 and I-485 at the same time, OR you can send the I-485 at any point after the I-130 (and include the I-130's NOA1 with the packet). Both circumstances fall under concurrent filing since both forms are adjudicated together.
There's no need to leave the US / go for a CR-1 visa. This is an option still, but AOS is still available up until they exit the US.
Edit: For reference, AOS from a K-1 uses the I-129F as the underlying petition instead of the I-130.

Should have submitted them together. The I-130 petition will simply be logged if the fee payment was correct
-
caeremonarius reacted to geowrian in Spontaneous Wedding with no K1
The I-485 is filed based on the pending I-130, so it should not be cancelled. It's still a concurrent filing.

That's why the I-485 is needed. OP's spouse is in country.

Find an authorized doctor and get the medical done. Then file for AOS as soon as you get the medical done. That’s all you need to do. She shouldn’t leave until a decision is made on AOS. She should apply for AP and EAD with your AOS application so she can travel freely and work before receiving greencard. Don’t wait. Gather all the evidence and mail stuff out. It’s taking longer and longer these days for USCIS to process AOS.

Once you file the I-485 she can remain until a decision is rendered. She must NOT leave until she receives AP or a decision on the GC. If denied she will have to leave and you will need to get a visa for her to return

caeremonarius reacted to sevimli in Chicago Judicial Oath Ceremony Dates?
Happy new year!
Thanks, I got the same date as well. And yes, Dearborn is for judicial oath ceremonies.
I believe there is a min. number of attendee requirement in order to hold a ceremony, so I am assuming they are shifting people between two locations based on need.
Best of luck to everyone!

Hey, we've been waiting for my husbands oath letter - was in the mailbox yesterday (even thought it didn't show up on USPS's 'informed delivery' tracker). His oath is Tues 1/16 - at the Federal building on S. Dearborn. So I'm assuming that's a judicial oath?
As an FYI, he is not doing a name change, so not sure why he's being sent to that one!
Happy new year and good luck with the rest of the process!

Hi n400chicago5,
I am Chicago filer too.
I received my Oath Ceremony letter today with the location for the ceremony as US District Court @ 219 S Dearborn Street and Date 01/25/2018
I too did not request for name-change so not sure why am I being asked for a judicial oath.
Could you kindly please share your Judicial Oath experience after your Oath on 1/16?
Thanks

Thanks!!!
It is finally over (for my husband), and another ceremony to attend next week!
It went very nice, easy and smooth process. Only downside was about the passport application, we brought his passport photos, application that filled out and a checkbook. But we learned that applications that are done in USCIS building are quite costly than a regular post office application.
They insisted on charging us $60 plus fees on top of the regular fees. We ended up not applying on the spot. Will wait my own ceremony and will apply together at our local post office.
Has anyone experienced the similar situation at the 101 W Congress Pkwy Chicago?
GOOD LUCK TO EVERYONE!

Hi, can someone update this list to show that he is now a US Citizen? Oath ceremony was yesterday, January 8th, 2018. Good luck to everyone still waiting. It is worth it.

Thanks for the well wishes. I had a positive experience with my interview. It was this afternoon and I was in and out in a half hour. The IO was very nice. After taking the oath and showing ID, I was given the test. My questions were very straight forward:
What Ocean is to the West of the US? What is the name of the national anthem? Why are there 13 stripes on the flag? How old do you need to be to vote? What happened on Sept 11, 2001? What is the rule of law? The IO went through my application to confirm my responses, and after updating some more recent international travel, he indicated he was recommending me for approval. Hoping everything goes through and my status turns to "in line for oath ceremony" soon!
