    This was a cr1 process ( see i-130 form) , with petition with concurrent AOS. But the important thing is that your answer to the question you gave is the same answer that i said. Nothing to be worried but keep in mind and answer.

    You guys are confusing this a little bit. The OP is already in the US, thus not filing for a visa. The i130 petition for alien relative can be filed for an individual inside the US (together with AOS) or outside the US (with aim of obtaining an immigrant visa).

    They got marry after 90 days, so they let the K1 visa expire. They are fine, they started a new ordinary Cr1 process. But there are a lot of probabilities that the question about the K1 expiration will appear. So they have to be prepared to answer this question in a satisfactory way and in like many other questions their approval will be based on their answers to all the questions . So why are you confused?

    I have a similar question.

    I already have a ten-year tourist/business visa which means I can go to American for short stay.

    Right now I live outside US with my husband and I have a pending CR1, waiting to get approved so we can move back to America. 

    So if I have a legitimate reason to visit America for tourist/business intention, and can provide necessary documents(like company invitation letter, flight return tickets etc) to prove it to the custom officials, would I still be denied at the border?

    of course you can, but is a kind of lottery based on the decision of the immigration officer at airport. as you said you should bring enough documentation. sometimes they just ask and let you get in

  5. same-sex-marriage is a law approved by the Supreme Court of Justice. So no matter what the government says this is the law and i don´t thing any USCIS employee would take this risk, that could imply the lost of their career and for sure impacting USCIS credibility and allowing you to start a legal process that you will win.

    I know this is very stressful but the only way  to know the reason is asking USCIS, or wait for the explanatory letter and then you will be able to take actions. Before that you cannot do anything of course it could be a mistake and that is why is so important to know the true causes for this denial.

    After that you will have a month to take actions based on the reasons for the denial. Providing additional information or correcting the cause that conduct your visa to a the denial

  6. ok you dont have to worry because after your K1 expiration,  you started a Cr1 visa process concurrently. For sure they will ask you why you didnt get marry in the time frame required. if you both live together and are in love, for sure you only need to answer the true. is important that you as a couple talk about this answer in a way to avoid any inconsistency.

     

  7. Probably they will ask you why are you visiting USA. is good if you have information of your conference and an invitation letter. and say you are going to stay 3 more days as a tourist. Maybe they will ask you who is paying for your expenses during those days. and where ( Address ) where are you going to stay those days.

    I'm new to VisaJourney :)

     

    My boyfriend and I currently both live in the United States, but he has to go back to his home country because his visa is expiring. I am a U.S. citizen and he is not. We are considering getting married. Would it change the process significantly if we married abroad vs. marrying in the U.S.?

    You are both in USa, so you can marry and then file the petition, no waiting time. If you go abroad. Then you have to wait till the end of the process to live together. Only will be allowed to visit you without the intention of staying.

    nop, reading what they wrote, they were preparing their K1 and something wonderful happened. so they decided to get marry before. she did not come with the intention to stay

    After the immigration visa is approved this visa will be valid for 6 month. so you need to enter during this time

    This is because they found any issue, like some information that not match, or something like that. they are going to send the case to USCIS to review it again and they will send a notification of deny with it explanation, normally can be answered and add additional documents  in one or 2 month. after that they check and if they considered that the missing information is fine they contact you for a new interview. it is something long time consuming but there is still a hope.

  12. Did you win the lottery ? I am not sure if a got you but you should fill all the information you have, your works and your education because this is not a job search. this more like to know about you. If you have a Hight school diploma, then your write it down and say ot in an interview.
