    We live nowhere near a US border and he still carries his card. All the time. He's not a US citizen. It's the law that he carry his card. It's that simple for us.

    Did you guys find a co-sponsor? I seem to remember that was a challenge before... Hopefully someone agreed!
    I wanted to pipe in as someone who had a baby nine months ago and is now five months pregnant again. Pregnancy and having babies in the U.S. are very, very expensive. Depending on the state you are in, it can be quite difficult to get any sort of governmental assistance even if you are a citizen, which means you will be delaying prenatal care. I have excellent insurance and my last baby cost $2000 out of pocket (just for medical expenses--I don't even want to think about everything else!) and this one will be even more. I really encourage you to think about staying in Canada during this process, where you can get high quality health care without having to worry about the expense. Your baby has to be the priority now, so even if that means your husband and you separating until the birth at least you will have the resources you need to take care of yourself and your little one.
    If you husband-to-be doesn't have enough money to sponsor you and is still a student, please think very carefully about what these costs are actually going to be. Talk to your local Medicaid/WIC office and see what you will qualify for. Compare this to your options in Canada.
    Finally, think about what you are asking on here--you are going to move here and immediately become a public charge. You are asking all of us to pay for you to have your baby because you want to be with your husband during pregnancy. That seems awfully screwy to me. Harsh? Maybe. But when states are denying medical coverage to children who need surgery because they can't afford it anymore, it's a little frustrating (well, very frustrating) to have someone who has access to free medical care in her home country talk about immigrating here with full knowledge that she's going to take from the state because her husband and her can't afford to have the baby. You HAVE other options. Take them. [/rant]

    I'm not quite sure to have understood the meaning of your message, but if I got it correctly, then hiring a lawyer may make the process slower for the part of filling the forms and sending the application. Just think that a lawyer has several cases at once, not only yours, and if he has to go to the post office today, christmas eve, to send your stuff out, he will more than likely do it next monday (or even after new year's eve).
    Once USCIS has your documents, it's irrelevant whether you have a lawyer or not, because their processing times are the same and there is nothing a lawyer can do (for better or for worse).
    for sure a lawyer will send you his invoice, so unless you have a complicated case, I'd say you don't need one to fill a couple of forms with the info that YOU will have to provide anyway and mail them.

    If she would still be legally married to her first husband in that country still is still legally married to him here. Different countries have different methods of terminating a marriage but running away usually isn't one of them. She really needs to file for a divorce in her home state, serve him by public notice and then remarry her current husband. Not only is bigamy an issue but benefits collected for spouse number 2 can be considered fraudulently gotten ( my ex got into trouble for this , it wasn't a bigamy charge that caused him headache , his employers insurer asked for him to return all benefits she had taken )

    Not possible.
    A K-1 can only adjust status through the petitioning spouse. If this guy sabotages her AOS petition, she's hanging out to dry.
    I wonder, however, if this might be an ulterior motive of her husband, having her fate in his hands.
    Food for thought (calling Jim): could this count as a VAWA case?

    Your friend unfortunately is still legally married to her first husband. The US government recognizes all legal marriages that are recognized in the country they took place. Your friend can file for divorce here in America iwth out her husbands concent. So technically her second marriage to is not valid. The United States outlawed in the 1800's. Right now your friend could be charged for bigamy.

    Ok, get a big box, and then a bunch of boxes that fit inside one another, then for the small box, have the envelope with the cash in it, the bigger the better, this way they can all laugh as they open box after box after box, and if you really want to add to it, throw a bunch of tape on each box, if nothing else you and the wife will enjoy watching them open the boxes. :bonk: :rofl:

    I keep my newly acquired green card in my purse with my passport, I really do not want to lose it but I'll just try my best for the next three years not to.

    Please re-read the first three words of your opening post: "The law says." That's your answer, and THE answer.Those who don't are potentially playing with fire, because they can be stopped at any time by a Federal agent, or by a local law-enforcement officer whose agency is part of the ICE 287g or "Secure Communities" program. We don't know and can't know if or when such interaction will occur.Please re-read the first three words of your opening post: "The law says." As with every step of the visa journey, we have best results (or the fewest negative results) when we read accurately, interpret literally, and follow instructions completely.

    I'm livid that you closed this thread because you figured "This topic/issue requires the assistance of an immigration attorney." What a convenient excuse! First of all, I see too many threads on many forums on this website where the topic of discussion clearly require the assistance of an immigration attorney. Why aren't those getting closed too? Might there be a double standard? Hmm...I wonder. I challenge you to find me a clause in the TOS that states that topics that require expert help must not be discussed.
    But I suspect the real reasons why you closed that thread are:
    1. Just to make yourself feel "important" and "powerful"
    2. You probably don't have an immigration problem and you have zero empathy for those who do!
    3. Because you can't stand your "authority" being challenged as it was by w8inglongtime.
    I hope those who crowned you king realize just how power-drunk you are. And what better way to show more of your "authority" than by promptly closing this thread as well. And then terminate my account and ban my IP for good measure.

    Here are a couple of things for you to think about.
    When you get your NOA2, it will be that much sweeter. Also, things will move very quickly for you and there will be a lot of work to do after it pops. I'm also hoping that the consulates will have a decreased workload once the log jam breaks and things will move faster.
    Next, you will have your whole life together (hopefully). While it sucks, just remember the end goal. If anything it puts you through a trial period that will hopefully strengthen your relationship.
    Finally, how do you think people in the military feel when they have to deploy? My mom had to raise two kids while my dad spent two years in Vietnam. I'm not trying to say that our situation isn't bad and that we should all suck it up. However, it could be worse. Look at the good side. You have Skype. Your fiance is (hopefully) not getting shot at. You have something to be excited about. Can you imagine doing this before the internets? Just think of your fiance as a present you can't open yet.
    Just hang in there and try to keep a positive frame of mind (I know it is hard).

    What about putting out a flyer in your area and do some babysitting or maybe watching some neighbours kids after their schools if the parents dont get home right away?
    Or you could put a flyer and do some dog walking service for people in your area too.
    if you have a church close by you could join a church group maybe? sometimes they also have social events for people in the area too.

    Why are you getting an interview from Vermont? Is she not having an interview in canada where she is to get her visa? When vermont approves the petition it gets sent to NVC then it will be sent to montreal where she has to have her medical get her police papers and send in papers, after all that is done then she will get mail telling her to book her appointment.. you have quite a ways to go still before she will be moving.

    1) Physical presences needs to be more than 30 months in past 5 years, or 18 months in past 3 if married to a US Citizen. Also any period longer than 6 months will reset the presence to zero. You say out of country greater than number in country, then this would add up to MORE than 18 or 30 months out of the country and would disqualify you.

    2) you should keep a dairy, however, USCIS can pull these records from the POE to confirm what you enter on the form.

    Every sponsor's Social Security number is required by law. If you do not currently have a Social Security number you must obtain one before submitting this Form I-864.
