  1. After we get married, I file for the AOS, EAD, and for the application for travel document right? I have a kid with me with a K2 visa. does this mean that I pay the AOS twice, Advance Parole twice also? Is there a payment for the affidavit of support? should I include a money order for that one also and include it with the applications? If yes, there should be 7 money orders on the envelope that i will be submitting (AOS money order for me, AOS money order for my daughter, EAD money order for me, Affidavit of support money order for me, affidavit of support money order for my daughter, Advance Parole money order for me, Advance Parole money order for my kid) on to them?

    If you are not planning to work right away you don't need the EAD unless you can't wait for your GC.AOS yes for you and your child, EAD not necessary if you don't have to work right away coz you don't need it anyway once you get your GC. Application for Travel Document??WhY?are you planning to go out of the country while your AOS is pending?You can't d o that unless you will have the Advance Parole...AP is only needed if you are going out of the country while your AOS is pending. If not then you don't need it that saves you a lot of $$$$.

    Not correct advice... AP and EAD are NO CHARGE if filed with or after the I-485 so there is NO $$$$$$$$$$ savings

    so i only need to send money order for the AOS for me and my kid and the EAD and AP is no charge for as long as it is filed along with the AOS is that right>

  2. after the consul said that were approved, when i stood up, i asked him, btw, can i pick up my visa? no reason given, no letter given. then he said, hmmm. since its a holiday, it will definitely not today. after the holiday. I got a call after 3 business days. Because it was a holy week back then..

  4. Ive visited the step by step guide when applying for adjustment of status for k1 visa holders. Ive seen there about filing affidavit of support which is $70, right? I have my daughter with me, does that mean we have to pay $70 twice? its an I-864 form right meaning, I can have a joint sponsor?

    My second question is about the application for travel document, is this really a requirement or is this my discretion to apply for this one? Is it recommended to file this? since I have a daughter with a K2 visa category, does that mean I have to file the application for travel document twice?

  5. I need help whether I need to file the AOS before my K1 visa expires? Because I am leaving the country on June and my visa expires sept 2009. How long is the AOS process?

    Your K1 visa will be valid for 4 months from date of issuance. If you enter in June, that is well within the 4 months from the issuance of your visa on April 13, so you are fine.

    Once you have entered the US you must marry and file for AOS within 90 days.

    Note: It's not your K-1 visa that will expire in Sept. Your K-1 effectively "Expires" on the day you enter in June, at which point you will be issued an I-94 in your passport. It's the I-94 that has 90 days validity till Sept. You must file the AOS before the I-94 expires. Once your AOS is filed, you are in a sort of gray zone in which your I-94 is expired but you still haven't received your EAD, AP or Green card. The VJ advice I have seen on this matter is to always carry around EVERYTHING. Your passport, the I-94 (even though expired), your certified marriage license, and all the paperwork you sent for AOS. This collective package of documents is your proof of valid presence in the US till you get the Green Card.

    Thank you so much. When we get to the US, we'll get married right away and file for the AOS as well. How long does it take? So if Sept comes and my AOS is still pending, for as long as I already filed it, I can stay in the US right?

    does anyone here has requested for pick up of their visa approved? Mines was approved by the consul and I called today, talked to Lorraine of USEM.. not the call center.. and she told me that the visas were approved for printing only yesterday. Does anyone knows how long does it take for me to pick up the visas? I was interviewed and approved before the holy week last tuesday April 7. Just wondering tho.. excited as it is. :)

  7. well i was saying that because i saw some timeline that they met in person in less than a year and approved visa,so i dont see anything wrong,being helpful that you are hopefully the other girl passed too

    my fiance's friend. he jus tmet his wife on the internet then he come here in Philippines after 8 days talking online then after that meeting they file K1 visa. They got approved less than a year now they are happily married in US

    Oh I see. Yah i saw that too. I checked on the USEM's website that 'Evidence must be presented that the couple met in person within the past two years before the petition was filed.' thank you.

  8. I just got approved and wanted to petition my Parents when I get to the US. Im with a K1 visa. Im leaving the philippines on June 9. When can I start filing for a petition for my parents?

    Hope you are well.

    To the best of my knowledge, you cannot petition a parent until you are a US Citizen.

    Your stages will be: Enter on K1, marry, adjust your status to permanent resident, receive a 2 year green card, and then eventually receive a 10 year green card. You can naturalize and acquire US citizenship after you have been married 3 years. Once you are a USC, and not before, you can begin the process of sponsoring a family relative of your own- e.g. parent, brother/sister. You still have several years ahead of you before you can do this.

    I was wondering if the visits are the basis of the approval of visa,its like base on your statement theres a poor chances of approval if visit once.....

  10. Hi fellow VJers! Im sorry for the late post of my interview experience. Its a holy week and have to do a lot of stuffs before the working days ends. But here you go.

    April 6, 2009 7pm - went home to fix some folders, got done at 1AM .. practiced with my fiance about some questions and brainstorming for the last minute.

    Took me awhile to fix my folders because i made a portfolio with table of contents for each of my folders. I also made an AVP presentation of all his visits and pictures on the presentation.

    April 7, 2009 = 4am woke up, woke my fiance up, woke up my daughter and had my make up done. Prep my 2 yr old son eventhough he was still sleeping. :)

    530 am = left the house, dropped by caltex buendia to buy some sandwich.

    630am = arrived at the embassy (we were dropped off by my dad)

    - while i was in line, there was another K1 applicant from Cebu who doesnt know what to do. he documents were not complete, though she got proofs and other stuffs but the forms like the 156, 156K she doesnt have. good thing she paid the BDO application for but not filled up yet. When I came in, i told the guard about her that she doesnt have the forms and all that . she was so scared so I accompanied her. My kids are so kulit good thing my fiance is there to take care of them bec this lady is about to cry. When we came in, we waited til we were called to get a number. when the other K1 applicants saw me helping this lady, they started asking me for help. So I didnt had a time to feel the nervousness because i was assisting these ladies. I didnt even touched my folders and even proof read them no more because my attention were all with these ladies.

    The guard told us to get the numbers now and while in line, alot of applicants dont have the right documents with them. then people started asking me again, i had everything taken care of for my docs so i went ahead and fixed their forms again just for them to get a number. When i finally got my number, the first lady that asked help from me kept of following me saying ate, tulungan mo ko ha. so i went back i told the lady whos giving out numbers that she doesnt have forms yet. so when we came back and sat down, I filled up her forms while im interviewing her. Kawawa naman tlga. She hard in talking in english also, Im not sure if she passed tho because she only saw her fiance once and that was july 2008.

    Anyway, when our number was called for the pre-screener, i left her already. I told her, she'll be ok and I went ahead and do my own thang this time.

    Pre screener was a ###### at first. I know she has a tendency of being a ######.it showed on her face. When she ask me one question, I oanswered with just one answer. I didnt elaborate anymore. these were her questions:

    first she told me to give her the NBI, Cenomar, Birth certificate for me and my daughter and affidavit of support.

    -When did you guys meet

    -How did you know eachother

    -How many times he visited you

    -HOw long have you known him

    -When was his last entry here

    now she asked about some pictures and some proofs of our relationship.

    - My daughter's playing with the mic and she now had an attitude saying, pllllleeeeaaaaasssseeeeee wag galawin ang mic masakit sa tenga.. shempre, di ko pede labanan, so i apologized. She checked on my daughter's information, application forms and everyting and she said 'oh long hair ka dto ha, (sabe nya sa anak ko), sbe ko, ginagaya kc si angelica panganiban. Now she cracked joke and said, anak, idol mo ba yon? kc ako din eh.' so now, she's ok naman pala.

    Next she said, just sit down and wait for your number to be called.

    My name was called for finger scanning.

    after 3 minutes, I saw my number flashed on the screen. This is it.. My number was 7024.

    I went in with my daughter, my US citizen son, and my fiance. The consul said, how are you? I said, Im ok and how about you? naks! kala mo hindi kabado, but honestly i was not, pero starting palang. haha. The consul asked my fiance, are you the petitioner sir,? my fiance said yes. The consul said, you may stay outside and if i need to ask you questions, we'll call your attention, you may bring all the kids with you what ever your comfortable with. My daughter, my fiance and my son started to walk out. My 2 year old son starting to have a watery eye saying 'MAMA, HALIKA NA, IWAN MO NA YAN" he might be thinking na inaaway ako ng consul. hehe. So the consul said, he can stay. so my son just sat down. staring at the consul na parang gusto nya sapakin ung consul. haha.

    These were the questions.

    - So, when did you meet him?

    - for how long?

    - was he married before? once, twice, thrice? (maybe he is just fishing if i know) so i said only once.

    - how many kids? i said one.

    - where is the kid staying? i said with the ex wife's family.

    - he's been here since november 2008, how can he sustain all the expenses and how can he support the family? - I answered that he has a media and production business in the US and he's having his stuffs rented out while he is here.

    - he asked when you guys come back to the US does he have work, like how will he support you? I told him as ive said he has the business there and once we are there, he can DJ again and use these equipment and make money for us. and he said, I SEE.

    - what are your plans after getting to the US - i told him that we'll get married first week of June.

    - He asked how old is my son. And I said he is 2.

    - He said so he is a US citizen already so he's good to go, I said yes.

    - He asked me where is our POE, I said Guam. (because the affidavit of support is only good for poverty guidelines in Guam) tho we are really planning to enter Hawaii.

    (my son heard me saying Guam, so my son called my attention saying.. MAMA MAMA!! HINDI GUAM!! HAWAII!!... shet ang kulet ng anak ko!!!

    - He was just scanning to the documents again.

    - Then the consul said, I dont have any other questions maam, your visas are now approved.

    - I said thank you sir. I have a question, can I bring my brother and my father with me to be on my wedding day? he asked me, are they being petitioned? I said no. he said, they would have to apply to the non-immigrant section instead. my second question sir is, can i have our visas picked up? he paused for a few moments and said, hmmmm. definitely not today, and since theres a holiday, it will be after holy week. so he approved it. I said, thank you very much sir.

    I went out, with a blank face because I was tripping out. I dont want to tell my fiance what happened, wheather its approved or not. I just want to trip out for like 5 minutes. I told him yes, its approved. He started crying and people around were touched and a lady started to cry also. he hugged me and said thank you. awwwww...

    My number was called I went to one window and the lady said, the consul approved to have your visa picked up so im giving you this claim stub.

    - i went to my fiance and left the building.

    Thank God! I was expecting the hardest interview ever. Why? thats because of our complicated situation. My fiance's ex wife recently got approved for an IR1 visa and left only last year. I even helped her to get to the US and I was the one who processed her son's CRBA. They got divorced after 3 months and filed for his petition to me. So i was expecting theres a loop hole there and will start to ask me questions about it. But no. It didnt happen like that.

    Thank you guys for the time. and for all those who will have theri interview soon, one advice that i can give, LESS TALK, LESS MISTAKES. :thumbs:

  11. My fiance has an upcoming interview for her K-1 Visa at Manila.

    What is the best way to arrange the folders?

    Should the 2nd letter of intent be in the I-134 Folder?

    Should the DS-156, 157, 156K be in a folder by itself? Etc...

    just follow the one on packet 4 that you can download online. i had my clear book in a portfolio and i had placed a table of contents outside the clear book folder

    i was hoping to see you that day.. hehehehe. sana makuha ko na sa monday. i scheduled my dad and brother for a tourist visa on tuesday. sna mabigyan sila. kc chambahan lang tlga don eh. ung mga kilala kong milyonaryo, denied sila kahit na meron sila pera. ewan ko sana wag ganon mangyare kina dady para andon sila sa kasal ko.

  13. Im consfused. He overstayed in the US? If i am not mistaken, if he is filing a k1 visa, he should be a US citizen so that means being a US citizen,you can stay in the US as long as you want. please correct me if I am wrong.

    Initially, I started my journey posting questions about my K1 visa petition being too complicated as it is. The first post I had was about filing a K1 visa petition as soon as getting divorced. With it, after I stated my case, I got all the haters, without even thinking whats the real deal. Let me give you guys an idea on what was our situation before today.

    My fiance was married to a Filipina for 8 long years. They have a 6 yr old kid. He petitioned the first wife 2002 with an IR1 visa category. In the middle of the petition, my fiance met me me, around 2004. We started chatting online, since we were only introduced thru MySpace and finally met July 27, 2005 when he visited philippines that time. I knew about the marriage but he said they are longer together so I continued with the relationship with him. When he went back to US after that 1 month visit, I learned that they are still together and the petition is still running. That moment that I knew that they are still together, I broke up with him and the next day I knew i was pregnant with him. I continued with the baby, gave birth April 25, 2006. When my baby turned 3 months, I filed for a CRBA for him and it was granted and now he is a US Citizen already.

    IR1 for the wife got approved March 2008 and left for Hawaii on April 2008. My 'fiance' continued with the petition because he thought the relationship with the first wife will be fixed once she get to the US. My fiance went to Guam and not flew to hawaii with her because he got an offer for a new job and a business around end of March. As you notice the petition took alot of years and the first wife already had the plans all set and dont want to go with him to Guam. THe whole plan was for the wife to go to Hawaii and my 'fiance' try to go to Guam and check out the life there. My 'fiance's ' business went well the same time as the wife got a stable job in Hawaii. He wanted her to come over to Guam with him and unfortunately, they started fighting over it and resulted to divorce. My fiance filed for a divorce on July 2008, that was 3 months after the wife got to the US.

    My fiance decided that after the divorce, he will petition with with a fiance visa petition. Divorce was granted Oct 3, 2008. My fiance filed for my K1 visa on Oct 10, 2008. He went to Manila for 5 days and proposed to me on October 15, 2008. I am all worried about our case bec he just got divorced and the ex wife just got to the US. I know that it will be a red flag for them. But we still pushed thru with it as we really have a bonafide relationship with trials and mistakes along the way.

    We were also worried about his income when we'll have my affidavit of support since he got there in the middle of the year meaning it will be hard for him to earn income good for 6 household. THat will include the ex wife, their kid, me, our baby my first kid and him. But his business suffice the income and made 35k for 6 months plus savings. so were ok with that.

    People here thought that we are having a VISA Fraud with my case and will cause the first with to be deported and me being denied on my interview. Let me tell you guys that I JUST GOT MY VISA APPROVED, for one because we really love each other and our relationship is genuine. Mistakes happen, we are just people not perfect as it is.

    For all the people who hated and posts stuffs againsts my case, I understand your point. And thank you also for being a part of our journey.

    ive never read your post before but i would like to congratulate you.anyway just a few questions coz we have already receive our NVC letter with the manila case number last april 4 2009 what should we do next?should we call the manila use embassy for scheduling the interview.?pls guide me since you already approved

    you may call NVC at 603 334 0700 and ask if they have sent your case to manila yet. if yes,then you can go to st lukes and do your medical, be sure to bring your NOA2. if they havent sent it yet, that means you have to wait til they sent it. thanks

  18. well guys i need some insight here im bit of nervous because my interview is up coming and here the thing that maybe i might be in trouble i hope not.. my fiance visited me once when we got our engagement party last April 13-19 just 7 days

    after that their no chance to visit again because after he was out of probationary to his work his department gave him more work load and it mean there no really chance to visit again beside its not practical too for me.. now im nervous because consul might question it why? but we have lots and lots of chat log cards and some of prof of evidence then his mother letter remittances pictures of our engagement,everything is here but still this one bothered pls i need some tips who have in here in vj same situation with me pls pls pls i really appreciate all the info you will share

  19. :wow: That's so great! You're so lucky to resched your interview date to an earlier slot, wish i could also do that! I and my fiance are planning to call every day to resched my May 6 interview date to at least last week of April coz i already passed the medical exam and i can't wait to get my K1 visa and book my flight :)
