    hey uscan, thanks!! this is so great. i always stalk your timeframe because we have almost the same day when we were stucked @ NVC and luckily left NVC same as well. Im so happy that both of us are out already. You would not belive that i called 5 times today to confirm?? hahahaha. funny. i cant belive it thats why.     Guys, thanks for all the support. I will prepare the dcuments already that i will be needing for interview. I have a few case wiht my credit card company because i owe them money here and havent paid for a while so, they im afraid they might hold me if they will file case against me. though i have all the police clearance that I need. i just cant pay them because life here in manila is realy hard. i got layed off from work so that is the reason why i was not able to maintain paying my cards. But i wnt to fix my issue with this card but still dont know how. I;m sure embassy will be able to see pending cases if they will file one against me.

  2. i called again because im not contented with that answer earlier. and she put me on hold for like 5 mins. and when she went back, she told me that review and processing at the NVC is all completed and will be sent to manila in 2-4 weeks. is it really 2-4 weeks? but IM OUT OF AP ALREADY. !! i guess the count for 52 days is true. friday the 13th!!!!

  3. It will be two months on the 16th of March. I call them often and as of 3/11 we were still in (AP). :help: us all God. Im remaining claim for the most part, but as for my SO he is ready to throw in the towel and have me come to him. Faith will conguer this milestone, I pray that we all will overcome this solitude.

    I called today. the representative said my case is out of AP but for some reason it went back. I dont know what they mean by that but as of the moment its out of AP. and there is no time frame for that. what the hell is that!! is that AP part 2?!!!!!! the hell! today is my 52nd day but i thought it will be different. anybody heard that before? or should i call tonight instead before they close?

  7. does immigration from my point of origin hold me if i have pending credit card bills?

    I could see that you are from Dubai. The immigration in Dubai airport or any ports in UAE would just hold you if the bank has filed a case regarding your credit card bills. But if not then you are good to go. You could pay bills anywhere (even out of Dubai) you are anyway..

    how about in the philippines? if there are banks that filed case regarding your credit card bills, will they hold you even if you have the court and prison records certificate that you are clear and NBI showing you dont have a record?

  8. After reading your story your two main issues are:

    1. Whether or not the entry as to the "mother" in the BC of your fiance's half brother should be changed?

    2. Who should petition your fiance's half brother after fixing his BC ?

    Clearly the other characters have no problems at all since their visas have already been approved and they are all here in the US.

    I say get a good immigration lawyer especially that there is "fraud" involved because of the "simulated birth" ( when another person is entered as the mother of the child in the BC other than the real mother ).

    Sticking to the truth or not, I believe a good lawyer can give your fiance's mother the best advice to fix everything.

  9. How about sticking with the truth right now. Change the name of the mother in the BC from the sister's name to the real mother's name (your MIL on your story).

    And one suggestion, please stop calling your fiance's mother as your mother in law. If you stick with this mother in law thing and the consul saw this in your evidences, you would have a bigger problem explaining it.

    Use mother in law for your fiance's mother after marriage. This make the story so confusion to everyone.

    Ok. I'm sorry. My bad. Just used to say that. But then again, to make clear, as of the moment, she is not my mother in law yet. thanks reanick!

    Your story is too convoluted and I have a hard time following the individuals involved. But my main question is, how/where do you fit in, who are you in relation to this story? Are you also petitioning your 'fiancee'? How can the mother (but not the mother on the BC) be your mother in law, if you're not married? :wacko:

    Are you sure your terminology is correct? If the 2 kids just recently came to the US (December 2008?) on IR2 visas how is it that anyone is a US citizen?

    Lets put names on this situation so that it will be clearer. My fiance's name is Luck-e, (soon to be married to him so I consider his mom my mom-in-law) His mom's name is Gloria, His 21 yr old kid is Rey, and the 18 yr old kid is Warren and the one with the CR1 visa's name is Luke.

    When there were petitioned, their visa shows IR2. Their cases got current when warren was 2008. USCIS expedited the warren's case because of the CHILD CITIZENSHIP ACT of 2000. Their case was different (warren and Luke) it didnt go the normal wait periods because USCIS expedited their case. It is stated on the letter with the instructions on how to medical, that Warren has to be in the US before he reaches 18 in order for him to get a US CITIZENSHIP. We were informed by the USEM when we called that his case is expedited and need not to be scheduled. Just go to the embassy anytime Mondays-Fridays 8-5pm and they can have their interview anytime. However, Rey who is 20 yrs old when the case got current, was left here and just got his visa last Dec 2008. There were no instructions nor letters stating that he will have the US Citizenship just like what warren received.

  12. This is something that you need legal advice to know what options are open. Things dont work the same way here as in the Phils. Your attempts to fix things on your own might jeopardise all of your families future here. Get a good lawyer.

    My mother in law petitioned my fiance's half brothers and their dad. They are now in the US but left one here who is over 21 yrs of age.

    The whole story there is, my fiance is the first son of my mother in law way back 1981. My fiance's dad petitioned him and his dad and left for the US when he was 7yrs old. My fiance's dad was addicted to drugs and was turning crazy and hurting my mother in law. My fiance and his mom ran away, went to guam and went to the philippines because he was turning all crazy and cant control him anymore. They felt that that was the only way to go.

    When they were here in the Philippines, my fiance's mom met another man. (my fiance and my mother in law are both USC already and this was around 1987 i think). He had 3 kids with this man, the eldest is the 22 yrs old now. However, because she wanted to keep this as a secret from her in laws in the US, when she gave birth, she had her sister put her name as the mom of the new born baby. She gave birth in the province and you know how the system works here, you can always ask favor for them to do that. So there, the birth certificate shows that the mother of her baby is her sister and the father of course is the new man.

    After a year, she got pregnant again but this time, she put her name on his birth certificate as the mom and the new man is the father, this kid now is 21 yrs old now same goes with the 3rd kid is 18 yrs old.

    My mother in law went back to US and worked, my fiance was left here in the philippines with his half brothers and their father (half brothers father). My fiance followed to the US after sometime. My fiance's dad was deported to the philippines because of drugs. When he went back here, he still continued to take drugs until he totally lost his mind and cant recognize people around him anymore. My fiance's dad did 2002 due to multiple organ failure.

    Before my mother in law left for US before, she ended her relationship with his new man that got her pregnant with 3 kids, move on with her life to continue to raise her kids and just sending money to the philippines if she could. When she is starting to have her life back considering the nightmare that she had with my fiance's dad, being a battered wife, she eventually petitioned her mom and went to the US as well. She finally fixed her life and moved on with it.

    On 2007, me and mother in law talked about having my fiance's half brother come to the US. I see no problem with it since those are her kids anyways. The only problem that came across our conversation was the very first kid that she had her sister sign the birth certificate as the mom. What she taught about is to just marry the father so that the father can bring him to the US.

Or should we fix his birth certificate and file a LATE REGISTRATION AT OUR NATIONAL STATISTICS OFFICE and place that his mother is his real mother. (it sound redundant but thats the simplest way i can state it, sorry ). If we fix his birth certificate, instead of the brother petitioning the eldest son, my mother in law can just petition him right? Im just thinking of complications that will arise and whats the solution for this because, in reality, she is still the mom.

    Yes Just file I-130 and if she becomes a Citizen she can have it upgraded, wait time is many years so dont expect any results for a long time They are just issuing visa's to people who had an approved I-130 from Dec 1997.

    what happens if he becomes a US citizen while he filed an I-130 petition when he is with a 2yr greencard that will be a 10 yr greencard after he adjust his status?

    i see that people with greencard that petitions sons/daughters are faster than a US citizen filing it now. Since they are now giving F2B (Unmarried Sons and Daughters (21 years of age or older) Children, and Unmarried Sons and Daughters of Permanent Residents for those who filed 01 DEC 97 and for F1 (Unmarried Sons and Daughters of Citizens), they are now giving visas for those who filed 15 JUL 93.

    If his US citizen brother petitions for him, it would be in the F4 category (US citizen petitioning for a sibling). The wait for a Filipino is 23 years as those in this category with petition filed on or before May 15, 1986 are just getting their visas.

    If he gets his birth certificate fix and his US citizen mother petitions for him in the F1 category (US citizen petition for unmarried child), the wait is 16 years. Currently, F1 Filipinos beneficiaries with I-130 filed on or before July 15, 1993 are getting visas. If the brother gets married, he will automatically move to the F3 category where F1 Filipinos filing on or before June 8, 1991 are getting visas.

    If I understand what you are saying correctly, the 22 years old brother's dad is now in the US and has a green card (legal permanent resident). He can file for his son in the F2b category (LPR filing for unmarried child 21 years or older). Visas are available for F2b Filipinos with I-130 filed on or before Dec 1, 1997. THIS IS THE FASTEST WAY TO GET THE BROTHER AN IMMIGRATION VISA. The brother should not get married until he is in the US with a green card; otherwise the application will be denied as an LPR cannot petition for a married child. The dad can become a US citizen and if he does, he should request that the application not be reclassified as an F1 at that time.

    the 22 year old brother's dad is now in the US with a CR1 visa. that's conditional and if im correct, he would need to adjust his status after 2 yrs to get an LPR. am i correct? My next question is, how about the birth certificate, if the dad will be the one to petition it or the brother, either or, he needs to fix the birth certificate still or what?

    Im thinking if he fixes it, the USEM here will see 2 names on our NSO's database and will see that he his name is attached to one dad but two moms? and might question that he only fixed it now that his dad and brothers are in the US and just doing it to get to the US with them.

    3.) should we stand by what is written on his birth certificate that his mother is my mother in law's sister, or should we just file a LATE REGISTRATION at NATIONAL STATISTICS OFFICE and place that his mom is my mother in law? Is that possible?

    4.) I understand that US embassy does its own verification with our NATIONAL STATISTICS OFFICE, so I'm assuming, this might really be a big problem because they might see there that his name will appear twice on the database, one it will show the same dad but different mom (that is what I am thinking) So I really dont know how to fix this mess.

    I hope to hear some advice here guys. Sorry if its really long but its really like a soap.

  18. Does the NVC mail a letter to you with a NVC case number, for you to call and track? Or do you have to call the NVC and acquire the case number yourself?

    you may call NVC first. If they received your case from USCIS they can give you the case number over the phone. in the next coming days or weeks, you will receive a notice that they got it and assigned you a case number. but then again, you may call so that you keep yourself posted while waiting for the mail to come in.

    ei liza, i was waiting for your post hehehe stalker. congrats! i was reallly expecting you'd be out on your 51st day. whew!. anybody else here that are near their 51st day? I called NVC today nahhh.. same thing.. im on my 38th day now. still 2 more weeks to stretch out... will just do my medical with my kid so as to avoid this feeling.. u know what i mean.... arrrgghh! this is really prolonging my agony. ..
