    NVC has recently received the petition from USCIS and gave me an MNL number today. So i am preparing documents i need during my interview. we are woking on the affidavit of support now. My question is, my fiance started a business in Guam its for a media service last July 2008. He is also working at the same time. he earned 35,500 plus for the year 2008. My question is, since the 2008 just ended and w2s are yet to be mailed and if in case I should have it before my interview like around febuary, it might take a couple of weeks before my fiance completes preparing his ITR for 2008 so my fiance might not have enough time to file the 2008's ITR. can we just show his paystubs, w-2s and the filed taxes for the newly set up business and his 2007 income tax return? Is it ok if the business is just new but is earning enough money together with his jobs to reach the 125% of the poverty guideline.

    Recap:

    1.) can i just bring my fiance's 2007 income tax return since 2008's income tax return might not be ready by febuary just in case my interview will be set this february.

    2.) the total income from the w-2s and the NEW business will be 125% of the poverty guideline, but the business is NEW, is that ok?

    You've got things well covered. A new business is not a problem since his employee income is more than sufficient.

    He only worked there for like 6 months only and he is now here in the Philippines since November since his business is making money in Guam. HIs new business makes more money than his job. is that ok? he wants to wait for me then fly back to US.

    He's going to be declaring the income he currently derives, not what he derived in the past. He can provide tax returns but cannot base his current income on what he earned last year from a job he doesn't have anymore. Does the business provide sufficient income? If so, what evidence can he provide to support the income claim.

    evidence would be the filed gross revenue tax every month. In guam, when you have business, you file your earned income from this business every 20th of the month and pay corresponding tax due. last 2008, he earned 31k plus from the business that he currently have. He is currently not with that previous job since he is here in the philippines right now. this january 2009, even if he is here in manila, his business earned 2,500 gross revenue. can he bring his w-2s for his previous job and filed gross returns from the business last year nd january 2009's gross revenue tax filed?

    You keep asking what he can bring and fail to notice the key factor is his current income. It would help if the two of you actually looked at the I-134 to see what I'm talking about. It asks him to declare that he currently derives $X income from X source. "Gross Revenue" can be but usually is not "income". It can be, in a service business with no overhead but I take it he knows the differnce and needs to read the form and decide what his answer would be and what he has to docuement that answer is true.

    Of course, he can bring any financial documents he thinks will help them rule in his favor but he must answer that one question truthfully and back it up. I'm always leary when the USC is not involved in asking the questions. He's there with you. It's his affidavit of support. Why isn't he asking these questions?

    We are both here and he is also unsure of what to do. He prepared the I-134 last week January 21, 2009 to be exact and the total income he put in there is the total income he had for the whole year of 2008 that is comprised of the income from the two jobs he worked and the income from the business.

    Sorry pushbrk because were really confused. Sorry for asking the same questions. If say for example he prepares the I-134 dated February 2009 that will only include income for January 2009 because thats the only current month he can declare, is that how it is or what? If that case, how can that affidavit prove that it will meet the 125% poverty guideline? thank you for the help.

    Here is what I suggest... I've helped friends and families with their petition and as soon as we learned that the case is being sent here in manila, we go to st lukes right away without the appointment letter. Just bring your passport, the 2x2 pictures and the payment. If the guard will look for the appointment letter, just tell him this.. 'kuya sabe po samin ng NVC, kayo nalang daw po ang mag rerequest eh" ok na yon. We always do this that way if you found out your sick or something, you'll know as early as now. Bec that happend to us already. we went to st lukes and had a medical with the appointment letter and it turned out that she has this spot sa lungs then she would have to go back after 2 months, which is very frustrating. so we tried making excuses kay kuya guard para we can do the medical early. just be sure you'll not do the medical more than 3 months bec it has an expiry date. wait until the case is sent here in manila then go to st lukes na.

    yeah i wanted to have my medical done first before i quit my job...but do guards buy that excuse?

    yes they do. we did that 3 times after that first one that had to return after 2 months.

    I would like to ask since k1 visa is considered to be a non-immigrant visa that requires to use the DS-157 and DS 156 forms, I assume the same goes for the tourist visa applicants. My question is, my interview will most likely be next month or by march, I want to bring my dad and my brother (who has a photography business) to the US to be there on my wedding day. Do you think it is alright to bring their DS 157 and DS 156 together with their passports during my interview day and once approved, can I ask the consul if I can bring them with me when I leave for US and give them their application forms for a tourist visa application?

    HI..JUST CURIOUS..WHEN DID U GET YOUR MNL CASE #?RE YOUR QUESTION ABOUT BRINGING YOUR DAD AND BROTHER WITH YOU ..I WAS ALSO PLANNING TO GET MY MOM APPLY FOR HER TOURIST VISA-SHES 70 NA KASI AND SHE HAD GREEN CARD NAMAN BEFORE PERO SHE DIDNT HAD ENTRY IN THE STATES FOR LONGER TIME.. I THINK ITS OK NAMAN AS LONG THEIR TOURIST VISA WILL BE APPROVED..

    I havent received any MNL case number yet. thats what i am waiting for I recieved an email that it was sent to NVC last week pa. so i assume they will get it either today or if not tomorow latest would be next week kc it was holiday last monday so there might be a delay. il call NVC in 3 hrs. :hehe:

  10. 2008 IRS taxes are not due until April 15th, 2009.

    W-2's, 1099's, etc employers and companies have until Jan 31st until they have to be mailed out.

    so for the moment, he can show his income tax 2007? but how if that cant cover the 125% of the poverty guidelines but the earned income that is not filed yet for 2008 met the requirement, what can he show?

    one more question about affidavit of support for a K1 visa. just to clarify, I will bring an affidavit of support during my interview right and he doesnt need to notarize it anymore - according to the new rule, right?

    second question, we received the NO2 yesterday and was thinking my interview might be in a month already. We wanted to prepare all the stuffs that we need already and all we are waiting for right now is the affidavit of support. w2s for 2008 are not in yet so he cant file for his income tax return for 2008. Although he has a business in guam that he is paying taxes every month that is enough to 125% of the 2008 poverty guidelines with all the pay stubs until october 2008.

    He doesnt have pay stubs after oct 2008 til the present since he is here in the philippines with me and wanted to be with me during my interview day. However, he is making money out of his business in Guam and is paying taxes as well. what do you guys think, what does he needs to show during my interview if he has no work since oct 2008 up to my interview day since the Income tax return for 2008 is not filed yet.

    is there anybody here in VJ who is from guam? bec my fiance is paying taxes every month depending on how much money he make for his business.

    I hope you guys can give me some answers.

  12. Just because you submit cosponsor paperwork, does not indicate that the CO accepted the cosponsor in making their determination of support. The CO looks at your circumstances and can make a ruling based on his belief that you may or may not become a public charge. There is no set minimum income for this determination for the K visas. Minimums are set by statute for the I-864 which is not used for the nonimmigrant K visas. If you have cosponsor paperwork from close family members, it could show that you have a support network already in the U.S. and may lead him to determine that you are less likely to become a public charge. It does not prove that he used the cosponsor income to meet some minimum requirement. Likewise, if the cosponsor paperwork you present is from someone that has weaker ties, the same determination may not be made. In either event, the consulate in Manila will not use the paperwork to create a cosponsor dependency. They will rule based on the totality of the circumstances with the petitioner as the only sponsor.

    one more question. i just got my NO2 yesterday and i was wondering, for his ITR 2008, he hasnt filed his ITR 2008 yet since w2s are not in yet. he has a busines in guam and worked for a couple of months in guam as well, what does he need for his affidivit of support if he has not filed his ITR for 2008 yet?

  13. magic jack retailer in the philippines? hhhmmm...i wanted to get one for my house and get another one and send it to my husband in the philippines but i would have to end up paying 20$ yearly for both phones which is 40$ each year...but then i guess it is unlimited...please give me the number of the retailer of magic jack in the philippines...maybe my husband can go see how it really works over there. we have internet at home but it would be nice if he called thru magic jack to my verizon cellphone in the us without being charged per minute!

    get a magic jack. go to www.magicjack.com and that will give you more information. there is a retailer here in the philippines already and you can ask them to buy it from here. not over 3k pesos. PM me and il give you the retailers cell number. i have one here and it works perfectly fine. all of my family in different city and provinces has one. since we get a mainland phone number, you (in the US) can call it just like calling another state. you can bring the magic jack anywhere. the thing is they would need to be online for you to call them anytime and for them to call you also. you dont need to be online for them to call you bec they can call your cell in the US or your landline for free. thats calls to US and canada for free. hope this helps.

  15. call 1-800-375-5283 then at the menu, press 1,2,3 then wait for someone to answer the phone and demand to speak to a supervisor, the cs rep will ask if they can help you, just say no because this issue requires a supervisor, then the cs rep will place you on hold while he locates the supervisor, after he locates one he will transfer your call to him.... Good Luck!!

  16. we have phoned three times about our missing noa2, which we are completely convinced that they never sent to us. Our case online still says received and pending, and everytime Vito Phoned they have said that they cannot see our approval (so proves they see no more than we do on our accounts) and have even been asked how we know/found out we are approved.

    We found out from nvc we were approved by letter, so that proves they have his address right and nvc told us on the phone our approval date was the 23rd of Sept. just to be doubley sure we have been approved i have my interview on tuesday :wacko: yet still our account online says received and pending, and no email or correspondance from CSC, at all in regards to our approval.

    the last time he phoned the lady promised to send a service request i think to get our account updated. and the last touch date has changed finally from july to november, but still says same thing. received and pending :bonk::bonk:

    we are hopeing that i can fly out mid feb and we have our wedding date booked for 9th of april, so we dont really have much time left to sort this out with them, if past attempts have anything to go by. and i dont really want to be out of status for any ammount of time of i can help it.

    can someone please tell us what we are doing wrong on the automated options, how do we get to speak to an actual officer or representative at uscis that has more access to info than we do? because clearly thats all the call center staff have. or perhaps is it possible to go to the center its self and ask to see someone about our case? how would we go about that if its possible?

    how did you talk to a representative when you call the USCIS? i tried to call and all i get is computer prompts. im using a VOIP phone here in the philippines. i needed to see where is my NOA2. i hope you can help me get a hold of an actual representative since my online updates says the same as yours. thanks.

    Ive been tryin to call USCIS for the last months to follow up on our case but everytime i call even in between their ofc hours, i cant seem to find the right prompt to talk to a representative. all i have are computer options. im Using a VOIP phone here in the philipppines.

    I was wondering if anyone can help me talk to a represetntative from there? thank you.

    I would suggest that you have your Guam divorce decree confirmed in the Philippines so that it will be validated there. That is the recent rule now when one of the parties to the divorce is a Filipino citizen. Unless you do that, your ex-wife will remain married to you and if the USEM would conduct its own verification, such fact would appear.

    just need advice on this. i recently filed for a k1 petition for my new girl in the philippines and got the NOA1 last oct 29, 2008. there are some questions i want to know if there would be some problems when it comes to my fiance's approval to get the k1 visa. I am a US citizen and was married to a filipina last 2000.i filed for her IR1 visa on 2004 and she got her visa and left for the US last april 2008. i met another filipina last 2005 and got a baby with her (who is now a US citizen btw). it was all because i fell in love with the new filipina but still continued for my first wive's IR1 petition. my first wife has forgiven me after everythin that happend and things are going well among the 3 of us. we hav agreed to get divorced the moment she gets her SSN. now that she has her SSN and now working, i went to guam last may 2008 and filed for a divorce after a month of staying in guam. i got the court order that we are finally divorced last august 2008 and immediately filed for the k1 visa for my new girl. we got the NOA1 last oct 29,2008 and went back to the philippines to stay with her for a while again. got in the philippines last nov 4, 2008 up to the present. my question is, would there be some complications as far as being with my new girl in the middle of my first wive's petition? i got divorced before filing the K1 visa petition but our relationship is active since 2005 before my first wife got her IR1 visa.

    My second question is, about her point of entry. i filed in the guam sent it to CSC but i was wondering if can her point of entry be in new york or in hawaii, not guam?

    I hope i can get answers from you guys. i know our relationship is really interesting and kinda messed up but were going thru it.

  19. It could be true love for you this time but you still have to prove it to the USCIS. You do have a uphill battle, if you have any, with your situation. USCIS will not just go by 'but its for real this time', they will check your past and your petition history and a lot will depend on that to say the least.

    You might want to research a lot more, take legal advice and check for eligibility etc and not just look for 'you'll be alright' here on VJ coz frankly its a very messed up situation.
