    My goodness, this is an extremely judgmental and NOT helpful response. If you don't have any facts, and don't have any answers, I suggest not commenting if all you feel like doing is judging someone harshly for their living situation. Not to mention questioning the validity of the person's relationship simply because the OP lives with their parents. Thank goodness you AREN'T the one doing an interview, IMO.
    The OP asked for advice on whether their living situation would impact their petition, which it will not. They did not ask for your opinion on how they live.

    How the hell do you not have contact with your spouse for six months? This raises questions as it is not normal.
    Imagine the interview: When was the last time you spoke to your husband, the person petitioning for you? Six months. = Visa Denial

    Your late husband's income is not going to count. He cannot sign an I-864 or I-864a.
    Your current husband as the petitioner must file form I-864 even if he has no income.

    This post is for Sam&Jensi. This is not a message for Janulla.
    Why should Janulla and her husband be given a refund? The fee is to pay for processing the I-485. USCIS has paid employees and used resources all the way to biometrics on this case. Should all people who apply for the wrong thing have no consequences and be entitled to get their fee back? Should US taxpayers have to bear all the burden for their mistakes? Does it not cost the same to process a case regardless of the outcome?
    USCIS is not your lawyer. If you get the wrong advice from a person on the phone, then it's your problem. This is widely known on VJ.
    Where did USCIS make an error that would justify a refund?

    A lawyer cannot help you become legal. A good lawyer will make you pay for a consultation and tell you what I will. A crooked lawyer will take your money and tell you whatever you want to hear.
    You have already made a very big mistake by overstaying after your I-94 expired. Since you arrived in Nov. 2010, I am going to assume that your I-94 expired at the latest in May 2011. You have overstayed more than half a year in the US, you will be subject to a ban if you leave the US.
    Here are your two choices;
    1. Leave the US and incur either a 3 years ban (overstayed more than 180 days but less than a year) or a 10 years ban (overstayed more than a year). Once your Priority Date becomes current in the F2a category in year or so, you will be denied your immigration visa due to the ban. Your wife will need to file a waiver for your ban. The waiver is discretionary, so you may or may not get it. If you are not granted a waiver, then you will not get a visa until the ban is over. If you are granted a waiver, then you can immigrate to the US.
    2. Stay in the US illegally until your wife becomes a US citizen after 5 years as an LPR. You live illegally without the authorization to work. You will be deported if ICE picks you up.

    Note that your actions - coming to the US on a tourist visa to marry and stay illegally which makes it so much harder for Filipinos to get tourist visas to come visit their families in the US. What you have done is commit visa fraud. Every case of visa fraud in the Philippines makes it that much harder for everyone else.

    Generally, there is no refund policy. You would have to show that USCIS made an error in order to get a refund.
    Your best hope of keeping your money is to cancel the check before it clears. Better to pay the bank's $50 cancel check fee than be out $1100.

    Nobody here knows what exactly was said in those calls or if the Call Center employee was even given enough information to identify the LPR.
    Regardless their position will be that it isn't USCIS's responsibility to ensure you fill out the proper forms AND if you actually read the instructions for each form they clearly explain what the form is used for.
    This mistake was clearly made by the OP, USCIS has accepted the application and already "worked" it as evidenced by the fact that her husband had a bio-metrics appointment which he attended.
    Losing over $1,000 sucks and is a hard lesson to learn but at the end of the day this is neither the responsibility nor fault of anyone at USCIS.

    You can file for divorce in your state.
    You can't send him back. He has a green card, he can stay.
    Your father will continue to be on the hook for sponsorship until your husband becomes a citizen or otherwise meets the requirements to no longer need a sponsor. As long as your husband isn't using means-tested benefits your father shouldn't have to worry about owing money.
    Do not follow the advice to stay married for an extra year so your husband can become a citizen sooner. That would be fraud.

    She can work like any other LPR. A part time job is not a problem.
    Healthcare will be a problem. She will not qualify for Medicare until she pays into the system for 40 work quarters (at least 10 years). LPRs cannot qualify for Medicaid for the first 5 years as an LPR. Private insurance or insurance through work are her choices.

    The child is automatically a citizen upon entering the US with an immigration visa if the child is under age 18 and residing with a US citizen parent. The child needs a SSN. Form N-600 is a request for a certificate of citizenship which is merely evidence of the child's US citizenship.

    The F1 category is for US citizens to petition for an unmarried child over the age of 21. You have already been moved to the F1 category. If you legally changed your name after your annulment, you need to inform the NVC or USCIS to change that. Otherwise, there is nothing else you can do to speed up the process.
