Sponsoring My Son

Hi guys,

Just want to get some information from those who have sponsored a family member. As you can see from my time-line, my husband passed away from cancer five months after I became a permanent resident in 2009 - we were married for 2 years 5 months so I received a 10 year GC. We both had cancer, but I have been healed for seven years now; thank God. He was unable to petition for my son at the time that he petitioned for me due to financial difficulties - he was the sole breadwinner.

I am now remarried and my husband is currently unemployed. He is petitioning my son, who is now 15 years old, and I am the houselhold sponsor. My 2011 and 2010 income far exceed the poverty guideline; however, my 2009 and 2008 individual income were less than the poverty guideline - even though the household income far exceeded it. The questions I want answered are

(1) Which income should I state for 2008 and 2009? My individual income or the household income?

(2) Should I state my current income as my projected 2012 basic income or should it be based on what I earned last year?

Your husband must file form I-864 as the petitioner. He declare only his income.

You file form I-864a as the household member. You declare only your income.

The NVC and the US Embassy/Consulate will combine your husband's income and your income to create a household income. This household income must meet or exceed 125% of the poverty level.

Thanks for your response. I am aware of that. He has no income. The questions I want answered regard combined income for my late husband and myself.

Your late husband's income is not going to count. He cannot sign an I-864 or I-864a.

Your current husband as the petitioner must file form I-864 even if he has no income.

Thanks, Aaron. I am aware that my deceased husband cannot sponsor my son . My question was based on pass income information. In 2008, I had a couple hundred dollars as personal income (waaaay below the poverty guideline from self-employment); however, the combined income was way above it. I'm just realizing that I received more than the poverty guideline in 2009 as individual income from Pension and social security .

I will report only my income for those years as advised. Thank you.
