    USCIS never ever approves any visa. What they approve is the petition that allows the foreigner to begin the process of applying for a visa. It doesn't take the worker a lot of time. There is simply a backlog. So, the petition sits and waits its turn for several months before "worker" even sees it.

    Guys, you have it all wrong.
    The NVC web site says that either English or the language of the local country where the embassy is. There are a few exceptions to this, but DR is cool with Spanish.

    Open RBC Canada and RBC USA accounts and link the 2 online. Have your EI cheques direct deposited into your RBC canada account, transfer the money to your RBC USA account online and you are good to go. I think I pay a $4 monthly fee for each of my accounts, but there is not charge for transfers. If you have Weigels stores where you live, they have no fee ATM's so you can withdrawl money without it costing you anything (or do cash back when you are shopping).
    The only downside is if you don't live near a RBC USA branch it there could be some issues if you ever need a branch. I have been here for 2 years and have yet needed to go to a branch.

    Actually you only have to show strong intent to re-establish a US domicile--you don't have to be currently domiciled in the US...be sure hubby is well prepped on that issue.

    I stand corrected...by following all the links at the German embassy website, they DO want the DS-2001, and it looks like there is a similar form specific to them that they will request later. Here are their instructions:
    # Paying the visa processing fee.
    * The NVC which will provide detailed information on method of payment.
    # After the NVC has received confirmation of payment, they will then request that the required documentation be completed.
    * To be completed by the visa applicant:
    o DS-230 (pdf), Application for Immigrant Visa and Alien Registration (pdf)
    o DS-2001 (pdf), Applicant's Declaration of Qualification for Immigrant Visa Interview
    * To be completed by the American Citizen or Legal Permanent Resident petitioner:
    o I-864, Affidavit of Support
    A processing fee may be applicable for this form. If so, this form will not be sent until the processing fee payment is confirmed.
    # After the forms are completed, it is now time to mail all required documentation to the National Visa Center. This includes:
    * DS-230
    * DS-2001
    * All collected documentation listed under [step 4: Gather Required Documentation].

    Chill !! Not suggesting you are lying. It's time to take corrective action and stop fuming about how you were wronged and going to sue someone later. What a waste of good energy that can be used to solve the problem.
    Well, foreign income doesn't count anyway, so you could have made $1 million and it wouldn't matter unless the source of income continued after you were back in the States. I'm not 100% sure what you are saying about 2010--are you saying you filed for an automatic extension to file and if you did, then the DOS web site says you MUST supply the 2009 return which you did, but it didn't have any US income--see where I'm headed here?? And exactly what did you supply to show projected income for 2011--is that the employment letter and pay stubs??
    It's a little tricky, and while you should have been able to get through it, it was probably more than your wife could explain--maybe??

    Aha...as I thought some more, IRS 1722 isn't the norm--all it says is that you didn't file. The more normal approach would be IRS 4868 which is the automatic extension. You made a tricky situation worse by not taking the path that is specifically laid out in the directions. And don't blame NVC--they only take a cursory look at things--I think much of this falls into your lap by not following the guidelines 100%, and maybe by not understanding that your foreign income didn't count for anything.
    At best it is confusing even to those of us who deal with this all the time.

    Are you out of your mind !!! The circumstances under which you can sue the government for anything are very unique ...don't waste your energy on something so remote and focus on getting it fixed--you are in control of that, and there is no way to sue the government for your inconvenience.

    Dear employees of USCIS,
    I am writing to wish you a wonderful Labor Day on Monday. I want you all to relax, kick back and enjoy your extra day off work. I know you work hard for our government. I know you put in long hours. I know you must feel your position is a thankless job. But, I want you to know that I appreciate all your hard work and dedication. I want to personally thank each and every one of you for all that you do in USCIS.
    I pray that you get plenty of rest on Monday. I hope you get to enjoy time with your family and especially your spouses. And I hope when you get back to work on Tuesday that you have the most productive day on record. I know Sept 30th is the end of your fiscal year. I know the bosses are breathing down your neck to close as many cases as possible. Just take a deep breath and get down to business and kick out more approvals then you ever have done in a day. Know that I will be waiting patiently, right here, checking the website, calling 800-375-5283 incessently because I appreciate all that you do and I believe in your abilities and I know you are great efficient employees.

    If you think that USCIS wouldn't find out then you need to do a lot more research than you have yet done into US immigration processes.
    Just to clear up some issues:
    You apply to sponsor a fiancee to the US. USCIS investigates to make sure you are qualified to sponsor a fiancee. If you are, your petition is approved. The process then moves overseas to your fiancee' home country. The Department of State which oversees consulates now investigate whether she is eligible to receive a K-1 visa. She provides them with detailed information about who she is, where she lives and works, and her marital status. They will investigate with a fine tooth comb all aspects of her situation, her background, and your relationship looking for evidence of fraud. They ensure that you have followed proper cultural procedures/rituals and have the evidence to prove it. They run security and criminal checks. Some countries also require additional processing which can include 'home visits' and contacting family members to ask them about the relationship. You will both state in writing that you are free to marry and intend to marry when she arrives in the US and sign these documents. If you lie about this, then the lie will be discovered - and it will be discovered - sooner or later. If sooner, then she will be denied the visa. If later then several things may happen.
    For instance, if she gets a K-1 visa, then you marry before she arrives in the US, she is no longer eligible to enter the US on the fiance visa as she is no longer a fiance. If she tries to use the K-1 visa and lies at the POE that she is not married, she has then committed misrepresentation - one of the biggest 'crimes' as far as USCIS is concerned. Her arrival to the US is only valid for 90 days. She needs to request permission to remain in the US by applying to change her status from non-immigrant fiancee to permanent resident. Part of this application includes the marriage certificate - the date of which needs to be after her entry to the US - and further proof of the relationship. Once again your relationship is put under a fine tooth comb and may involve another interview. If she was married before she entered, it is likely to be discovered. She will be guilty of several counts of misrepresentation which will lead to detainment by USCIS, deportation and a life time ban on ever being allowed to enter the US.
    If the fraud is not discovered at the AOS stage, then 2 years later your relationship is once again put under the microscope when she applies to remove the conditions of her two year card - oh yes, she is only allowed to be in the US for 2 years before she has to prove the validity of your marriage once again. There are more security checks and the possibility of another interview.
    Even if it is not discovered now, there is no statute of limitation on immigration fraud. Anytime in her whole life it can be discovered that she did not get married in the US but was married before she came and used a K-1 visa knowingly and fraudulently - leading to detention, deportation and a life time ban.
    Seriously, if you love this woman you will NOT subject her to any sort of illegal immigration activity. The news media are filled with tragic stories of families being torn apart because one member has committed some sort of illegal immigration activity and has been banned from the US. There is a fairly recent story of a US citizen who did exactly what you are proposing with his Japanese wife. It was discovered 2 years later after they already had a family. They have spent the last few years apart fighting to try and find some sort of loophole to allow his wife to re-enter the US. Their claim that their family wanted to see her married before she left Japan held no water with USCIS. She was guilty of immigration fraud and is now banned for life while she and her family are suffering the consequences of her misrepresentation.
    If you do not have the time and the money to do it properly, then you need to re-think your situation. It will be a lot more time-consuming, expensive and heart-rending to be commit immigration fraud because you don't see how USCIS would ever know. It is USCIS's business to know. Uncovering immigration fraud is their bread and butter.
    On another issue, it is also a violation of the Terms of Service for Visa Journey to commit or to condone any sort of illegal immigration activity. I have left your post rather than removing it as I feel you need to be advised about the degree of danger your suggested course of action holds for someone you are supposed to love. Don't be so selfish. If she cannot leave her home unmarried, then you need to get married and file for the correct visa for her to come to the US. That is your only real course of action.

    Its so easy and quick to do and makes a HUGE difference in the data out there and all of the calculations. Its so frustrating to see people not using their timelines.
    Not to mention how much more difficult it is to get assistance when asking a question as the "experts" on VJ have to ask questions about your situation instead of getting a quick summary of where you are in the process! Its a courtesy to those helping you!
