VISA PENDING ORIGINAL DIVORCE DECREE

Usually when they request additional evidence, they give you 1 year to respond to the request before the case is considered abandoned -

So here is my advice that I give everyone regarding the NVC and K-1 visas. Once NVC sends your case to the embassy, they will send the K1-FTP letter by email to the email addresses they have on file from the I-129F petition. This will contain your case number. Sometimes, the email addresses get messed up on conversion from the I-129F to the NVC Case. This is what I would do if I was you... 1. In about 2 weeks, if you have not heard from the NVC, use the public inquiry form at the link below to request your case number. In the text of your inquiry, notify them that your I-129F was approved and sent to NVC and that you would like to get your case number so that you can start to prepare for your embassy process. Then add in the text of that inquiry that you would like to update both the petitioner and beneficiary's email addresses and and then list your email addresses. Make sure you attach a scan of your I-129F NOA2 to the inquiry. Now most likely this first request will get a reply that "they have received your case from USCIS but have not entered it into their system yet, but they have updated your email addresses as requested". That's OK! The real purpose of this first inquiry is to have them make sure that they have your correct email addresses. 2. Then you can follow up with them every 10-14 days after that to see if they have a case number assigned to you yet. Word of warning - Most embassies will not let you schedule your interview until the case shows "Ready" in CEAC. And you do not want to schedule your medical farther out than a week or two before your interview because the validity date for the visa, once issued, is 6 months from the date of the medical, not from the date of the visa issuance. P.S. - This is what Jaycel and I did and as a result we were well prepared for the embassy phase. -

That form, G-1145, E-Notification of Application/Petition Acceptance, does only what the title of it says. It E-Notifies you of the Application Acceptance. You will not receive any other E-Notifications regarding your case after the one you get saying your petition was accepted. How long has it been since the case was sent to NVC? -
To me this RFE is stating that you need evidence of the Joint Sponsor's status, and the part about the petitioning sponsor says that they couldn't determine that they meet the 125% of the poverty level, which is why you got a joint sponsor I'm assuming. I believe that once you send in the evidence of the Joint Sponsor's Status, it will make the point about the Petitioning Sponsor moot since the Joint Sponsor will then be fully qualified. (Assuming that their income is sufficiently above the 125% of Poverty Guidelines for the properly assessed household size).

I wish I could like this post 100 times.... Get the copies of everything they sent on your behalf, remove them from the case as @OldUser recommended and find a reputable lawyer that does nothing other than Immigration Law and specifically family based immigration law. The fact that your lawyer doesn't know that USCIS issues the 48 month extension letter for EVERY I-751 filer and then tries to make up some garbage about children born to the marriage and name changes, rather than do a 30 second Google search, is frankly one of the most blatant signs of legal incompetence I've seen since starting my research for the immigration process 2 years ago. When you find a new, reputable lawyer, have them check over all the submission copies you get from the old one to be sure they didn't screw it up -

Oy vey.... I'm glad you got it rescheduled though!! 🎉🎉 -
And Filipina FB Groups & Tik-Tok regarding family immigration from the Philippines and the Medical, interview & CFO processes are the absolute worst. Jaycel was so stressed out befor her trip to Manila for her Medical/Interview/CFO that she was an emotional basket-case. Afterwards she said that she wished she had never read / watched any of those FB Forums and Tik-Tok videos. She said the whole process was way easier and less stressful than she was made to believe.

There will be no harm in uploading the docs to CEAC. She should still bring the certified official copies (often referred to incorrectly as originals) of any civil documents with her to the biometrics appointment at the VAC and then also to the actual interview appointment at the embassy. When Jaycel was waiting for her interview there in Manila, she naturally made friends with some of the other women there with her. One of them had an updated I-864 from her husband with a job change and a new Tax Return Transcript since they were DQ'd and the CO told her to go out and have them scanned and uploaded to CEAC and come back. Around the embassy in Manila there are several "Vendors" who will, for 1000 PHP, scan your documents and email them to you so you can upload them. They obviously know you are under pressure and will pay almost anything to get it done. Since they only do interviews in the morning there I think she had until they were done with interviews that day to go out, scan them and come back. If she didn't want to do that or couldn't do that, the other option was to get issued a 221g and submit them via that process.

You should be able to use any combinations of the names that appear on the marriage certificate - For example Jaycel took her maiden surname as her new, married middle name and took my surname as her new, married surname So this section has changed since we filled out Jaycel's I-485. In reading that section's instructions on the form, my instinct says start with the "Unemployed" period since coming to the US and work backward from there. As for listing financial support for the time as a student, I would not think you would have to list it as you were a full-time student not "Unemployed" despite the fact that you may not have been working. (That's my best advice based on reading the instructions on the form for that section )

January 2025 AOS Filers
Edward and Jaycel replied to Yareth's topic in Adjustment of Status Case Filing and Progress Reports
Ours took exactly one week to go from approval to card produced. The SS Card showed up one week after the approval (The same day the status changed to "Card Produced"). The card arrived 3 days after "Card Produced" and we saw the tracking number on Informed Delivery the day after it went to "Card Produced". -
I have urged my co-workers who complain about it to do just that.... but you know human nature - Much easier to complain to others than actually do something about it. 😐
