  1. If she comes here with that intent, she will have to declare it to CBP at her PoE inspection and she will be denied entry. If she does not declare it, and just says something like "Tourism" and then files to adjust status, that is misrepresentation, which can cause her to be denied and get a ban on re-entry to the US. You do not want to go down that route. Besides, CBP would likely have knowledge of her approved I-130 that is pending consular processing and deny her entry anyway. My recommendation is to get this line of thought out of your mind and wait for the process at the embassy. Sometimes it can take up to a year or more for the interview to be scheduled. It all depends on the backlog at the embassy

In the additional comments section, you can do something like "From 8/15/2020 - 5/15/2024, while attending XXX College, I lived on campus at the following address(es): Address 1, Address 2, Address 3 etc., except during stays at my parents house in-between semesters and on breaks at their address at: 123 Maple Street....." I had several addresses the previous 5 years prior to my filing as I lived 4 different places just during the time I spent living in the Philippines and they would not all fit even in the additional information section, so in one of the spots on that page I referenced the appropriate Page #, Part # and Item # and wrote, "Please see attached sheet for address history." I then typed up a page referencing the Page, Part and Item numbers and explained my address history. No issues whatsoever with that and the I-129F was approved.
  4. If you are qualified with income, leave the assets section blank and do not include bank account information. Tax transcript, W-2 and copies of pay statements for the previous 3 months should suffice.
  5. You will have to make an appointment at your local SSA office and do it in person. It appears that they have ended the EBE program for I-765 & N-400 filers that automatically triggered SSA to send you a card, so unfortunately you will have to do it in person.
  6. There is very little folks can do to answer your questions without knowing more about the case. I see you posted this in a K-1 forum. Is that the visa type? What embassy? Is this from the CEAC case status checker? If so, you must have a case number from the DoS I would assume? If so, your case is not on the way to the NVC, it's been there and already shipped to the embassy.

  12. So you don't know what the disposition of the removal proceedings are? Like @OldUser said above, there are no guarantees. I would consult with an attorney or at the very least do a FOIA request to see if you can find out what they did with her case before you do any international travel. That's my best advice based of the information provided. From what I know there are situations that won't necessarily cause you to be denied for Adjusting Status but they ARE cause for inadmissibility to the US. That's why I said you may want to consult an attorney, they would know all of those peculiarities of the immigration law.
  13. I don't know for sure what the photo shop did, maybe they took it in a resolution that didn't require as much or any compression? All I can tell you for sure is that once they took the new photo with the size requirements we gave them, we were able to upload it successfully
  14. I think the culprit may be the error where is says you may have compression artifacts. Jaycel and I ran into a similar issue with her DS-160 and she had to go back to the photo shop and have them re-take it and ask them that the image be no larger than 240kb. They were able to accommodate the request and we were then able to upload the photo
  15. Did you open the plastic surrounding the yellow envelope to retrieve your passport or did you breach the actual yellow envelope?

  17. The unpaid credit cards will have zero effect - The removal case... what was the disposition of that case? Was it disclosed to the embassy on her DS-260 application? How did they handle it? (i.e., was she questioned about it, etc.?)

The problem here is once she gets the K-1 visa and then enters the US, she cannot leave the US until the Adjustment of Status is filed, adjudicated and green card issued which can take a year or more after filing. (Yes I am aware there is an option to apply for advanced parole but the adjudication times on that tend to be pretty long and that is intended for emergency travel - I would not travel frivolously on a AP. There is no guarantee that she will be allowed to re-enter the US using it). We are approaching 9 months since Jaycel entered on her K-1 visa and her AOS case is still pending. If the applicant leaves the US while the AOS is pending (with no advanced parole), the case is considered abandoned.

  20. If you submit the tax return transcript, the I-864 instructions specifically state to NOT include the W-2 unless the sponsor is "Married Filing Jointly" and wishes to have their eligibility based only on their income
  21. Here's a fairly recent thread on K-1s and Bogota - It sounds like they send you a "Packet 3"
  22. Correct, there will be no uploading of docs to CEAC for K-1 visas. Unfortunately I do not know the K-1 process in Bogota so I don't know if they make you wait for them to contact you before scheduling the interview. Once you fill out the DS-160 and submit it, that is valid for 1 year. You will also have to do a medical exam, but I would not schedule it too far before the interview because the expiration date of your Visa will be 6 months from the date of the medical exam. I'm trying to find some recent K-1 posts from Bogota for you to look at here on VJ.
  23. Invoice number is issued to Immigrant Visa applicants only. K-1 is technically a Nonimmigrant Visa so you will not receive one. You will get no more communications from NVC. The next should come from the embassy
  24. Did this email have an attachment of a letter with the case number that said K1-FTP on the top? If so, this is the only "Welcome Letter" you will get from the NVC in the K-1 process
  25. The "Ready" status means it is ready at the embassy in Bogota - I would imagine you will receive something from them soon regarding next steps. I do not personally know how Bogota handles K-1s. Maybe someone with recent experience from there can comment. Usually the embassy will send instructions via email. If they do not have the beneficiary's email address, it will go to the email for the petitioner that was entered into the I-129F unless the emails were updated by one of you with the NVC.
