I always thought there may not be a valid provision to apply. However, what's the alternative? One child can never be moved to Northern climate, and children have no one besides me.
Let's not discuss "employment" - there is no legit employment offer to me as a Canadian. I do expect to be able to find some employment, once I have EmpAuthorization and SSN. And of course my DL will be instantly renewed, if I bring DMV any paper showing how long I'm authorized to stay

You cannot claim USC thru the children, You can only can only gain legal status thru marrige to a USC. Sorry about life's event, but there is no way to gain legal status through them.
There are children living safetly in Canda that have the same conditions as your 2 young children, proven that the conditions in Canada to be too humaine for the children would be a hard case.

My husband was brought to the United States from Mexico when he was 2 years old. When he was 19 he got into a fight and ended up being charged
with assault with a deadly weapon other then a firearm and burglary. He served a year in county jail and was deported to Mexico in August 2008. We got married before he was deported and I filed an I-130. In July 2008 we got the approval notice. After that nothing was done since the whole deportation happened. I have spoken to a few attorneys and we have to file waivers for the 2 felonies on his record. We have a 3 year old daughter and we are all living in Mexico to keep our family together. I'm wondering if continuing the process is even worth the money or if he will just be rejected. Does anyone have any experience with this or any advice for us? Thank you.

So start with the basic, clean hygeine, dress neat, speak well, speak softly, and listern and observe. Start with one friend, this should lead to others. Meet in bars, gymn, park, rec sport, clubs, library, bus stop, resturant, starbuck, or any other coffee shop.
Do volunteer work.

They would say YEAH for sure!
I ask them a number, and text them later but they never respond me.

I would say I am advanced user. But I don't know much about programming like PHP or Web design.
But if your PC broke I can fix for sure.
Sometimes I look videos on youtube and try to do something myself like repair stuff etc.
I can do any work in the world just show me once, and I'll repeat it.
Religious - hm I am against all those organization where you have to be a member for a 10% of your income.
This no friend issue is a problem, good friends would tell yo where job openings are.
Is this a personality problem issue, do you interview well?
Skills, work well with hands , follow directions well, work independently, learn easy, computer skills,
Do you speak to people in public w/o them speaking to you first. A simple HELLO, do you walk arounf with a smile or are you just mad at the world.

I am not looking for a cook position. I am looking for any position cook, waiter, bartender, general labor.
To be a chef you have to go in culinary school for 2 years and after graduation its very less chances that you will become one.
I worked with famous chefs in LA they all work 10-12 hours a day and making 50K a year, exactly the same what cooks make,
the only thing the don't cook much, they like supervisors.
If you want to be at school for 2 years better be a nurse.
School its not option for me now unfortunately...
I can do any job, I am very fast learner. But its all abut connections, which I don't have.
People don't pay attention at my personality, even I try to be nice, they seem like don't care.

Do you have a hobby or anything that you do well, but doesn't it a skill? Do you have any leadership skills, can you do anything else on the computer except internet search and Facebook?

C's wife may have had someother skill that assisted her with the micro job. What skills are you bringing to the table, I have listed 2 for you.

Education- higher education
So why do you continue to look for a cooks's job, is cooking a passion? If so then you should be looking for opportunities to lead to being a "chef".
BTW can you cook, what is your speciality?

I am not gonna talk about skills. I am gonna talk about jobs which possible to get without experience.
1) I was a cook 14$ an hour + health benefits
2) Servers were making around 50K - 60K a year
3) Bartenders around 100 K
4) Movers make good money on tips
5) Truck drivers
6) Casino employees
etc, etc, etc
I have high school diploma from my country
Bachelor Law degree which unfortunately I can't use here,
and in my home country as well if you don't have connections
And you know what most interesting?
I finished university with good grades, but I don't know a ####)))
Minimum wage in my country I would say 300$ a month but rent cost around 80$ for 2 bedroom.
I am not comparing minimum wages. I am OK with 8$ if rent gonna be lower.
In California 8$ its impossible and like I already said VERY hard to get even those jobs.
You have a Bachelor Law degree, in what field of intrest? So you were working at a 5 star resturant, those numbers you quote above doesn't agree with a cook making 14.00 per hour. Was your only skill a cook?
You have shown good writting skilss and communication skills. So your speaking skills should be good aswell.

They want you to lift up heavy boxes all day for 8$ an hour.
Its should be at least 16$.
And some of "good" employers willing to pay you only cash as independent contractor,
to avoid paying taxes. That's so wrong! Because they set-up schedule and they pay by hours.
But even those jobs are hard to find like they said before 80 applicants for 1 position.
I been here for 3 years and things not getting better.Less and less jobs everyday.
Limited skills? What kind of skills you need to serve tables, or move furniture?
People do everything here just to survive, and employers taking advantage of those people

Then what do you want to do about what is in the quote, not once had I heard you talk about going back to school to get a higher education. Do you have what is equal to a high school diploma?

A student visa to a school in the US is not a right to residence, the US government is looking to the parents of these students to support them thru their years of education on a student visa.
These are the cases that hurt those who comes behind them who wish to be granted the same opportunity to student in the US, but they are denied.
What accredited University/College shuts down without notice?

Nothing is stoping him frm going home, so why is USCIS just ridiculous? Poor and out of money, usually means it's time to go home. Who was paying for his education, he was on a student visa correct, couldn't thse same people assist with the fee for a lawyer.
Also he had to be out of status for a while inorder to land on I.C.E pick-up list, so how was he surviving while he was out of status.

1. when you'll get your interview date, you can try to request an earlier date, but since you are the one pregnant(USC) they probably won't honor your request.
2. Interview dates are usually 2 months after approval at NVC.
3. babies comes when they are ready, saying that if he has an mid sept date for Interview, he could be in the states by the end of Sept.

Ugh, it is rare if anyone from Jamaica get put in AP. If they are put in AP, it's usually for a couple f weeks.

So, her finger prints weren't done in India, they were doing a re-take. If she is back in India, have her to try to go back to the Consular to see if they would re-take the prints from there.

It's $1,100.00 more than you have today. With your limit skill set, being choosen shouldn't be your 1st option. What doesn't kill you may end helping you.

You are adjusting status, what income does your wife have to show from 01/01/2012 to now? They don't care about what income she made 3 years ago, The government is concern about how you will be supported today/tommorrow.

Hello all! My fiancé and I hoping to get some advice and help with our K-1 visa!
First a quick run down of our situation:
I'm the US Citizen and he's the UK Citizen
My fiancé and I met in November 2006 shortly after we started dating online. Seven months later he flew out to america so we could meet, he stayed for 3 months then went back to England, 20 days later he flew back out for another 3 months then again returned back to England. Ten months later he was able to fly back out again and stayed for 3 months. Upon his arrival customs held him for 2 hours and told him he can stay for the 3 months but would not be able to come back to america without a visa, and if he tried it again he would be de-ported. So we looked into visas, and at the time the student visa seemed like the best option, our local collage had a program and we got everything all okayed by the school. He even booked another flight to go home a week early so he would be able to make it back in time for beginning of the school year.
His visa was denied because the interviewer said her friends wouldn't give her that kind of money and she didn't think it was creditable. Due to financial reasons and the visa being denied we weren't able to see each other for 3 years but talked every day and was able to keep our relationship going. This January we were finally able to see each other again and on March 1st I flew out to England! I arrived and we decided to apply for the K-1 visa so we got engaged and we submitted I-129F, on March 29th they received it and sent us our NOA1. We decided to change my flight so I could stay the full 6 months (I was already planning to stay 3) and hopefully I'd still be here for the interview. Looking back that might have been a misjudgement? I'm still not entirely sure. I'm leaving for America on August 27th.My family said they would support him and provided a bank statement along with all of the other necessary paperwork.Our only concern for not getting our visa the income. He has his own business developing apps and makes more money than the government poverty line but he only started making that much at the very beginning of this year (hence being able to see each other again since January it just took time to get my passport and everything all planned out), meaning he doesn't have tax returns for the past 3 years showing enough income, just this year, are we doomed? :|
We really don't want to be apart again as you could imagine, lol 3 yrs apart is long enough! Is there any likely hood that we could get to the interview before I have to fly back?
And if not is there any way I could come back if the interview happens after I have to go so I can be here for the interview? ie if the interview happens in October could I fly out again for the interview?
I'm also slightly confused by the process of it all, We sent off our I-129F and received our NOA1 and to my understanding the next step will be getting our NOA2 and then he'll have to have a medical and gather all the documents and proof we have for the interview? Is this correct or am I missing something?
Also I've read a lot of interview questions and some slightly confuse me, one person was asked when their wedding date was, how are you supposed to plann everything before you even know if your going to get your visa?

What happen to your family that was going to sponsor him for the student visa, can't they sponsor for the K-1?

I am in the process of sending out my documents. When I realized that my marriage certificate has all my middle names and I only carry one on all my documents (ssn, passport, etc). Should I include my other names on the I-130 that reflects on my marriage certificate?
Another thing is my step mother filed for me decades ago to migrate to the US, my mothers name was in the SSA system as my mother but somewhere along the line it changed to my step mothers name, but I am putting my birth mother on all the documents to send in. Will this pose a problem?
These two things stopped me in my tracks this morning from mailing my package out. HELPPP!!!!1

2. Use your Birth mothers name as your mother.

Hello Fellows,
As a US Citizen, I applied for my wife ( who's in Algeria ) to join me here in the US through the I-130.
Finally, the I-130 was approved on July 2th..and I'm waiting for a response from the NVC...
What I'm concerned about is not really this......I'm extreamly concerned because my wife is pregnant with our son, she is due sometime by the end of August / early September.
When the I-130 was filed there was no mentioning of our unborn child....
My question is, assuming that if my son will be born before the interview date, will he be included in the process automatically ( of course showing the supporting documents that he is our child ) or another process is required....
I really really really hope that the interview date will come quickly so that my son will be born in the US.
Looking forward for your comments and advice...
