  1. send in AOS as soon as possible. if the I-94 is expired, they are technically unlawfully present and subject to removal, until you have proof of a pending I-485. Send in what you have for the DS-3025 you may get an RFE for a new medical, but thats better than anything else
  2. ours never updated with a tracking number but it did show up in informed delivery under the packages section! lol
  3. NOA1 means they are processing it, they would have rejected it outright if it was a major issue. unless they find something egregiously wrong with it, you could just get an RFE
  4. if the I-129f is signed in the correct spot, it could just be an RFE. But if it does get rejected, everything gets sent back to you (including any checks you made) and nothing gets paid for. if that happens you fix the mistake and you can send back the same exact packet (including evidence)
  5. a bit of both imo i couldn't find the article but at one point the new pick to lead USCIS said interviews would be back to becoming standard for everyone, but i can't find anything confirming that but also just a word of mouth situation of people hearing directly from officers at their interviews that all AOS applicants will have a mandatory interview. from my understanding the waiving of interviews only became big during the Biden Administration and during COVID before that all family based AOS applicants were interviewed. being interviewed is supposed to be the norm lol
  6. it does this automatically, ours says the same thing don't expect it to be waived. with current administration everyone is getting an interview
  7. this could be something that can be updated at the time of your fiances interview. as far as writing a letter, that agent was more than likely referring to the service center that received your packet, which i believe for all I-129fs now is the california service center. it would have your case number, your name, fiances name. and probably attn: I-129f. something along those lines But i think easiest thing would be for your fiance to update the information at their interview.
  8. if you are doing tax return transcripts (which is preferred), the W2 is irrelevant and you should not include it. if he is out of status you need to file asap. start the process to obtain his BC now. submit what you have (passport, K1 Visa) and wait and see if you get an RFE for the birth certificate. it happens at least you would have started the process to get it.
  9. its recommended to have a copy of the packet and evidence to bring with to the interview in case the officer asks for it. they don't always do, as they have a copy of the approved packet themselves. the beneficiary should be able to just print all of it in their home country and its not an issue

  12. i don't believe there is a "need" no, but they are only visible really if you aren't wearing anything on your head, which is a requirement the only time they would be covered would be because of the need to wear religious head wear

  16. make sure to thoroughly read the RFE. but it would say something like "sign/initial and date next to each box you fill out". but if it only says to sign and date, you should be fine to do that in the bottom corner of the page page 12 is just the additional information page, so signing in the bottom corner is where it should go.
  17. my now-husband came over on his K1 in november 2024 at DTW. it was very easy, took all of 5 minutes. no secondary inspection. the only hang up was the officer didn't know exactly what to do and had to get a superior. but that was it. the only thing you give them is the sealed envelope. the x-ray CD is yours to keep, so just keep that with you. and obviously you show them your passport lol

  20. he probably can use that address, but you have to think about where you would live once you arrive on the visa. would you be staying with his sister? personally, i think it would be best for the petition as well as for your potential future if he had somewhere for himself. there definitely doesn't need to be an official "engagement" if you are both free to marry and want to marry each other, that is enough no ring or engagement pictures required we got engagement pictures taken after my now-husband arrived on his k1 visa, 10 days before we actually got married so LOL
  21. it doesn't mean have you been together for at least 2 years it just means have you met in person within the last 2 years of the date you filed the petition so if you filed the petition on april 26 2025, you would have had to have met in person at least once sometime between april 27th 2023 and april 26th 2025. if you have, than you answer yes
  22. Husband got is physical EAD in the mail today He's very much looking forward to finally being able to work again lol
  23. the I-765 has to be filed with a certain category. the category for "pending I-485" gives the applicant the legal ability to work while that I-485 is pending.
