I just wanted to know from those that have sent back the RFE Info if you were able to send it Via UPS or Fedex becuase PO Boxes dont accept signature packages?

Ok, so I spoke with 2 lawyers this morning (just to be double sure) as i started to get concerned becuase so many people on here were telling me I couldn't use my husbands assets for the I864 RFE!
WRONG! I am quite able to and after looking at my paperwork they both said it would more than satisfy the USCIS. (Assets in the 300, 000's should do it)
So let's all stay positive and keep the negative thoughts away and off I go with the rest of the journey.
And I really feel for all of you that have received RFE's, you are in my thoughts.

Assets may supplement income if the consular or immigration officer is convinced that the monetary value of the asset couldreasonably be made available to support the sponsoredimmigrant and converted to cash within one year withoutundue harm to the sponsor or his or her family members.
With Owning 8 houses this could be done easily

I got an RFE for Evidence of Assets. I am in the process of getting it together to send back

Hi All.
First, I am asking for other peoples experience with using Assets (IE: Houses) with the I 864 (and this would be a main form of the USC's Support of Affidavit).
I have read and re read the directions, I consulted with an attorney and I am not trying to be rude here but I don't need links for me to "read the guides" and or "counseling" on this matter.
I just would like to hear some other's experience in this specific case? Which is using assets for the I 864?

OH, here is the clause I was looking for in regards to liquidating assets within a year.

Thats why you got an RFE right? Cause you are proving your income? I thought so!!!
I was not saying you were incorrect. I was just stating that my case is different and that I am able to give them the proof of assets rather than a paycheck, which is exactly what the RFE states " Submit additional evidence of assets that meet federal poverty line"
Everyone's story is different, and again thanks for your reply earlier.
My case is just different thant someone who would get regular paychecks and W2's.
No need to be aggressive, we are all just sharing our stories and experiences here.
My patience has paid off - I got a CRIS email that the EAD card production was ordered yesterday. This is only half the way though - I'll believe it when I have the card in my hands. After that, my next step is learning to drive and getting my first driver's license. And looking for a job in the meantime.To all April filers and everyone else still waiting - hang in there. Wishing everyone a smooth process and best of luck!

What If I Cannot Meetthe Income Requirements?
Income from the intending immigrant, if that income willcontinue from the same source after immigration, and if theintending immigrant is currently living in your residence. Ifthe intending immigrant is your spouse, his or her incomecan be counted regardless of current residence, but it mustcontinue from the same source after he or she becomes alawful permanent resident.
Income from any relatives or dependents living in yourhousehold or dependents listed on your most recent Federaltax return who signed a Form I-864A;
A joint sponsor whose income and/or assets equal at least125 percent of the Poverty Guidelines. See question belowfor more information on joint sponsors.

You can send them as much assets as you like but UCSIS wants to see money coming in the bank via employment stubs. If your husband manages 30 houses, doesnt he receive a paycheck?? Title of cars are nothing to the USCIS unless you plan to sell them to show you have money in the bank, and even that said, its only secondary assets. They are really interested in money coming into the bank through employment regardless if you own 30 houses and have tenants living in them.
Hi, thank for the response, however if you read the I 864 guideline as directed on the USCIS website it does state that one can use "assests" that can be liquidated within one years time to meet the poverty guidelines. And the RFE did say that it needed additional information for these assests or a sponser. NOT BOTH!! I fully understand that i cannot use the vehicles as assests, but I am sending it anyway.
BTW, No he does not get a paycheck! I won't give lessons on how managing that many properties and keeping them in excellent living condition and paying mortgages and occasionally not receiving rents can effect this.
I am not sure if you realize this but at times when you own your company (I have owned my own company so know this 1st hand you are the last one to get paid.

I finally received the actual letter for the RFE and yes it was exactly what I thought. They didnt even look at the assets that I had sent with the I 864 and just told us that his tax income was too low. Lazy a$$$$eS
In any case, I am sending them a HUGE PILE of the operating agreement, mortgages statements, leases of current tenants, settlement statements for the over 30 houses my dear Husband owns and manages himself as well as the titles of the 2 vehicles he owns and the house he owns that we live in..
That should satisfy them don't you think?

I just received an RFE as well by email, i am waiting on the actual paper. From what I understand yes it does put the I485 and everything with it on hold.

I hear you, and I agree with you, I hope he can capitalize on the rough R E MARKET, but if hes a builder I feel for you !!
Thank goodness not a builder. An investor and thankfully the rental market is coming back strong so he is able to rent all of his properties out (not much revenue however), but at least sorta breaking even.
It will come back , this Real Estate market and when it does we are moving to Hawaii.

No, never marry for money. I dated a rich guy who was the probably the worst, selfish, self absorbed, arrogant bastardo...who cheated on me and treated me like his Personal Assistant and cook and washwoman.
Now, my husby is worth mucho dinero. HOWEVER its all in real estate so right now we are counting pennies, but I love him for him and not his worth. And when I do get my EAD, I will be brining home a few slabs of bacon.

As for me, I'm on day 90th since I sent my application and 83rd since my NOAs and still no sign of EAD approval.
Hey there. Hang in, we filed the same day and I got an RFE (still waiting on the snail mail to find out why) They have to be processing you, watch something come this week.

Once it's past the 90 days make sure that when you go to your Infopass you do a "service request" apparently this is when they actually send a "service request" to the NBC about your case.

That seems quite risky to me, I got to 3 days before the 90 day mark for the AP and got an RFE.
You never know, its better to be safe than sorry. If you are not in the country and something like that happens it would be quite an ordeal I would think...
Maybe give it an extra month if possible?

Hi! If you dont mind me asking what type of assets? Is the bank account the only asset?
I just went through this exact same thing, an RFE becuase Justin didnt make the poverty line (he owns his own real estate business). I did call 2 lawyers for consultations and this is what I was told:
Basically what I was told that they need proof of Assets that would be able to be liquidated within one year without harm to the "family". Unfortunatly the lawyer told me that bank accounts are probably the weakest asset, as it could all be gone in a minute.
Please let me know if i can help at all! I know how hard it can be.
