  1. Hi everyone.

I got married in february but I don't know if it's gonna work out. I miss my homecountry too much and I think I want to go back. The application is on hold right now cause I have't sent in the initial evidence yet. Is there any way of cancelling the application without having my case look bad in case I would like to come back in the future?

    Thank you guys.

I'm going to respond with tough love: You're being very selfish. Home sickness is normal and it's part of growing up in life. Think about your spouse's feelings. You can probably get your AP in 12 weeks after you send in the papers.

  2. Guys my I-485 was touched today.... hmmmm... I know it doesn't mean anything.. . but sometimes you want miracles in your life  so let's hope it means fast approval as it is 1 month in CSC already... I know many of you have AOS transfered to CSC long time so let's hope there are still miracles on the earth... Good luck to everone  Rhosi I saw your case was touched so many times this week... I wish you to be approved next week as minimum :star:

Hey Elmira my I-485 was touched today too!!!! I'm thrilled.

  3. IMO, you will need these NOA's, as they are your evidence that you are maintaining legal status in the US, i.e. you are "pending Adjustment of Status". Without them, your legal status expires when your I-94 expires, which means that beyond the I-94 date, you're out of status (i.e. illegal) and you need the NOA's to show you're in status.

Unless you are a K-1 then you stay in limbo (after the 90 days) till you file AOS. I know that doesn't apply to these people, I just don't want a K-1 to get confused.

  4. Thank you for your quick reply!

    1) I did created an account with USCIS and put the receipt number for I-130 and 485. But the last updated date is 03/19/08 when I did my biometrics. That means they never touched my case after that???

    2 AOS questions:

    1) how do you know your case is touched?

    2) how long will they notice you before the interview?

    thanks!

Answer #1 you have to open an portfolio account with USCIS and add your I-797 numbers. You will see the last activity date change when you and visit your account.

    Answer #2 I think about 6 - 8 weeks +/-

From what people told me, that doesn't mean that they are not working on it. I've seen surprise approvals on here. Hang in there my last touch on my AOS was 4/7/08.

  6. And your point is....what?

You know something, Go straight to hell. I'm so sick of you select few sarcastic idiots that roam this website. I'm trying to help people with whatever knowledge I have in a polite and respectful way. Give it a rest!!!!!!!!!!!!!!!!!!!!!!

It's a fair question. How about answering it?

Great another one... Immigration can deport you if you are not a US citizen. Obviously you have to do something bad after you become a permanent resident to get deported, but they still have the power. Now what was so hard about understanding that? Stop making something out of my statement that it's not. Whatever you may think that is. Is that a fair answer?

  7. Last week during my wife's biometrics appointment, one of the agents who happened to be Spanish practically scolded my wife for inappropriately adopting my last name. So for the sake of discussion, let's say her full name is (just making this up):

    Julia Maria Sanchez Cruz

... and that my name is ...

    John Andreas

So upon marriage, she took on the name Julia Maria Andreas. That is the name we've used on her ITIN, AOS, and everything else.

But the biometrics lady insisted that it should be ...

    Julia Maria de Andreas

... and practically forced my wife to change her name. I am concerned that even this minor change will cause some hiccups or delays in the process. My friends had just gone through the exact same process we have and they said they were allowed to change the name during the GC interview (there was a mistake in the paperwork).

Any advice or observations greatly appreciated.

Whenever my wife (who is Spanish) is in need of any service that will be provided by another spanish woman she gets nothing but a hassle. (Cashier, Wait Staff, etc.) There is a bitterness and jealousy that runs so deep when they see a spanish girl with an american guy. They deliberately try to hassle you. Anyone else have these experiences? I unfortunately can't answer your question regarding the name change. I just had to vent out here a bit.

  8. It's preferable to file before the I94 expires. Out of status time accrues during the lapse between that and filing.

You're never out of status as long as you are married within the 90 days. At least that's what immigration told me.

Mind being more specific as to who told you that piece of information?

An immigration officer over the phone. The service rep transfered me. I even asked what would happen to a k-1 if they didn't get married within 90 days. Here is the response, and I quote: " Oh that's ok, as long as she came here legally you have options" that is the 100% truth. I almost fell on the floor when I heard that. Here is part of my conversation with her.

Me: How long do you have to send in the AOS after you get married?

Lady: You don't have a time limit to send it in.

Me: So you mean I have until forever to send it in? (actual words)

Lady: Well I didn't say that.

Me: So there is a time limit?

    Lady: No there isn't

I wish that I had recorded it. It was unbelievable. She didn't sound like she was uninformed, she was really quite quick witted with her words. After all she was the immigration officer.

No there's no 'legal' time limit.

USCIS doesn't put a time limit on negligence. If someone wants to stay in this country past their visa expiration dates, or I94W or I94 dates, the government isn't going to stop them

Because the government reserves the right to deport them later if they so choose.

As long as you're anything but a US citizen the government reserves the right to deport you.

    And your point is....what?

  11. checked all instructions and didn't find anything about 6 pictures :) anyway let's see what will happened... but this AOS process is less painful for us as I am here with my husband... and we became kind of Immigration specialists.. hehehe ... like probably everyone here :) Good luck again to everyone

hmmmmm... we read here that we need only 4 :( ... anyway if they need 2 more they will ask and we will send... it is not a big tragedy :) hehe

    6 is correct.

    Two are needed each for

    EAD

    AP

    AOS

Per form instruction you can find that AOS, EAD & AP requires Two (2) passport type photos. Just in case each will go to different sections/department then the evaluators will have each complete document package. But as Elmira said, let's wait and see. Everything will be fine and now we are still waiting til they cash the check. :)

hello I am just wondering if you separated the forms by folders or paperclips or mailed all together? What about cover sheet telling contents or between different forms? thanks...WaltnRafi

Use a cover sheet showing the order of all of your forms. Also, I used candy striped paper clips. ha ha! Also I used tabs on the bottom of separator sheets so the can have easy access to the forms without having to dig through them.

The I-94 governs your legal presence in the USA. If your status does not "expire" then why does the I-94 have an expiration date?

In case you don't get married. Once you enter into marriage you get the "limbo status" which means your here legally but you're just drifting in nothingness until you file your AOS. Your marriage certificate along with your k-1 visa (expired or not) is your status.

  14. I have a question concerning the Stimulus checks.

When my husband and I first filed our taxes we used his ITIN number because we were awaiting his EAD to be approved and then as soon as we received it we went to a SS office and applied directly for his card. He received his SSN in about one week. We then scheduled another appointment with our H&R agent and she amended our taxes and put in his SSN but she kept him as a "nonresident alien." I checked out the IRS website today to try to calculate how much we might get I had to check the "nonresident alien" box because that is what the agent put and it stopped me from going any further in that section and said that we are not eligable because he is a nonresident alien. So for the heck of it I retried it and checked No for being a nonresident alien and it let me finish calculating the estimated amount. I went and checked under my SSN and it said I will not be getting a check because my spouse or I are a nonresident alien with an invalid SSN. But when I check under my husbands it comes up as "We are sorry, Specific Information about your Stimulus Payment is not available. The thing is our agent told us that amending our taxes will make us eligable for the stimulus payment she even wrote it on our 1040 amending form so I am really confused now. I'm not sure what to think now does any one have any idea if we get one, or maybe we will just have to wait and see like everything else. Sure hope next years filing taxes goes alot smoother. lol

Sorry if this is a crazy question, I'm just really confused right now and just would like to get some opinions.

From what the IRS told me today. No amended returns are accepted. It's nuts. Did you amend it before 4/15/08?

Yes we did, we amended them on 3-14.

I would say then it is a possibility. They are acting very weird on this. The only thing I can say is look up the last 2 digits of the SS # of the primary name on the return and see when the expected return would be and wait an see. I think you can look it up on the IRS website.

Ok thank you so much. I did look it up and its like the 23rd of May. I guess we will just wait and see. :( Again thanks.

You're welcome. I hope it works out for you. My wife's sister got shafted this month as their date came and went.

  16. I have a question...

Will it cause problems for us if we delay sending in the AOS? We got married in March 2008, well within the three months allowed for the K-1. However, we're having difficulty scraping together the 1010 bucks for the AOS just yet. I've read that many people have waited to send it in. Is there a deadline, or somewhere it says when we have to send it in? Or can we just do it before my I-94 expires? I just don't want to screw anything up for us. Any advice you can offer is appreciated.

    Thanks!

    Janny

I'm not sure what the rule is now. But we waited 4 1/2 years to send ours in. (Long Story) She has the EAD in her hands and we got transfered to CSC. I called immigration back in 2003 and the immigration officer (not service rep) told me there was no time limit. We even got married on day 90. I'm speaking from the past but someone may be able to answer who knows the current rules.

  17. Hi. I just got off the phone with the IRS and they told me that if you filed your 2007 taxes with an ITIN you will not receive your Stimulus check this year for the US citizen and the foreign spouse. You'll get a tax credit next year when you file your taxes. You have to love the government. Write to your congressmen and senators. Some are aware of it and don't like it at all.

Your wife was (at one time) eligible to receive an SSN and you chose not to get one... You need to include yourself in this....

My wife went for her SSN today. I didn't know that I could've received one when she first got here. It's not that I didn't choose I just didn't find out what to do when she first came here.

Don't blame the government for your lack of knowledge....

Maybe shove it down my throat a little farther. I'm not blaming anyone for my responsibility. I don't need the government's measly hand out they borrowed from China. Were do you people get off pointing out my faults in not being prepared. Are you perfect??? What the hell is going on here. Lighten up please!

In that case, no further discussion is needed!!!

    BTW, it's 'where', not 'were'.....
