  1. Thought I'd keep everyone up to date. My husband's EAD and AP were approved yesterday! (Approval Notice Sent) WooHooooo :dance:

    To help those who are not being touched. I've reviewed at least 5 cases where they were touched 6+ times and then nothing so far for more than a month or two. One guy had two touches a month or so ago and then "pow" just got his approval email for the I-485. Hang tight, I'm in the same boat of "no touches since...."

I just got off the phone with the IRS and they told me that if you filed your 2007 taxes with an ITIN you will not receive your Stimulus check this year for the US citizen and the foreign spouse. You'll get a tax credit next year when you file your taxes. You have to love the government. Write to your congressmen and senators. Some are aware of it and don't like it at all.

    Your wife was (at one time) eligible to receive an SSN and you chose not to get one... You need to include yourself in this....

    My wife went for her SSN today. I didn't know that I could've received one when she first got here. It's not that I didn't choose I just didn't find out what to do when she first came here.

    Don't blame the government for your lack of knowledge....

    Maybe shove it down my throat a little farther. I'm not blaming anyone for my responsibility. I don't need the government's measly hand out they borrowed from China. Where do you people get off pointing out my faults in not being prepared. Are you perfect??? What the hell is going on here. Lighten up please!

  3. We were interviewed April 24th (see timeline below) and were told that we would know in two weeks if we were approved or denied. It's been over two weeks and still no updates online and nothing in the mail. The officer did say that even if he wanted to, he couldn't approve the case the same day because NVC still had the computer locked from the local office because NVC still thinks that our file is at NVC. He said he would request NVC to update their system since it was obvious that the local office had the file.

    After waiting over a year since filing AOS, I'm not too confident in how quickly we will have an answer. My husband's EAD expires in June, along with his driver's license and he's been waiting to go back to Morocco since his sister died in March and his cousin died 2 weeks later and we were denied emergency AP (he is now experiencing severe depression). He has been waiting desperately to get some good news about the GC so he can go to see his family.

    So now we sit with no sign of approval or denial. No way to file AP or to renew EAD since we've had the interview. No idea how long it will take until we have a decision.

    Does anyone know if USCIS 'has' (I know they can do anything they d@mn well please) to make a decision within a specified amount of time after the interview. This is pure torture waiting.

    We have contacted our Congressman's office about this and they haven't been able to get any answers as of yet either.

    We plan on going to an Infopass on Thursday and taking off another day of work and driving 2 hours and taking the chance of not getting any more information.

    Sorry if I'm whining. We are both so frustrated and bitter toward USCIS. :angry:

  4. Card Production Ordered!!!!! Yippee!!!!

    I've had no touches since the end of March, and today I came home to an email that said my green card has been ordered and should receive within 30 days.

    I hope this means good news for all you guys who have also been waiting without any news since March!!

    That's inspiration for me. I'm seeing all of the touches for people before and after my CSC transfer. I'll wait for my surprise email soon too.

  5. I have a question concerning the Stimulus checks.

    When my husband and I first filed our taxes we used his ITIN number because we were awaiting his EAD to be approved and then as soon as we received it we went to a SS office and applied directly for his card. He received his SSN in about one week. We then scheduled another appointment with our H&R agent and she amended our taxes and put in his SSN but she kept him as a "nonresident alien." I checked out the IRS website today to try to calculate how much we might get I had to check the "nonresident alien" box because that is what the agent put and it stopped me from going any further in that section and said that we are not eligable because he is a nonresident alien. So for the heck of it I retried it and checked No for being a nonresident alien and it let me finish calculating the estimated amount. I went and checked under my SSN and it said I will not be getting a check because my spouse or I are a nonresident alien with an invalid SSN. But when I check under my husbands it comes up as "We are sorry, Specific Information about your Stimulus Payment is not available. The thing is our agent told us that amending our taxes will make us eligable for the stimulus payment she even wrote it on our 1040 amending form so I am really confused now. I'm not sure what to think now does any one have any idea if we get one, or maybe we will just have to wait and see like everything else. Sure hope next years filing taxes goes alot smoother. lol

    Sorry if this is a crazy question, I'm just really confused right now and just would like to get some opinions.

    From what the IRS told me today. No amended returns are accepted. It's nuts. Did you amend it before 4/15/08?

    Understood, but a lack of knowledge of your available options does not eliminate some culpability...

    Hello to all. I'm looking online and I'm noticing a bunch of touches on the I-485 for CSC transferees. People before us I can understand, but people transfered 2 weeks or more after us are getting touches and we're not. Is this normal???

    Touches are only touches, some people get them some people don't. I wouldn't rely on 'touches' to give you up-to-date answers on your case. It might mean someone has gone on a coffee break from reviewing your file, or it has been moved from one desk to another. It really doesn't make a difference. The best of a speedy approval!!

  11. Don't assess the status of your case by comparing with other people, and don't rely on the CRIS Case Status online tool to tell you when something has changed on your case.

    There are many factors in each case. If the status for your I-485 has not yet shown that its resumed standard processing, then either its not been updated in the system or CSC has not officially received it from the NBC yet.

    The CSC got it already in the beginning of April.

  12. I can't understand USCIS... last week I got two E-mails from CRIS saying that card ordered and now this one...

    "Receipt Number: MSCxxxxxxxxxx

    Application Type: I765 , APPLICATION FOR EMPLOYMENT AUTHORIZATION

    Current Status: Approval notice sent.

    On May 9, 2008, we mailed you a notice that we have approved this I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION. Please follow any instructions on the notice. If you move before you receive the notice, call customer service".

    I just need my card :)

    I also received the same set of emails but i noticed the following:

    Only for EAD cards

    First Email - Approval Notice - Informing you that the application has been approved (actually the approval date is in the actual card -date when they first mailed out the FIRST NOTICE/EMAIL)

    Second Email - Notice that the card has been ordered

    Third & Final Email - Informing you that your actual EAD card/approval has been sent

    This is just based on my personal observation and Elmira I am sure the card is on its way. :thumbs:

    Mine Was Like This:

    1st Email Card Production Ordered

    2nd Email Card Production Ordered

    3rd Email Approval Notice Sent

    I didn't get a 4th one. But I noticed that people who have it this way usually get the card within 1-4 days after the 3rd email. I'm expecting ours here tomorrow or Monday at the latest.

    I have been receiving calls from employers. I am a Telecom Engineer with specialization of Fiber Optics and Microwave Transmission. Anyone may have come across an opening on this please let me know. Thanks.

    I think the second time production is when they mail it out. I've been observing other people's cases.

  14. Your status is AOS pending, USCIS will allow you to remail in the USA until a decision is made on the I-485.

    I messed up my previous response. Tell them that you can work legally in the USA outside of their employment. Tell them that you have an EAD. You may need them as a reference for a future job, so don't just leave without an explanation. I hope this helps.

    Please kindly advise me on what i should do. I have entered the US in Oct 2007 on H1B. And, I have filed family based AOS.

    The company i work is a private consulting firm. And the nature of work we do is contractual based. I was working on a contract job from December until early March 2008. Then, I have become on bench. The company has a rule that i need to report to the office everyday from 9 -5.

    I got married with my USC husband in Jan 2008. We filed I-130/I485 on Feb 2008. (I was still working for them at the time of filing) After filing I-130/1-485 for a month or so, the contract was over. I reported to the office since that time until early April 2008. Last week, i got AP and EAD card. So i want to become independent as soon as i can. I have just started actively applying for jobs myself. But not much is going on. I haven't gotten any offeres and used an EAD card yet.

    My employer called today threatening me (in the voice mail) that i have not reported to the office for 2 weeks. They need to know why. If i do not show up next Monday, they will report USCIS that i am no longer their employee.

    From my understanding, I already have EAD in hands; and am legal in the US. What if they leterally report to USCIS as such, would i be out of status????

    I was thinking about trying to get a job and use EAD as soon as possible(at least before they have a chance to report to USCIS!) After that, whatever they would report to the USCIS wouldn't cause me any problems!!!

    Is my thought the right way to go?? Does anyone have any advise??? PLEASE help!!!!

    Would like to add more info..

    You should at least tell your former employer that you have an EAD card and that you can work legally in the USA outside of their work visa. That's just good business. Plus you might need a work reference from this company to get another job. Don't just walk off the job, it doesn't look good to future employers. If you tell them what's happening, they will at least know what's going on. I hope this helps!!!!

    01/2003: Came to US(F1 visa)

    02/2006: Started dating with my USC husband in CA.

    06/2006: He moved to IL. I was on OPT (F1 at that time)

    10/2006: I relocated to IL, and moved in with my husband.

    09/2007: OPT ended. I went out of the US.

    10/2007: I came back to the US on H1B.

    01/2008: We got married.

    02/2008: We filed I130/I485 package to USCIS

    03/2008: Fingerprinting was done. I was still working for my employer on H1B. Unfortunately, the project that my company had with its client ended. So, the last cheque i got from them was until March 05, 2008. After that, i had to come back on bench to wait for the next project. I have reported to office everyday since then until the beginning of April.

    04/2008: I got AP and EAD in the mail.

    My anxiety about this is since I have not officially declared my status as 'AOS pending' by either traveling out of the US (using AP) or getting a new job(using EAD) and thus given up my H1B, my status is hazy. It would be clear cut if I can easily get a new job during the bad economy at this time so that I can just use EAD. Unfortunately, after i have been waiting for almost 2 months, I really do not know when i would get a new job on my own.

    I am not sure if my employer reports to USCIS that i am no longer their employer, I (as on H1B) would be out of status even though i already have filed AOS and have AP and EAD in hand.

    Or, because I have filed AOS and have AP and EAD in hand, I should just ignore them???
