No need to worry about updating the new citizenship at this point. At the NVC stage you'll add it to the DS-160. However an appointment with an immigration attorney would be highly recommended at this stage for the potentially 2 overstays. I've never seen anyone DIYing the waivers necessary for that. And like another user said ensure you either have custody or permission to move country with the child. I understand china does not allow dual citizenship. I don't know if there's risk in interviewing in China for the daughter as the consular officer will clearly see that she has 2 citizenships when she's meant to only have chinese. So i guess there's potential for the daughter losing chinese citizenship interviewing in China? *Might be worth considering the daughter interviewing in Canada if that's something you're trying to avoid. Switching embassy can be requested at the NVC stage. (*Mods im happy to edit this part out if it's out of line) -
Hi there, I'm going to give you my recent expirience which will help alot. We are in a similar situation. I'm british but have been living with my husband in Tijuana while he crosses to work in San Diego. We also didn't want to lie and everyone freaked out about him giving his address as mexico. There's multiple addresses to give. We got our i-130 approved and more importantly DQed at the NVC with this. For the petitioner we put his physical address as the Mexico address. And his mailing address as the US address. Having the physical address in Mexico shows that your both living together and is just the truth. And its very important to put the mailing address in the US as it shows domicile. Which is what she will be worried about. I lived in the UK at the time of filing so my husband had all his addresses in the US. But when working with the NVC giving address history and proving his US domicile become the most important. To back this up we sent multiple documents. (Probably overkill but it worked lol) All trying him to the US. His US bills, name on appartment, US car title and insurance, US job paystubs for 6 months, life insurance, letter of work proving he works. I think more but off the top of my head I cant remember. Oh and also we attached a letter of explanation saying he holds domicile in the US and is temporarily living in mexico and commuting in order to stay together during the wait. And that the final destination will be the US. This is essential. I only proved it at the NVC stage but it wouldn't hurt including the letter at the i-130 stage too. You can so do this yourself if you follow guides and keep asking questions. (And yes ownership of your house would so be enough at this stage) Any questions let me know!

So I received my i-130 approval under the documents tab after receiving the action taken email on the 19th Jan. But on the USCIS account it shows up as the 21st. edit: on my approval notice it says the 19th!! But still curious of my questions for the rest of the process. Also our case was sent to the department of state today (the 23rd) but on the USCIS account it states it as the 24th Jan. So my 2 questions. Which should I update my VJ timeline to be the most accurate if this is a pattern of the day it actually happens and the day the say it happened? And I guess why does this happen? When do they consider the approval/events to be? All this being said my approval day in my heart will always be the 19th. It's a day i'll never forget. Thank you all

yeah try direct consular filing for the faster processing time since youre both abroad. do not fill the i-130. and then she can abandon the green card down the line

This is a bit old so I don't know if you solved it. But Adding the account number to your existing account is the way to go! Did you come to that conclusion?

The next step after the NVC receiving it is paying the fees. It's only after it leaves the NVC then the embassy get involved. Have you been documentary qualified yet? -
Possible fraud on k-1 visa

As an avid watcher of the show the only people that stay that look sus are those that got married in good faith, adjusted their status with the person they married and then divorced. Which is all legal and fine. But the k-1 haaas to adjust their status through the person that petition the k-1 and then married. Defo no hope for this woman. -
So would leaving Portugal endanger her Portuguese residency? I get the feeling the embassy will be understanding but are you able to maintain that residency while moving to the US? I guess there's the risk of losing it. But for the Paris embassy accepting you you might as well wait and see. And if they accept you then you'll get your interview letter and it'll be fine. If not then they'll ask you to transfer to the Peru embassy and you can wait in Portugal till your interview!

That's interesting. So if it's being held at NVC then when they restart then it's waiting for the embassy again from scratch right? No way to have it held at the embassy? -

Get engaged this next trip and for k-1 right away. And wait while doing smaller trips to visit each other. Reason I'm saying k-1 over the spousal visa is even the first part of the process is now 16 months and you will be able to be together sooner if you do this. -
Yeah OP I think it comes down to these things: Top priority: being together faster and not having to separate: K-1 by a MILE The ability to go to your home country if one of your family members is sick or something: Spousal. (although you can get advance parole after K-1 and I don't know how long that's taking these days so it wouldn't rule out the K-1 completely) And as for where you want to get married. I would say unless it's extremely important to you focus on these two points to make your decision. Unless certain people from you country are unable to be in the US that you really want to be there. If you are going for the spousal visa budget money for visiting each other. The wait is brutal right now and not getting any shorter.

Thank you for your reply! That's good to hear about the rough timeline. Wow for the medical I thought it only had to be 5 working days beforehand. Is that too tight of a plan doing it the week before? When I submitted my i-130 I lived in the UK but then moved to Mexico to be closer to my husband 7 months later. (I'm a British citizen and now have Mexican temporary residency) Do you think that would cause me trouble?

Yes meet up with her and get engaged and you will be filing the i-129f. Check out the guides here and also KsenyaInternational's youtube channel was so helpful to me. You can already start preparing with evidence to show your relationship before you got engaged screenshotting your conversations. You're definitely able to do with without outside help. Be sure to ask any questions you may have about filling out the form and double trip check them before you send them off! Good luck!
