    I think you don’t have to wait 5 year. Vawa green card holders are qualified for citizenship after 3 years and you can marry once you get your citizenship after 3 years. Remember sending your citizenship application 2 years and 9 months after getting your green card

    Unfortunately my spouse was an lpr so I would have to wait 4 years and 9 months before I can apply for citizenship. Correct me if I’m wrong but I think 3 years rule applies to those who were/are married to usc.

    Thanks for the info. I wasn’t thinking about getting married right away. Maybe after a couple of years. It takes time to find someone and get to know the person. Not going to make the same mistake and rush like I did the first time. But again, I’m getting old and 5 years wait seems a bit extreme.

    I had a conversation with my attorney regarding getting married again and he told me that I should not get married and sponsor my wife since I got my GC through my wife who was an LPR. I was told that I should wait 5 years until I become USC. He didn’t remember if it applies to those who got GC though vawa. So I came here seeking advice.

     

    My marriage case wasn’t strong enough due to obvious reasons but my vawa case was strong enough that my AOS was approved. Due to what I experienced, I chose not to get married here in the US and marry someone in my home country.

     

    My question is… is it true that I should wait 5 years before I petition for my wife? I know it’s a long process and I’m not getting married anytime soon but I’d like to know what my options are.

     

    Please let me know if you have any information regarding this. Thank you.

    I am panicking again, looking for some advice. Got GC approved, wanted to book international flight for a couple of weeks and go see my parents.

     

    I unknowingly violated my prior immigration status years ago, I mentioned it in my 485 application, it was cleared recently, and I got GC approved.

     

    My question is: Is it safe for me to travel now? Can I be still denied entry? What are my options if they don’t let me enter.

     

    If anyone knows about it, please let me know or guide me to a document or something, I would really appreciate it.

    I got an update on my I485 again yesterday. Another RFE - additional evidence. The first one I got was RFIE- which was for birth certificate. I responded to that and I got the deficiency letter a week stating I should either bring my medical to the interview if I'm schedule or wait till they send me a request.

     

    What is this RFE for additional evidence?

     

    Is this one for medical or what other evidence will this be.

    Very likely a medical RFE since they also sent you deficiency notice earlier.

    You can expect an approval or medical rfe if medical expired. Seeing this pattern a lot lately. Give it 2 weeks.

    my vawa was approved on July 2022 then couple days ago I got update saying finger prints are taken. I did lot of inquiries but no reply from uscis. 
    my field office is Jacksonville Florida. Do you think my case is already in field office? 
     

    I got my 360 approved in May I think and I too got fingerprint applied update last week on 485. Seemed like a step backward and couldn’t find any info on this.

    I was under the impression it was transferred to local office, Does this mean it's gonna be a little while longer to hear anything from them? or this is a good thing? @ax1990 @Julie15 

    I received rfe for birth certificate mid august from nbc, prior to that my file was at Vermont. Responded in early September, haven’t heard anything since. My medicals expired too but wasn’t asked for it. It will be transferred to local office next and they will determine whether to interview or send rfe. If your case was transferred, you know it’s moving and it’s a good sign.

    Likely transferred to local office for interview or medical rfe if interview is waived. You are almost there.

Since I assume you did go through consular vetting when you obtained the visa you entered the US with, I don’t see you facing much issue with the delayed registration of your birth….but I am shocked you have an attorney that submitted the I-485 and I-360 without a bc

    The rfe I got included a link to birth certificate requirement table by country, I got what they are looking for, it’s just the issue date I’m concerned about. And yes, they did vet me well I believe, I was put in admin processing for a couple of months before they granted me a visa. I don’t blame the attorney, I had an extraordinary circumstance which required me to file for AOS asap even without the birth certificate. More on that later. Thanks so much for replying.

    That might be the issue. 

    It can be understandable if you loose the original birth certificate an now having the duplicated one of 2016 from your home country. 

    The administration will really like to know whom are they dealing with.

    It May also work, one never knows. 

    When I got my first passport like 20 years ago, having a birth certificate wasn’t a requirement, I had a separate national identification which sufficed. Things have changed now. Also when I got F1 visa, submitting a birth certificate wasn’t a requirement and I got the visa without it. I think they know who I am, still it’s causing me some stress, so I asked the question.Thanks for responding back.
