My guess is parent entered using someone else’s visa/ fraudulent entry documents. Thus lawyer is thinking I-601 for fraud/Misrep will cure the entry. … -

Judge to hear arguments over scope of trial in New York's civil suit against Trump The former president's lawyers want the state Supreme Court to dismiss the fraud lawsuit against the Trump family brought by New York Attorney General Letitia James. During the pretrial hearing, New York Supreme Court Judge Arthur Engoron will review a motion for a summary judgment by Trump's lawyers that was filed in late August, asking for the attorney general's complaint to be dismissed. Trump's lawyers argued that the New York attorney general has "no valid authority" to sue, that the lawsuit was filed outside the statute of limitations and that James has “failed to demonstrate any even theoretical harm to anyone, public or private.” James' office has asked the court to find the Trumps and their family business, the Trump Organization, liable for fraud even before the trial is set to begin Oct. 2. "The undisputed evidence establishes that Defendants employed a variety of deceptive schemes to grossly inflated values for many of Mr. Trump’s assets," her office wrote in a filing.

What you paid back then for I-485 and I-485A was for the adjustment you abandoned ( did not show up) and you don’t get that $ back or claim credit for it. You pay new filing fees You have to use 245(i) otherwise you cannot adjust / get green card from within the US. As long as marriage was real and you have evidence of such ( in case it’s asked for) there is no issue.

The judge admin closed your case to give you a chance to get the I-360 approved. Once that got approved a motion to re calendar/ terminate is necessary to pit case back ob docket and get in front of judge . The I-485 renewal noted just tells me you had already applied for adjustment w your abuser spouse ( I -130/I-485) before being placed in removal …and that I-485 is currently on hold w USCIS ( in abeyance ) until removal is terminated. ..so you won’t even need to file a new one..just update anything needed ( ex new medical and I-864 W) usually via an RFE they send after they get copy of termination. So get your motion filed w the court asap -

There is no method to speak to a supervisor . Respond to the RFE by stating you qualify for I-864 W are enclosing a newly executed form and submitting documentation from SS. I am not aware they insist on SS earning records be “certified” and they would need to specifically RFE it , so what you sent is perfectly good. Respond and you will be fine -

Just go into a SS office, show them RFE and ask for PEBES report. ..they usually put a stamp on the one page document….the paystubs will not be considered. What exactly does RFE say about I-864 W issues?? Exact words -

The fact that OPLA/ICE doesn’t respond or says wait..is common. It’s fantastic that you got attorney to file motion to Recalendar/ terminate w the court! Hopefully you have a copy of it, if not get one. The I-485 filed w the Motion won’t get traction since goal is terminate and Run…not schedule future hearings to adjust in court. As long as you can independently verify motion was indeed filed , nothing you can do but wait for the court. Texas is a border state..so you can appreciate the backlog. Nothing a new attorney can do ..and not worth $ to switch , now that work needed ( Motion) already done and filed. Turn on the Texas charm you picked up , call the court , make nice w the clerks and try to see if they can guesstimate a date . -

Did you submit a statement of earnings from SS that shows you earned 40 credits along w I-864 W ? If you have the credits , correctly filled out I-864W along w either PEBBLES SS report or certified record of Earnings…you insist on it. Respond to RFE by stating you qualify for I-864 W based on evidence as submitted at filing or updated SS reports you obtain to satisfy RFE. -

Don’t worry, you have enough survival skills to even pass the N-400 citizenship test ..and you will , if you do a good job job with I-485 adjustment and get your green card first . As parent of a USC , a well prepared packet is likely to be approved without interview. ..if there are no other issues. If you are determined to DIY , then get your college degree daughter to read your post , review the steps I laid out and go for it. You can hire an attorney after , IF an issue comes up and USCIS raises questions on that marriage. A good attorney can help navigate the responses . The story line you tell is worrisome because: 1. your wife got pregnant w another man’s child 2. your petitioning USC daughter was born out of a relationship with another woman Both 1 and 2 took place during marriage and I-130 filing They may not catch it , but if they do you will need to show it was a real marriage, not for papers.

Did he agree to do the motions with court ? Nothing will happen until that is filed. It’s up to the IJ ( immigration judge) . If your I-485 was rejected by USCIS for lack of jurisdiction..why are you waiting I-131 and on what bases? As it is, don’t travel until removal is terminated..so don’t file I-131 yet -

Good first attempt..now try to find out when it was placed on expedite ( date) , has it been assigned to an officer and what timeframe is there for a decision to me made on expedite. Also indicate you have received no notice ( email or letter) confirming case is on expedite review. So you don’t know if expedite request was approved and if so when was it approved and how long has it been on that list. Say your heart condition is precarious and may require earlier than planned intervention…so dates are crucial (…or fill in as you see fit)… But it September and expedites usually get resolved in 30 days or less…so keep at it

After that consultation, poor kid is afraid to just submit divorce and was told his case is sooo bad..Hacking won’t take it…brrrr Would love to see the regulars who watch and catch such big boo boos , drop a few lines in the comment (not chat) sections. I recall @crazycat posted he made a few such corrective comments. -
If you are already working w Senator , you are one step ahead. No need to contact congressman , both work same way. Liason is just term for dedicated staff from branch . DOS is departmental of state. Keep up pressure with Senator to locate file and ask them for a direct response on status of your expedite. Yes, it’s hard to get human on phone w USCIS..but keep calling and lodge the expedite. If by chance expedite gets denied , appeal it ( simple email process)
