Dominion sued Newsmax in the wake of the 2020 election over the network’s on-air promotion of the false claim that the voting technology company rigged the election against then-President Donald Trump by flipping millions of votes to Joe Biden The decision by Delaware Superior Court Judge Eric Davis means — barring an out-of-court settlement — Trump’s lies about the 2020 election will be front and center at a four-week trial during the closing weeks of the 2024 election. Davis presided over a similar high-profile defamation case brought by Dominion against Fox News over the network’s airing of election lies. The case ended in April with a last-second $787 million settlement, the largest publicly known defamation settlement in US history. Dominion filed its lawsuit against Newsmax in August 2021 and is seeking $1.6 billion in damages. The allegations stem from Newsmax broadcasts that included claims that Dominion “has a long history of rigging elections,” its software “altered and flipped” votes in the 2020 election, and that the “entire election was hacked” in Biden’s favor. None of those claims were true, even though they were peddled on Newsmax by Trump allies, including Sidney Powell, Rudy Giuliani, Mike Lindell and Patrick Byrne, who are facing defamation lawsuits of their own. Michael Sparks, who spent the weeks leading up to the Capitol attack consuming and regurgitating right-wing lies about the last presidential election, was sentenced to 53 months in federal prison at a hearing before U.S. District Judge Timothy J. Kelly, who also oversaw the seditious conspiracy trial of members of the Proud Boys. “I am an American citizen who believes to this day that we are in tyranny,” Sparks told Kelly, adding that he believes the conspiracy theory that the 2020 election was “taken from the American people.” Kelly emphasized that Sparks had the right to believe whatever conspiracy theory he wished no matter how divorced it was from reality but that he did not have the right to storm the Capitol. “I don’t really think you appreciate the full gravity of what happened that day and frankly the full seriousness of what you did,” Kelly said, explaining why he went over the sentencing guidelines of 15 to 21 months. "A lot of us would like to see our country grapple with different challenges differently," said Kelly, a Trump appointee, but that did not give people license to behave as Sparks did. Given his support from the community and his lack of criminal history, Kelly said there "isn't any obvious explanation" for what Sparks did on Jan. 6, 2021. It was a travesty, a grotesque imitation with intent to ridicule. It was never meant to be a grown-up conversation structured to enlighten us 60 million viewers about how the candidates would govern in a second term. Trump shamelessly spewed 602 lies in 40 minutes – that’s a lie every 3.9 seconds. The CNN fact checker couldn’t keep up with him and neither of the CNN moderators challenged anything he said, though little that he said had any connection to the real world. His rhetorical assault is known as a “Gish Gallop” – a gas lighting technique used by con men and domestic abusers to make coherent debate impossible. There is no known defense, and it is rarely seen in public because only sociopaths use it. Trump called America a “hellscape,” the worst country in the world, and has already told us his plan for a second term: dismantling of the government as we know it, vindictive retribution against those who disagree with him, deportation of millions of hard-working immigrants, destruction of reproductive health care for women, climate degradation, chaos and mayhem. He will be Dictator on Day One. How can we even imagine such a man as President again? Trump is the candidate who must be called to step down. A source with knowledge of the incident said the cemetery official tried to prevent Trump staffers from filming and photographing in a section where recent U.S. casualties are buried. The source said Arlington officials had made clear that only cemetery staff members are authorized to take photographs or film in the area, known as Section 60. Special counsel Jack Smith has charged former President Donald Trump in a superseding indictment in his federal election interference case. "Today, a federal grand jury in the District of Columbia returned a superseding indictment, ECF No. 226, charging the defendant with the same criminal offenses that were charged in the original indictment," a Justice Department spokesperson said Tuesday. "The superseding indictment, which was presented to a new grand jury that had not previously heard evidence in this case, reflects the Government's efforts to respect and implement the Supreme Court's holdings and remand instructions," the spokesperson said. The superseding indictment retains the four original charges against Trump from the special counsel's original indictment -- but is pared down to adjust to the Supreme Court's ruling. While the original indictment laid out five ways Trump allegedly obstructed the function of the federal government -- having state election officials change electoral votes, arranging fraudulent slates of electors, using the Department of Justice to conduct "sham" investigations, enlisting the Vice President to obstruct the certification of the election, and exploiting the chaos of the Jan. 6 riot -- the new indictment removes mention of his use of the Department of Justice, which was explicitly mentioned in the Supreme Court's ruling as falling within his official duties. While the original indictment mentions the Justice Department on over 30 occasions, the new indictment makes no mention of the DOJ. It also reframes the portion of the original indictment outlining that Trump allegedly knew his claims of election fraud were false. The new indictment is 36 pages, while the original indictment was 45.
