TexasRafael got a reaction from 2022 in Requirement or suggestion to reschedule interview until AFTER medical exam is complete (merged topics)
My experience with this same issue in Indonesia was not a pleasant one.  The very first time my spouse went to the medical prior to the Interview, he tested positive for TB and had to go into treatment.  Unfortunately my spouse lived in Sumatra a different island than Java where the only approved US Embassy Hospital is located and the treatment takes 6 months.  Since he was not able to do the treatment in Jakarta, the hospital requirements are that after the 6 months treatment, he had to wait another year to schedule a new medical test in Jakarta, a wait of 18 months, then when he went to the medical, because he had scarring in the lungs they required the sputum test again which by the way in Indonesia takes 12 weeks, (3 months.)  Eventually he passed and passed the interview and was given his visa but from the time that USCIS approved our K1 application in Feb 2018 until the time he finally entered the US, June 2021 was 3 years and 4 months.  Wish you the best but be patient.

My spouse was positive for TB in Indonesia and it took a long time to get approval of the K1 because of the treatment.  When he entered the US the Houston Health Department reach out to us and came to the house and took a blood test, then he was told to go to the health department and take the sputum test again, which came out negative.  In any case, if your health department has not contacted you, do not worry about it.  Just go on with your process.  Good luck.

Well, my experience on this was the following.  I went ahead and filed my tax return married filing joint and entered all 9's for my spouse social security number, (while we applied for an ITIN which actually took a year and a half to get from the IRS.)  I had to file 2 years of taxes using all 9's for my spouse social security and both years the IRS processed them and uploaded my transcripts to their page which I was able to use for my  I864.  Once we obtained the ITIN I did amended returns using the ITIN and after my spouse arrived in the US and received their social security number, I once again did amended returns for those two years.

When I applied for my fiance visa in July 2017, I had only met my now spouse once, however, by the time the interview in the Embassy took place, we had met in person 3 times.  Unfortunately it all got delayed because a positive TB test, which required treatment in country and then Covid, so while my K1 visa application was approved in Feb 2018, my now spouse came to the country in June 2021!  During that time I travelled 8 times for a total of over six months of visits and the K1 was approved without issue.

    Hello,

This is regarding the process with the embassy in Indonesia.

Anybody know how long it typically takes to get your passport back by mail if an immigrant visa is approved? I heard 2 weeks but didn’t know if anyone had any direct experience.
Is it possible to pick up your passport directly from the embassy?

If anyone has gone through the process in Indonesia or is in process and wants to message me about this, feel free.

    Thanks

While I have no details about Pakistan, my now husband was approved for a K-1 Visa in Indonesia, the largest Muslim country in the world, (though as stated whatever prevailing laws in the country are irrelevant to obtain a K-1 Visa for same sex couples in the U.S.)  For reasons not important here, he had to leave the U.S. after marriage and before adjustment, so I had to apply for a CR1 visa and that was also approved without issue.  Once he arrived in the US we had been married over 2 years so he got the 10 year green card.  Good luck.

TexasRafael got a reaction from BeefedRamen in Filing Taxes as it relates to CR-1
This is my experience.  I got married in July 2021, 9 days after my spouse arrived in the US and unfortunately for reasons he had to go back to Indonesia and then I had to apply for a spousal visa.  When I filed my 2021 taxes I filed married filing jointly and just entered all 9's in the place where his social security needed to go, ( he did not have a social security number.)  I did proceed to apply for an ITIN in the interim but that took almost two years to accomplish.  So when 2022 came around, I once again filed married filing jointly and filled it all 9's in for his social security number.  On both times the IRS processed my return, gave me my refund and uploaded the return so I could get a copy to use when doing the paper work for the spousal visa.  The money you send is NOT income for your spouse, her income is 0 in the US.    He eventually entered in October 2023 with the spousal visa and in one month after arrival he received his social security number.  It would be good to have the ITIN but that process takes a long time and they are very slow in handling it.  What I would NOT do is file single.

Cannot speak as to how long will the wait be for an interview in Manila, however, the CR 1 visa would be the best and the cheapest, (given that all USCIS prices are going up and up.)  So go to the Philippines and enjoy a trip there and get married and once you arrive back in the US start your marriage visa process.

They probably lost it or it didn’t get scanned in by the lockbox. Easiest way to respond is to send them another one. Include a cover letter with your name, your beneficiary’s name, your I-129F receipt number, the RFE reference number, and state that you are enclosing the death certificate from your deceased spouse. Put all original pages of the RFE on top of your cover letter and death certificate and mail it in to the address they told you to send it. Make copies of the entire response package before you send it in to keep for your records

So seems like he really does not care about his wife and care even less if she is deported.  In the present environment there is a much higher chance his wife will be sent back to her country.  How sad.

His wife is not a priority then... it doesn't look like a bonafide marriage, sadly.

Our experience was that the questions on that topic never came up, however, my spouse was well aware that I had been married for over 30 years and was divorced.  The divorce decree was in all the papers that had been submitted with the application.  I think that while I do not believe that they need to know the details, they do need to know that you were married and divorced.  Good luck.

It is very sad to read your story.  I honestly believe you already know what is going on.  Your best solution is to get divorced and stop spending your money on something you already know is not for your benefit.
