We got our hopes up, thinking IL in Europe take 2-5 weeks after DQ….
I would email the consulate to ask. Use their subject format or it will be ignored.

Her daughter is in her 30s and is staying in Germany. My mistake on the entry denial: it was Mar 2021, not 2020. She also entered US in Fall of 2020, after the overstay in July 2020. Once your ESTA is denied, you cannot get another (we tried appealing with no success). Her CR-1 interview is next week.

You troll. Overstay was not our fault. Keeping my wife in a small room with 100 attempted illegal immigrants without masks in 2020 for 20 hours, screaming at her like a criminal: that is not humane or how the US should work. She was 60 years old from Germany, not looking for a free ride or employment.

Stuff happens. Weather happens, technical malfunctions happen, delays of incoming flogged happen, always give yourself at least a day’s breathing room if you are flying.
I think the issue with the B is not so much you technically cannot apply for both, but that the B visa requires you to overcome the assumption of immigrant intent, and obviously having an immigrant visa petition in progress means…there is immigrant intent.
Agents have complete discretion how to decide. My wife entered the US on another visit after the overstay and before the Houston jerk's decision. I haven't mentioned the criminal behavior of the immigration agents in Houston. It would make a fine Washington Post article on the abuse of power in that corrupt system.

COVID times were different: there were 0 flights for 2+ months out of Puerto RIco. I got the first United flight out after COVID. Maybe we could have flown to Dominican Rep. earlier, at much cost and losing our United return.

We were in US for 120+ days. Because there were zero flights from Puerto Rico during COVID, she got an extension to 120 days. We were told there was no possibility for a further extension, but now an agent told us it was possible. The flights kept getting cancelled until the last possible time, but then we had one on the last day. There were big storms in NY which made us miss the connection. Later immigration didn't care at all about those troubles, only that she overstayed. Evil system!!!

no, we applied for both at the same time. She has a house in Germany, a car, daughter..., so has strong ties. The NVC tech said the website cannot handle appointments for both IV and NIV.

My wife was denied entry to US because of an 8 hour ESTA overstay, caused by COVID and flight cancellations in 2020. We got married soon after this, and applied for both the CR-1 and a B-2 visas. At the 1st B2 appointment in Vienna, she was denied without any reason given, only "you can reapply...". We had a second interview a month later, denied again. The officer implied that the CR-1 application was a problem for the NI visa, but didn't say it directly. After many emails with Frankfurt and NVC staff, they basically said you cannot apply for both IV and NIV at the same time.
I wish this would have been clear at the beginning. We would have not applied for the CR-1 until we had the B-2. My wife has not been able to visit our US home for almost 2 years because of a nasty immigration agent at Houston.

They have the approve your request, which takes maybe a couple of hours if it’s earlier in the day. We requested it around 4PM and got the approval very early the next morning. After that you log back in and can see the calendar with dates and times to officially make the appointment.
It took me about 2 weeks and several emails to hear about an expedited appointment.

I got a response from the consulate within 30 minutes of submitting the request to file the I-130 in person.
I was asked if we filed online with USCIS and I replied NO. Shortly thereafter we got the good news! I'm now reading through the required checklist and I see that only the petitioner (me) needs to provide - Proof of petitioner’s German residency such as Residence Permit (Aufenthaltserlaubnis) or Registration (Anmeldebestätigung), U.S. Military Orders (if stationed in Germany), or other verifiable evidence of German residency.
Which I saw was a question that folks had on one of the forums. I can't remember which one. I just wanted to share because we were just going to file online and hope for the best then I started to read all the great content in this community and we took a chance and asked the consulate😀
Wow! I wish I knew of this, but it might not have helped. You just saved at least a year I think.

Does anyone know how long from interview to receiving the passport takes currently in Frankfurt? Our appt. is Nov 18 and we need to go to US ASAP.

The approved doc in Wien won't take appointments until you have the interview appt, but I think they are very quick. Frankfurt says they will accept consulate approved docs in Austria (and probably other countries). The Berlin doc had much sooner availability than Munich. If German docs have long wait times, I recommend another country's.

No, still no word from NVC about an appointment, 6 weeks later. We did the medical exam in Berlin 3 weeks ago. The wait times are rapidly increasing for this so we didn't want yet another delay. We are also doing a B-2 visa interview in 2 weeks in Berlin if we don't hear about a CR-1 appt. first.

My wife applied for B2 and CR-1 at the same time. She overstayed an ESTA by a few hours due to a weather delay so could not get another. She tried twice for a B2 visa in Vienna and was denied both times without explanation. Terrible system and people.

I would email the consulate to ask. Use their subject format or it will be ignored. If your app is still at NVC, though, you are stuck. They don't answer calls anymore.
