February 2022 Filers!

I think not. It's still early ... as sad it is to say that. -
Does NOA2 expire for IR1?
Alex&Nayden replied to karppi's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
Not sure about delaying the process but wanted to mention that once you get the visa in your passport, you have 6 months to enter the US. You don't have to do it right away. -
Co-Sponsor Question
Alex&Nayden replied to LT1's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
His current income should be enough. He just needs to show employment verification letter and pay stubs. I will say this and I truly mean it. If you do not feel comfortable being a co-sponsor say "No." Do not feel guilty for saying it either. It sounds like you are already feeling uneasy about it. Aa true friend would understand. -

DCF in Bulgaria
Alex&Nayden replied to malka's topic in Direct Consular Filing (DCF) General Discussion
I know this is a super old post but WOW I am so upset because when I called them and asked about doing a DCF in Bulgaria (I've lived here for 5 years!) the lady on the phone said I can't do that. I have to submit everything through USCIS. Then after submitting the I130 I was offered a job in the US and contacted the embassy to see if they can take our case, they said that since I already filed with USCIS they cannot do that. But otherwise yes, I would have been able to. So the original person I spoke to totally misinformed me and now we are stuck waiting (probably 1-2 years) to go through the regular process. -
spousal abandament
Alex&Nayden replied to bullettandmo's topic in Removing Conditions on Residency General Discussion
It sounds like you are more upset that she is now making more money and as a result "she needs to be deported." My advice: get a divorce and move on with your life. Focus that anger and energy on bettering yourself and gaining new skills so maybe you can earn the same salary as her because it sounds like that's what really upsets you. -
Yeah, it kind of sucks. I also think many people are trying to expedite even though it's not a life or death situation. Some couples are using "emotional distress" or financial hardship and getting approved. In reality — aren't most couples super stressed (emotionally and financially) and sad that they are not with their family? But that's just my personal opinion.

USCIS service center
Alex&Nayden replied to Yambouzinek's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
Why don’t they show Potomac? Do you know? -
With the proof of marriage, here is what we sent: - I think like 10 -15 photos (some just the 2 of us but we made sure we included photos with our families and friends to show that our families know about us) - a bunch of travel tickets and hotel reservations with both of our names - screenshots of social media posts we've made throughout the years (we put them in chronological order to show our relationship started back in 2017) - a joint bank account (our BG bank, I didn't even think to do my US bank lol) - our joint apartment lease (we have 5 but we only included our current one bc we didn't want to translate all of them) - 3 affidavits (2 friends, and my sister) - we also each wrote our own affidavit about how we met and what we love about each other and our plans for the future together - marriage certificate (obviously) Don't forget to get everything translated. But yeah that's pretty much it.

Yeah the wait is about 1.5 years, which is not terribly long but not short either. The first phase (USCIS) seems to take the longest so I encourage you to file asap and then gather everything else while you wait. If you have any "Bulgaria" specific questions, feel free to ask. I know there are not many of us here, but it's a plus bc the embassy doesn't have a backlog for interviews so at least that's fast. Also for self employment, do some digging in the forum because there are some helpful threads on it. For self employment taxes, they will look at "gross income." That's the income after you take out your deductions. Just make sure that's above the poverty level.

Hey! Bulgarian here too! Except we are both living in Bulgaria while we do the process. Question for you - did the embassy agree to take your case or do you have to file with USCIS? As far as your tax issue - you could be in a bit of trouble honestly. It doesn't matter where your spouse lives. If you are American and married you HAVE TO file taxes as married. I would connect with a tax accountant ASAP to fix it.

I-130 Online help!
Alex&Nayden replied to Oreo96's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
I absolutely second what this person said. We were under 18 when my parents were naturalized, so they didn't get the certificates for us. They just automatically got us passports. -

Yes I submitted it online. I put no I don't have a certificate. If it won't let you move on, then I would put "no" and then still explain the situation on the last page. -

The same thing happened with me (parents naturalized and I was a child) but I never got a certificate. I think your passport is more than enough proof that you are a citizen. I just used my passport and it was fine. You can answer yes and then add a note on the last page that you've lost it or can't find it. Just be honest. But definitely add your passport as proof of citizenship. -
Yeah I am in both of those groups (K3 and the Potomac Filers). And it does seem like the K3 does help 90% of filers. I did plan for a 12 month wait BUUUUUUT I'm being hopeful it's faster (I think we all are). Side note - are you (or your spouse) from S. Korea? I lived in Seoul for a couple of years. Loved it!

Affidavit of Support Questions
Alex&Nayden replied to HUGOC9999's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
Is there a reason you calculate pay period based on the full year even though not working at the company for a full year? Do you happen to have any sources on this? I'm asking because I am in a similar situation and I'd love to get more concrete information. Thanks I found a site of a lawyer who explained the current income like this and it goes against what you said so I'm just curious about your source: Example: Mike is immigrating his wife and is filing an I-864. It is Oct. 31, 2016 and you are assisting him in calculating his current income for Part 6. Mike was unemployed for the first six months of 2016, but started working at a job on July 1 that pays an annual salary of $48,000. He is not anticipating earning any additional income and he is planning on working for this employer indefinitely. Mike’s current individual annual income is $24,000 (not $48,000) because that is the amount of income he is anticipating earning in 2016.
