Not sure what you mean.  Even if yours is successful, it will not impact any other cases.

All of that is irrelevant to the fact that the burden is on YOU (not USCIS) to demonstrate evidence that your religion opposes vaccines.   A lack of structure will, in my opinion, make that next to impossible.  If you do not have written, documented, well-established teachings, doctrines, dogma etc, then it really is more of a personal belief than a religious exemption.

I would have a plan B in the event of a denial, with or without a lawyer.

iwannaplay54 Well the Immigration Officer put Religion but my belief doesn't just exist through religion. It is absolutely hard to understand if a person only knows that a belief can only base through man made religion. So for everyone to understand? I'll use the word nondenominational. we observe TORAH, we read Bible. We believe that YAHUAH exist and YAHUSHA HAMASIACH will soon come. But we do not believe that we needed a structural church to be save and this is why it's complicated for everyone to understand. We do not go to church I read and observe the feasts of YAH. But we do not believe in religion.

Letspaintcookies Thank you for your response. My brethren made letters for me they willingly made it. Also we truly can't afford hiring lawyer(s). So I made  VS account to collect opinions and experiences from others. Hoping that it can help me.

Greeting! Everyone. This post is about Form I-601 Waiver of Grounds of Inadmissibility based on Religious Belief.
I would like to ask question about what are the Requirements or other Documents I can submit except the Form I-601 itself? I've seen and researched and I even joined some I-601 group however not all of them can relate about my case. I opposed vaccination to be straightforward. I haven't took any shots. As in ZERO shots. I just want my other brethren here to help me or share their experience and opinions. I am slightly confused about filling up my Form I-601. Am I the one to fill up the form? Or my U.S Citizen Spouse? We are doing Adjustment of Status. Can you all help me about other documents I need to include? Thank you very much!

You are currently in New Zealand? How are you looking to immigrate? Are you getting the initial medical test so you can get approved for the k1 visa? Hopefully I'm understanding your situation correctly. We did the K1 visa and then the AOS after she moved here and we married.

I can only speak of my own experience of course, but when my wife went through her immigration process (back when she was my fiance), she had her medical for the k1 visa in the Philippines. They tried to bully her into getting vaccines, saying she would be forced to get vaccines in the States for more money. The medical form they filled out actually has a checkbox that says something to the effect of "declined vaccines and will request waiver based on religious or moral grounds". The medical staff did not fill out the form correctly, but it didn't harm our application. This is in the photo I posted previously - it says right on the form that you can request a waiver, yet everyone you talk to will say it can't be done and you'll be forced to vaccinate. I understand how fearful it can be! Despite what people say or think, you have the right to request a waiver for a truly held belief (unless they change the law in the future).

Note: Read everything they try to have you sign. When my wife was getting the k1 visa medical, the medical staff tried to get her to sign a document that, if you read it closely, would have been agreeing to get vaccines. She did not sign it. I'd have to double check with my wife for the details, but as I recall, the medical manager made a note that my wife was refusing vaccines and she ended up not signing it - and they accepted that. Obviously, I can't guarantee how they will handle it where you are. I'm just sharing my experience. We refused testing for any past vaccines. She did have to get a Tuberculosis test, so that took an extra two months for them to confirm it was negative. My wife still got her k1 visa. This part was pretty easy.

Once in the States, we had to pay $930 or so just for the vaccine waiver. I feel this price is high to make sure your belief is real. We submitted this waiver, along with payment, when we submitted the AOS forms. We included a detailed explanation on why we hold this belief. We included research we performed, information about our faith, etc. We included signed letters from other people (i.e., our pastor/etc.) that know us well and who could attest to our belief. The AOS form is where you actually apply for the greencard when following the k1 visa process. This is the part that was scary, as she was not just my fiance now, she was my wife. We did not want her to get sent home! I heard a horror story of another couple going through the interview process, but I found out they got approved in the end.

In our case, the interview was so easy I was literally shocked. But, we have an honestly held belief and that is apparent in our life, our activities, our faith. We were nice, respectful, and easily answered all questions (its easy when the relationship and beliefs are real!). The interviewer was very nice to us.

As far as advice - if you truly hold your belief on vaccines, you have no option but to fight for your rights. If it were me going through this process now (and immigrating to the USA), there's no way I would abandon my relationship or my beliefs. I'd have no choice but to take the chance and continue with the immigration process, get married, and request a waiver.

Again, just sharing my experience - not giving any kind of legal advice. I'd be happy to discuss over private message if you have any more specific questions.

Problem with the waiver because of religious beliefs is that you would have to show that the religious leader of your faith is opposing vaccinations. If you can't show that it might be a problem that's why it was mentioned earlier that you should go with the moral conviction.
These waivers can be very tricky that's why it is always a good idea to get an experienced lawyer for it who knows how to word the thing.

Hi there! I don’t have first hand experience with this, but I found this thread. There is an OP here that provides a very detailed explanation of how they did it. Hope it helps!

Hey, we did get the waiver. We did not have to submit the 693 form. We did a good job documenting our truly held beliefs regarding vaccines; the person who interviewed us for the AOS meeting saw the honesty there and did not give us any grief about it. She approved the waiver before I even had a chance to verbally defend it, haha. I like to think we were blessed and the lady could see the sincerity of both our relationship and our beliefs.

Thanks for the reply Hank. I came to the same conclusion after thinking it over more last night. I will submit the DS-3025 and I-485 (and I-601) and see if they request a new I-693 throughout the process.

I am not aware of any Religions that oppose vaccinations so you would no doubt be applying under moral conviction?. If there is a Religion then you would be able to document their stance.

The waiver application is filed on Form I-601, with fee, together with a sworn statement from the applicant articulating the exact nature of his or her sincere religious belief or moral conviction against vaccines, and how those beliefs would be violated or compromised by complying with the vaccine requirement.

Thank you. Your response practically clarifies this issue.
Although the main question was asked in 2010, still is not outdated.
I personally filed a Vaccine Waiver in 2009 - I did NOT have any problem, therefore my petition WAS successful.
Secondly, vaccines should NOT an obligation. Period. It is a medical advice but not a controlling matter to make an individual subject of it. I have lived 31 years free of vaccines, since I was born, and it goes back to my parents and grandparents and so on.
For this reason the waiver exists and based on the reasons it may be applicable to your case, then please feel free to exercise your rights as well.
Yes, it was granted to me based on Religious grounds, along with three letters translated into English, certified and notarized. The letters were from people who are not from the same church but who have known me since I was born, stating that we practice a healthy lifestyle and though we do not reject medical advice, we chose the option of what is best to our health. Once was from my family's doctor as well.

I realize this is an old thread and the OP is probably not following. I felt compelled to join the forum just to respond to this one thread so that people researching this topic in future have some facts rather than fiction to go on.
I filed i601's for my family of 4 on moral/religious grounds (immunization waivers) for our AOS, and it was granted no questions asked. Like literally, it was the one area that during interview was flicked through, but no verbal reference was made.
I also used Alan Philips who laid out what we needed to present and how to do it.
It is unhelpful that people like me don't follow up on these threads (in this case this was not my thread), but don't take that to mean the petition was denied and the OP is sulking. Unless you hear for sure one way or the other, do not draw a particular conclusion.
My understanding is that quite a lot of people file the immunization waivers and are successful. Most choose not to broadcast it because they don't need the bashing from the pro vaccine crew.
Had this topic been about an i601 based on criminal convictions, the responses would most likely have stuck to the facts rather than resorting to accuse the OP of making poor life choices because they don't agree with them.
So if you're looking for the likelihood of success for filing an immunization waiver, I believe (based on personal experience) that as long as your case is accurately presented and meets the requirements, you will be approved.
    Good luck.

I have hired a vaccination exemption attorney and have prepared for my religious exemption. I was just about to start a new post in here when I noticed this thread. There does not seem to be much information on the entire Internet about peoples' experiences with the waiver. One British man in here said it took him 6 months after interview to get approved as his waiver was sent to CDC Center for Disease Control in Washington, DC. He said he didn't mind the delay as he wasn't in a hurry to get into the US as he was working.
My lawyer is Alan Phillips http://www.vaccinerights.com/ and I purchased his e-book and then hired him to assist me with the I-601 form and affidavit and friends' affidavits and so on. I believe at the interview process I will be denied a visa as the form is sent away for approval. I was hoping to be approved same day but if not I hope the delay is not too long. I also read one in a hundred visa applicants apply for religious exemption, and two in a hundred for philosophical reasons. Philosophical can be more difficult from what I understand to get approved. And the religious exemption has to be sincere. However, the definition of religious is broad as you will see at sites help with the process. There is also an exemption for those allergic to vaccines. Also there are many good sites regarding 'educate before you vaccinate.'
