  2. I wasn't looking at the EB3s, and I didn't say only EB1s moved a year But thanks for pointing that out, both EB1/3 are current so it makes sense for them to move together indeed.
  3. Indeed my lawyer also thinks that based on the relatively less aggressive language re: possibility of future retrogression used in the April VB, the dates should stay as they are for a while. So hopefully that also means EB2s will get invited again. Of course we won't know for sure that EB2s got screwed in this and the past few months until the visa stats are out for Feb-Mar-Apr, but given EB1s jumped almost a year this time, my guess is they did skip inviting the EB2s for this round.

  5. I am no longer interviewing at MTL hence why I am not in that spreadsheet. But this pattern of not inviting EB2s is concerning to me, I can't say for sure it's happening at my embassy yet, but it looks like sth is afoot at MTL, and am trying to see if this is gonna happen everywhere. EDIT: BTW, do you happen to know when that switch to final action dates happened for USCIS?
  6. @LetsGoFast @Monash @Ibbs @DrJh07 @Alice Any IL news ? EB1s are getting invited with DQ's early 2022. I thought you should have gotten your ILs too, although I guess some of you guys became victims of the latest retrogressions . Please let us know. @ALC I assume you didn't get yours either?
  7. They don't. I have done that myself and it went smoothly. Just do a public inquiry, and state that you are a citizen of that country, and you have attached the proof of that, meaning your passport and birth certificate (with translation if needed), and therefore you are eligible for a change of venue for IVP from Montreal to the US embassy/consulate in your country that processes IVs. Don't need to add any other comment or anything like "it would be easier for me to go there" or whatever. The fact that you are a citizen establishes your eligibility. The only thing you should be thinking about are wait times and whether the chances of getting AP'ed is higher or not. I assume officers in your own country would be more familiar than those in MTL with your case, so your chance of immediate visa approval should be higher.

If sb could just confirm by any reaction to this post that they can actually log in, that'd be appreciated. it's literally telling me that my case number and invoice ID don't match!
  10. Hey guys, I recall some of you had a DQ date, which according to the CO updates, should have been already scheduled for interview. Did you contact NVC (how? public inquiry?)and what answer did you get? @akposphil@farzady Sorry if you have already answered this, I couldn't find anything.

You see a lot (320) FB visas issued because in fact even more so were scheduled for interview for the month of November, this was the month where Montreal CO announced that on the FB cases, they jumped from April 2021 to May 2022 DQ dates. At the same time, 70-80 EB cases is something that would keep the EB backlog where it is at. Anything more than that is welcome. In fact, November's 122 is close to the highest number of EB cases being invited in one month (I am counting E1+E2+E3+EW). So it was a good month for EB, not a great month though. Now that FB and IR are without any backlog left (based on the latest Montreal CO announcement), we should expect them to quickly ramp up their EB processing to something like 200+ per month, because they have the capacity to do even more!

  13. Just wanted to confirm this further: I joined a very large group on Telegram of applicants who are or have gone through this process until the end. All attest to the fact that the DQ date is the only thing that matters. So now I feel pretty confident of this answer.
  14. Not a specific date for that. Usually around 20th of each month. This time it would be late December.
  15. Hmm... I suppose there are fewer interview spots because of the holidays. So NVC sends invites for fewer people 😕 ... I don't know !
  16. My lawyer and myself separately asked NVC through the public inquiry channel . For both inquiries NVC was unable to understand the question! They replied with a completely irrelevant answer (first time they said my case is yet to arrive at NVC, second time they said we can't change your venue because you didn't provide proof of residence; lol! we never even asked for that!). So anyways, I couldn't get a guarantee from the NVC that the DQ date is the only criteria. However, my lawyer says that they have conducted additional research on this based on previous cases that they have handled the consulate transfer request, and now they are pretty confident that the DQ date is the only thing that is considered when scheduling the interview, even after a venue transfer. So I think based on the data that's available, the most likely answer to my question is what I thought : Barring some extreme cases/scenarios, it's just the DQ date that matters, and you don't get sent to the end of the line if you change your consulate.
  17. Oh yeah 😁 Have a look at the DS-5535 thread! Although it is true that middle eastern background increases that likelihood significantly, but given discussions I have had with my lawyers, they said that the relative percentage is still the same. However, the total number of AP-ed cases has risen beyond the normal rate. There was another analysis by some lawyers (it was posted in this thread I believe) and they said the same.
  18. Have you taken into account the chances of getting AP-ed and the potentially long wait after? I don't know about your circumstances but AOS is very much preferred to IV these days, esp. because consulates have recently had an abnormally high rate of sending cases to AP.
  19. It's frustrating that EBs moved just one month. but it could also be a good sign that FB backlog has basically been cleared. We should expect big jumps in the EB category in the next months.
  20. Not an expert here, but this looks better than getting directly a DS-5535. Could this be an example of an internal review at the consulate? Meaning the case won't be sent to Washington for administrative processing (which takes much longer). I am recalling a conversation on this podcast by a former consular officer, that mentioned the two types of refusal. From the transcript: "In a discretionary situation ‘at post,’ the consular officer will issue a 221(g) provisional refusal to buy time for further review. In this situation, the applicant has achieved statutory approval, but the officer would like to collect additional information or documentation. These cases are usually resolved quickly."
  21. As you will be able to see for yourself in the thread linked in the previous post, there has been an abnormally high number of EB cases (and from other categories as well) getting AP'ed. Some of it is supposed to be due to the backlog in the usual background check that officers are supposed to have the answer of before the interview with the applicant. They don't get that answer in time or they themselves hadn't had enough time to study the case, so they use AP as a cover to buy themselves more time. I wondered if sb could get a list of how many EB applicants in the EB Google sheet have been AP'ed. Or more precisely how many people have announced here in this thread that they got AP'ed.

  23. They should follow it and I would say I have the exact same issue, and my lawyer didn't ask me for a new PC. These are the guidelines. Give the officer a copy of the NVC website saying that quote in case they ask for a new PC, this should be enough to justify not submitting a new PC. But ... I guess if the officer is insisting too much, there's not a lot you can do at that moment. Usually if they are insisting, it's for some other reason related to the particular circumstances of the individual.
  24. No you don't need to. Quote from NVC's website under Police certificates tab: "Important: Police certificates expire after two years, unless the certificate was issued from your country of previous residence and you have not returned there since the police certificate was issued."
