I am a silent reader in this forum . This forum is more powerful than even hiring a lawyer . I have a lawyer but I gathered all my knowledge here by reading through all the threads and I just want to say a big Thank You to @Stillwinning!!!😊 @sandraj and all the other guys who always chimed in to educate us all on this forum. My journey started in 2019 and it was one of the hardest and most devastated year of my life but with God and you guys I was able to find some strength to do this. I’m a oct 2019 filer and I got my first RFE august 2021and I was so frustrated and depressed all over again with sleepless nights etc but today God showed up and I got a notification for my I 360 that a new card is being produced . I cried with a sense of relief that finally they approved my case . For all of you guys waiting for your case to be adjudicated don’t lose hope just believe in God and take advice from all the educated people on this forum . It’s worth it than even hiring a lawyer . Again Thank you , Thank you all and God’s richest blessings 🙏🏽🙏🏽

    Hello All,

I hope you all are doing great. I've been so busy at work these past few months due to staffing shortages and sometimes have to work straight 4 day shifts, juggle children's activities, but I'm so grateful to God Almighty for the opportunity.
After 3 long years, my I485 has been approved!!! What a beautiful New Year's present!! My attorney's office sent me the I693 first week in December on a Friday immediately they received it, I got my medicals done the very next Monday, received the results back on a Thursday and that same Thursday dropped it off at my attorney's office. Barely 11 days later, which was 2 days ago, I received the notification "card in production" and yesterday "your case has been approved". I normally read where people say it takes 2 months to get the notification for card production, so I was pleasantly surprised and overjoyed that it came so quickly. Being the daughter of The Most High God SURELY has its perks, it grants me VIP status wherever I go, thank you Jesus!! My Father in heaven, the creator of heaven and earth, I am SO PROUD to be your daughter 🥳 🙏🙌.
I just got home from work, so if I don't respond to messages immediately please bear with me as I'm probably passed out on my couch :-), but I will respond as soon as I can.
    Jet setting, let's get it!!

Thank you all and may you be blessed now and always.

    1. Nobody can tell how long before i-485 denial come, but once it comes u may be given about 33 days or so (the last time I checked) to leave the United States or put in removal proceedings.

    2. Yes I meant file before you get the denial letter.  If you file before the denial, You should be able to send a letter of Abeyance based on pending i-360 to Uscis and this will put a hold on  the denial of I-485, and then you can continue to use your work permit and renew.

    3. The negative effect after receiving the letter is that you will have to pay $1,225 again and you have to apply for new work permit, which means you will not be able to work for
months. Work permit is taking a long time now.

    4. You will be sent a letter when i-485 is denied.

    5. Filling vawa after denial will only cost you more and may land you in immigration court.

I am not a lawyer, I only know a little please Speak to an attorney.

    Read the post from perseverance.
Was it stated anywhere the hold was requested?.
    It state i-30 was withdrawn.
Can a requested to hold i-485 happen without filling a vawa?
    What are you saying?
You are the one confusing him.
He has to file something before putting the i-485 on hold.
If he/she doesn't file that vawa, ead will be revoked because the i-485 will automatically be denied.
Why because, the i-130 has been withdrawn.
The more reason i said file vawa fast.

If your i-30 was withdrawn, your i-485 will automatically be denied and your ead revoked.
I know you feel depressed but you have to act fast, put evidences together and file vawa, If possible before the letter get to you.
You will be put in removal proceedings if you do nothing fast, but once you  file vawa you will be untouchable untill decision is made.
Withdrawal of your i-30 and threatening to kick you out of the country can be regarded as extreme cruelty and can be added to other abuse you suffered to build a solid case.
Act fast and don't give up.
See a psychologist and ask for a report
    Draft a declaration
Get an fbi background check or police report from you county
Get pictures of you both together, pictures of dinner dates and trips, wedding pictures, pictures with family and friends.
Take declaration from your friend and pastor of whom you told about the abuse.
    4 passport photos
If you are not motivated enough consult a lawyer.
Keep the process from your spouse.
    I wish you Goodluck....

Don’t feel discouraged quite yet. Vawa still has relatively high chances of approval, imho.
in addition, you never know why the cases have been denied. Maybe they have been withdrawn/abandoned? Maybe an applicant decided to get married and file through their new spouse? Maybe their marriage was ridiculously fake? You never know.

based on my personal experience, here is my advice that no one asked for: please, do NOT purposely look up denied cases, since this will make you overthink and stress out like crazy for no reason. Of course it’s good to know which mistakes not to make, but don’t focus on this too much, please. Not worth it.

Hi folks, today I received this notification and it seems my I360 has been approved. Here you will see my timeline. I was devastated when my marriage finished but now I see a light after all this process. I never received a prima facia during these two years and my I485 was transferred from my marriage process.

btw, my i765 -C09 renewal is still pending since september 2020.

good luck to every one and never lose your faith.

Just got a case status update of card production on my i360 case. I presume it's a C31 EAD, but won't celebrate yet as USCIS is known to make mistakes on the online system. As the British say, there is many a slip between the cup and the lip. I360 receipt date Nov 12, 2019.

I'm not exactly sure since I've never really dealt much with annulments, but considering that your marriage while brief did happen and you were together for X period of time I really don't think that your husband really has a case for annulment. Grounds for annulment are also really strict in NY: https://www.divorcenet.com/resources/annulment/annulment-basics/new_york There is no uncontested annulment in NY, every case goes to trial : https://colwell-law.org/blog/getting-annulment-new-york/
My guess is that the judge would either outright dismiss the case due to lack of factors for annulment or give either of you an option to make it a divorce rather than annulment.

    Hi guys….
    my i-360 finally was approved!
It has been indescribably difficult in many aspects in life…
At least, this approval notice means a lot for me to heal my soul.. Somebody really listens to my story and acknowledges all the heartbreaking moments….
As many of you, I didn’t have any support when I was in the abusive situation.. I felt like I was alone.. Here I am today still alive and try my best to live fully as much as I can with my wounded heart. If there is any progress for i-485, I will keep posting.
🙏🏻 for all of us who are waiting for the news. You are not alone..!

    I-360, i-485 filed in October 2019

You are really not alone feeling that way. And honestly....being forced to talk about things you just wish were gone, things that make you wish like you could disappear...it's just....it's just a paradox...when it comes to some things, you cannot get "justice" and "protection" without reporting, talking, being exanimated, being interrogated, etc, etc. All of this it's a violation in itself. It is just a paradox...like you have to get more abused to repair the abuse.... So, you really are not alone in your feelings...

As for the I-864, do you have the receipt number? Can you check the status online? But in the end, it does not really matter...you file your petition and fight on your own to stay here. You will make it!

Do anybody here find just going through filing VAWA extremely hard and mental draining? I actually felt a lot better after separating with the abuser. However, talking about my experiences with therapists & lawyers just brings me back to where I was.
Since I was never subjected to physical abuse, having to prove that I was actually abused messes me up. I don’t feel like nobody would validate my feelings or experiences. I know therapists & lawyers I spoke with intended to help me, but hearing stuff like ‘you need more evidences’ hurt me deep down. part of me is still questing if I was actually abused or I am just over-reacting, dramatic, and whiny. (as my abuser used to claim)
I sort of just want to leave everything behind and move on, but the process itself doesn’t let me do so. It requires me to assert I was victimized so bad, but I don’t want to feel victimized. I want to focus on good parts of my life moving forward. Whenever I talk to therapists or lawyers, I feel low all day. It’s hard to dig through all the memories I would rather forget, then try to document them so that I would be able to build a stronger case.
I am scared of eventually getting denied VAWA, not just because I’ll have to leave the states, but mainly I don’t know if I’ll be able to handle that feeling of ultimate invalidation on my experiences. Since big essential part of the abuse was invalidating my feelings, making me feel nothing I feel is eight, and I’m just crazy.

Hello Everyone, my journey has been one filled with highs and lows, tears, fake “I am ok’s”, wth’s and I thank God that I got my approval finally and I just want to encourage someone here today not to lose hope. Hang on to the last ounce of strength you got within you because, eventually your sunrise is coming. Here’s my timeline. I reside in Dallas.
Filed my 360, I-765 and I-131 in 05/2019 for my Vawa case.
I have renewed my work permit like 4 times and the last one which I did late last year took some time, but overall, I cannot say I experienced a delay that kept me out from work.
My I-485, I-130, I-765 and I-131 that I had filled with my Ex were still open, but no action was taken with these cases till the last minute after my approval where the I-485 status changed to “Case Closed Benefit Received By Other Means.”
My I-360 was approved in Jan 2021.
I got my “interview was scheduled” for the I-485 that I filed with the Vawa case at the end of the month in 04/2021.
I got another "Interview was scheduled” for the I-485 case I had initially filed with my ex, that was just on hold in mid-May; 05/2019.
My interview was scheduled for the beginning of June this year; 06/2021 for the Vawa
Another interview was also scheduled for the initial I-485 with my ex for mid-June; 06/2021 which we told the IO we will not be perusing and won’t show up for the said interview later that month when I went in for my Vawa interview. The IO said that will be cancelled automatically after the Vawa I-485 was approved.
I waited for the whole of June, July and at the end of August 08/2021, my case was finally approved. The wait for this approval was heartbreaking. We even submitted a letter to ask what the delay was all about, but received no response.
My interview was pretty short, all we did was submit my medicals and update the I-485 responses.
My card was delivered mid-September; 09/2021.
I hope this helps someone. Remember to be still and let God do his will. It may tarry, but your approval is coming too.
    Blessings! ❤️
